consequence if any, including <strong>the</strong> cost <strong>the</strong>re to shall be exclusively borne by <strong>the</strong> Contractor<br />

and <strong>the</strong> Corporation shall have no liability whatsoever on this account.<br />

41. The Contractor is required to a<strong>bid</strong>e by <strong>the</strong> fair wages clause as introduced by <strong>the</strong> Govt. of<br />

Orissa in Works Deptt., letter No.LA-VIIR-18-16/52/75 Dt.26.02.1965, No.II-36/61-28812(A)<br />

Dtd.27.5.1961 and No.IIM-58-77-22059 Dtd.16.8.1977 or as modified from time to time.<br />

42. The Corporation reserves <strong>the</strong> right to award a single group or more groups to any tenderer<br />

depending on his capability as ensured by <strong>the</strong> authorised officer of <strong>IDCO</strong> and also reserves<br />

<strong>the</strong> right to accept or reject any or all offers without assigning any reason <strong>the</strong>reof.<br />

43. The Contractor will enlist himself with State Labour Department and with Regional<br />

Provident Fund Commissioner and will a<strong>bid</strong>e by <strong>the</strong> statutory rules and acts being en<strong>for</strong>ced<br />

by <strong>the</strong>m like labour license etc. In case of any complaint by <strong>the</strong>m, pecuniary or o<strong>the</strong>rwise.<br />

<strong>IDCO</strong> is entitled to recover such of <strong>the</strong>ir claims from <strong>the</strong> dues of <strong>the</strong> Contractor and dispose<br />

<strong>the</strong> same as instructed by <strong>the</strong>m and may terminate <strong>the</strong> contract, in case of violation.<br />

44. The Contractor shall be required to obtain requisite license from <strong>the</strong> concerned Labour<br />

Officer <strong>for</strong> employment of labours in <strong>work</strong> and should follow <strong>the</strong> prevailing labour laws.<br />

45. Concrete <strong>for</strong> rein<strong>for</strong>cement, cement concrete and flooring shall generally be machine<br />

mixed, unless o<strong>the</strong>rwise permitted by authorized Officer of <strong>IDCO</strong>. Concrete mixer if<br />

available can be supplied by <strong>the</strong> Corporation at approved hire charges of <strong>the</strong> Corporation<br />

which will include <strong>the</strong> running and maintenance and pay of <strong>the</strong> machine operator.<br />

46. All gold, silver and o<strong>the</strong>r things of any subscriptions, precious stones, coins, treasures,<br />

relics, antiques, and o<strong>the</strong>r similar things which shall be found in, under or upon <strong>the</strong> site,<br />

shall be <strong>the</strong> property of <strong>the</strong> Corporation.<br />

47. Price escalation will not be allowed under any circumstances. The Contractor should quote<br />

his rates taking <strong>the</strong> above into consideration.<br />

48. Recovery rate of Departmental machineries with consumables (As per rates fixed by <strong>the</strong><br />

Corporation from time to time).<br />
