i) Deductions <strong>for</strong> absence from duty, i.e. from <strong>the</strong> place or places where by <strong>the</strong> terms of<br />

his employment he is required to <strong>work</strong>. The amount of deductions shall be in<br />

proportion to <strong>the</strong> period <strong>for</strong> which he was absent.<br />

Deductions <strong>for</strong> damage to or loss of good expressly entrusted to <strong>the</strong> employed person<br />

<strong>for</strong> custody or <strong>for</strong> loss of money <strong>for</strong> which he is required to account whereas such<br />

damage or loss is directly attributable to his neglect or default.<br />

Any o<strong>the</strong>r deductions, which <strong>the</strong> Orissa Govt. may from time to time allow.<br />

b) No fines shall be imposed on a <strong>work</strong>er and no deduction <strong>for</strong> damage or loss shall be made<br />

from his wages until <strong>the</strong> <strong>work</strong>er has been given an opportunity of showing cause against<br />

such fines or deduction.<br />

c) The total amount of fines which may be imposed in any one wage period on a <strong>work</strong>s shall<br />

not exceed an amount equal to five paise in a rupee of <strong>the</strong> wages payable to him in respect<br />

of that wage period.<br />

d) No fine imposed on any <strong>work</strong>er shall be recovered from him by installments, or after <strong>the</strong><br />

expire of 60 days from <strong>the</strong> date on which it was imposed.<br />

8. Register of fines, etc. :<br />

i) The Contractor shall maintain a register of fines and of all deductions <strong>for</strong> damage or loss.<br />

Such register shall mention <strong>the</strong> reason <strong>for</strong> which fine was imposed or deduction <strong>for</strong> damage<br />

or loss was made.<br />

ii)<br />

The Contractor shall maintain a list of English and <strong>the</strong> in <strong>the</strong> local Indian Language, clearly<br />

defining acts and omissions <strong>for</strong> which penalty of fine can be imposed. It shall display such<br />

list and maintain it in a clean and legible condition in conspicuous places on <strong>the</strong> <strong>work</strong>.<br />

9. Preservation of register:<br />

The wage register, <strong>the</strong> wage cards and <strong>the</strong> register of fines, deduction required to be<br />

maintained under <strong>the</strong>se regulations shall be preserved <strong>for</strong> 12 months after date of <strong>the</strong> last entry<br />

made in <strong>the</strong>m.<br />

10. Powers of Labour Welfare Officers to make investigations of inquiry:<br />

The Labour Welfare Officer or any o<strong>the</strong>r persons authorized by <strong>the</strong> Government of Orissa on <strong>the</strong>ir<br />

behalf shall have power to make inquiries with a view to ascertaining and en<strong>for</strong>cing due and proper<br />

observance of <strong>the</strong> fair wage clause and <strong>the</strong> provisions of <strong>the</strong>se regulations. He shall investigate<br />

into any complaint regarding default made by <strong>the</strong> Contractor, sub-contractor in regard to such<br />

provisions.<br />
