liabilities Civil or Criminal arising out of <strong>the</strong> contract be liable to pay a penalty equivalent to<br />

five times <strong>the</strong> price of <strong>the</strong> materials on stock, accounting to <strong>the</strong> stipulated rate and <strong>the</strong><br />

penalty so imposed shall be recovered from any sum that may <strong>the</strong>n or at any time<br />

<strong>the</strong>reafter become due to <strong>the</strong> Contractor or from his security deposit or <strong>the</strong> proceeds of sale<br />

<strong>the</strong>reof<br />

20. The Contractor should be fully liable to indemnify <strong>the</strong> Corporation <strong>for</strong> payment of any<br />

compensation under <strong>work</strong>men’s compensation Act VIII of 1923 on account of <strong>the</strong> <strong>work</strong>men<br />

being employed by him and <strong>the</strong> full amount of compensation paid will recovered from <strong>the</strong><br />

Contractor.<br />

21. Every tenderer is expected be<strong>for</strong>e quoting his rates to inspect <strong>the</strong> site of proposed <strong>work</strong>. He<br />

should also inspect <strong>the</strong> quarries and satisfy himself about <strong>the</strong> quality and availability of<br />

materials, medical aids, labour and foodstuffs etc., and <strong>the</strong> rates may be inclusive of all <strong>the</strong><br />

items of <strong>work</strong>. In every case <strong>the</strong> materials must comply with <strong>the</strong> relevant specification.<br />

22. For <strong>the</strong> purpose of jurisdiction in <strong>the</strong> event of dispute, if any, contract should be deemed to<br />

have been entered into at <strong>the</strong> place, where <strong>the</strong> contract is signed on behalf of <strong>the</strong><br />

Corporation within <strong>the</strong> State of Orissa and it is agreed that, ei<strong>the</strong>r party to <strong>the</strong> contract or<br />

<strong>the</strong> agreement will be competent to bring a suit in regard to <strong>the</strong> matters covered by this<br />

contract at Bhubaneswar within <strong>the</strong> State of Orissa.<br />

23. After <strong>the</strong> <strong>work</strong> is finished, all surplus materials and debris are to be removed by <strong>the</strong><br />

Contractor and preliminary <strong>work</strong>s such as vats, mixing plat<strong>for</strong>ms etc. are to be dismantled<br />

and all <strong>the</strong> materials are to be removed from <strong>the</strong> site. No extra payment will be made to <strong>the</strong><br />

Contractor on this account. The rate quoted should be inclusive of all <strong>the</strong>se items.<br />

24. The Corporation will have <strong>the</strong> right to inspect <strong>the</strong> scaffolding and centering made <strong>for</strong> <strong>the</strong><br />

<strong>work</strong> and can reject partly or fully such structure if found defective in <strong>the</strong>ir opinion.<br />

25. The Contractor will have to arrange <strong>for</strong> water supply and electricity at his own cost <strong>for</strong> all<br />

<strong>work</strong>s and make sanitary arrangements <strong>for</strong> his <strong>work</strong>men employed at his own cost <strong>for</strong> his<br />

labour camps. Contractor has to arrange adequate lighting arrangements <strong>for</strong> night <strong>work</strong><br />

whenever necessary at his own cost.<br />

26. The tenderer shall have to a<strong>bid</strong>e by <strong>the</strong> C.P.W.D. Safety Code introduced by <strong>the</strong><br />

Government of India, Ministry of Works Housing and Supply in <strong>the</strong>ir standard order<br />

No.44250 Dt.25.11.57.<br />
