BY-LAW NUMBER 76 OF 2012
Being a By-law to amend the schedules for the collection of sums from the lands
assessed for the maintenance of the Bendway Weir Erosion Protection
WHEREAS:

The Municipality of Lambton Shores undertook the Bendway Weir
Erosion Control Project hereinafter referred to as “The Works”, as a
result of a petition submitted by residents under the Local
Improvement Charges – Priority Lien Status – O. Reg. 586/06;
One of the conditions of the construction of “The Works” was that
the costs for any maintenance of “The Works” would be billed to the
benefitting landowners on the same proportional basis as the
original capital contributions;
In By-law 63 of 2011, the sums for maintenance of “The Works” for
the years 2011 – 2013 were allocated and assessed upon the
benefitting lands pro-rata based on the schedule of assessment
confirmed by the “Committee of Revision;
AND WHEREAS: Since the schedule of assessment was confirmed and By-law 63
of 2011 passed, a property on Armstrong West has been severed,
which requires the Schedules of By-law 63 of 2011 to be
amended;
THEREFORE:
The Municipal Council of the Municipality of Lambton Shores
enacts as follows:
That Schedule “A” and Schedule “B” to By-law 63 of 2011 be amended as follows:
1. That the following charge be deleted from Schedule “A”:
