13.6 Subject to the general directi<strong>on</strong>s set out in the A(SP)A, the Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> State enjoys<br />

c<strong>on</strong>siderable discreti<strong>on</strong> in the exercise <str<strong>on</strong>g>of</str<strong>on</strong>g> the statutory powers, including the development <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

both policy and administrative procedures. 8 For example, following an announcement by the<br />

Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> State before Parliament, the Home Office adopted a policy whereby licences for<br />

scientific procedures using <str<strong>on</strong>g>animals</str<strong>on</strong>g> to test cosmetics, or procedures that involve the great<br />

apes would not be issued. 9 <str<strong>on</strong>g>The</str<strong>on</strong>g> Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> State has thereby used the administrative powers<br />

to effect a de facto ban. Similarly, by attaching a standard c<strong>on</strong>diti<strong>on</strong> to all certificates <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

designati<strong>on</strong> that every establishment shall have a local ERP, this provisi<strong>on</strong> has become a<br />

mandatory requirement (paragraph 13.21).<br />

13.7 Secti<strong>on</strong>s 19 and 20 <str<strong>on</strong>g>of</str<strong>on</strong>g> the A(SP)A established the APC, which was first appointed in 1987.<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> APC provides independent advice to the Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> State <strong>on</strong> any matters related to<br />

the A(SP)A as it sees fit or as may be referred to it by the Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> State (see Box 13.2<br />

and paragraph 13.16).<br />

Box 13.2: <str<strong>on</strong>g>The</str<strong>on</strong>g> Animal Procedures Committee<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> APC is composed <str<strong>on</strong>g>of</str<strong>on</strong>g> scientists, lawyers, veterinary<br />

surge<strong>on</strong>s, doctors, animal welfarists and philosophers.<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> Committee was established by the A(SP)A, which<br />

specifies that the Committee should comprise a<br />

chairman and at least 12 other members. At least two<br />

thirds <str<strong>on</strong>g>of</str<strong>on</strong>g> the members should have qualificati<strong>on</strong>s or<br />

experience in a relevant biological subject or have full<br />

registrati<strong>on</strong> as a medical practiti<strong>on</strong>er or veterinary<br />

surge<strong>on</strong> and at least <strong>on</strong>e member should be a barrister,<br />

solicitor or advocate. <str<strong>on</strong>g>The</str<strong>on</strong>g> Act also states that the<br />

Secretary <str<strong>on</strong>g>of</str<strong>on</strong>g> State, resp<strong>on</strong>sible for appointments to the<br />

committee, should take into account the desirability <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

ensuring that the interests <str<strong>on</strong>g>of</str<strong>on</strong>g> animal welfare are<br />

represented. Usually <strong>on</strong>e member <str<strong>on</strong>g>of</str<strong>on</strong>g> the Committee is<br />

an academic philosopher.<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> A(SP)A in practice<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> A(SP)A specifies that the APC should have regard to<br />

both the requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> science and industry and the<br />

protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>animals</str<strong>on</strong>g> against avoidable suffering and<br />

unnecessary use. <str<strong>on</strong>g>The</str<strong>on</strong>g> Committee has the dual functi<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> advising <strong>on</strong> certain licence applicati<strong>on</strong>s when asked<br />

and independently advising <strong>on</strong> policy and practice.<br />

Most licence applicati<strong>on</strong>s are assessed by the Home<br />

Office Animals (Scientific Procedures) Inspectorate (see<br />

paragraph 13.20). However, there are certain categories<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> project applicati<strong>on</strong>s that the APC also c<strong>on</strong>siders,<br />

including those that involve the use <str<strong>on</strong>g>of</str<strong>on</strong>g> wild-caught<br />

primates and primates in procedures <str<strong>on</strong>g>of</str<strong>on</strong>g> substantial<br />

severity. <str<strong>on</strong>g>The</str<strong>on</strong>g> APC advises the Home Secretary <strong>on</strong> these<br />

applicati<strong>on</strong>s, but does not itself decide <strong>on</strong> the outcome.<br />

13.8 <str<strong>on</strong>g>The</str<strong>on</strong>g> A(SP)A requires that three separate licences, which are described in more detail below,<br />

must be obtained before any animal is used in a regulated procedure.<br />

i) A pers<strong>on</strong>al licence authorises an individual to c<strong>on</strong>duct specified regulated procedures <strong>on</strong><br />

specified animal species, at a specified place or places. A pers<strong>on</strong>al licence by itself does<br />

not authorise a pers<strong>on</strong> to carry out any procedures. Rather, the authorisati<strong>on</strong> may <strong>on</strong>ly<br />

be used in c<strong>on</strong>juncti<strong>on</strong> with two further licences (paragraphs 13.12–13.13).<br />

ii) A project licence forms the centrepiece <str<strong>on</strong>g>of</str<strong>on</strong>g> the licensing process. This licence authorises<br />

individuals who hold a pers<strong>on</strong>al licence to c<strong>on</strong>duct a particular programme <str<strong>on</strong>g>of</str<strong>on</strong>g> work, for<br />

specific purposes, at <strong>on</strong>e or more specified designated establishments. It also describes<br />

the types <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>animals</str<strong>on</strong>g> involved, the estimated numbers <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>animals</str<strong>on</strong>g> that are intended to be<br />

used, the prospective severity banding <str<strong>on</strong>g>of</str<strong>on</strong>g> the project and individual severity limits for the<br />

protocols c<strong>on</strong>tained in it (paragraphs 13.14–13.18 and Box 13.3).<br />

iii) A certificate <str<strong>on</strong>g>of</str<strong>on</strong>g> designati<strong>on</strong> is issued to a pers<strong>on</strong> authorising a specified facility (called a<br />

‘designated establishment’) to c<strong>on</strong>duct animal procedures and/or breed or supply<br />

<str<strong>on</strong>g>animals</str<strong>on</strong>g> for use in regulated procedures (paragraph 13.19).<br />

CHAPTER 13 LEGISLATION, REGULATION AND POLICY RELATING TO SCIENTIFIC PROCEDURES<br />
