Bill advises on EC and multi-jurisdictional merger control laws in relation to mergers and
joint ventures. Recent projects include Cisco/WebEx, Cisco/Ironport, Cisco/Navini,
Cisco/Linksys/Belkin (for Cisco), ADM/Pura, ADM/Elstar, ADM/Wilmar (for ADM),
Amex/Fortis/Alphacard (for Alphacard); OTPP/Camelot (for OTPP), Canal+/TVN/n (for
Canal+), Biogen Idec/Elan (for Biogen).
Bill regularly counsels clients on collaboration and distribution strategies, including copromotion/co-branding,
B2B platforms, media distribution arrangements and go-tomarket
channel programmes, including the 3G mobile, data networking, telecoms,
lifescience and software sectors.
Bill is acting for complainants and defendants in cartel and market power investigations.
Recent projects include: reversing a Commission cartel decision in the Synthetic
Rubber cartel; successfully securing one of the lowest negotiated settlements in the
seven year long DRAM investigation; securing significant reductions in fine for Archer
Daniels Midland in respect of the Citric Acid, Amino Acids and Sodium Gluconate
investigations before the UK and EU authorities as well as before the EU courts;
successfully representing KirchMedia (now Infront) before the EU courts reversing
approval of a UK law mandating free-to-air coverage of the FIFA World Cup; defending
a large multinational bank in the Belgian Banks cartel investigation of the European
Commission into the fixing of currency conversion rates leading to a successful
settlement; successfully defending a global software company in antitrust litigation
before the Greek courts; securing access to interface information for a complainant from
the UK competition authorities in respect of a dominant software vendor; successfully
defending abuse of dominance investigations by the EU and German authorities in
relation to a well known global IT company.
Bill graduated from Bristol University and has also studied at the University of Hanover.
Bill qualified as a solicitor (England & Wales) in 1998.
In addition to in-house and client briefs on competition law, commercial and gambling
issues, Bill’s external publications include contributing to Butterworths Competition Law,
Cartels Chapter, Sweet & Maxwell’s IT Encyclopaedia, Competition Law Chapter,

MICHAEL BAYE is the Bert Elwert Professor of Business at Indiana University’s Kelley
School of Business. He served as the Director of the Bureau of Economics at the US
Federal Trade Commission during 2007 and 2008. Michael is also a Special Consultant
for NERA Economic Consulting, and has provided expert testimony in matters ranging
from advertising and pricing to mergers and monopolization. He has provided written
and oral expert testimony for the Canadian Competition Bureau, the US Department of
Justice, and numerous private parties.
