Chad J Haynes, age 36 <strong>of</strong> Kenna plead guilty on March 16, <strong>2009</strong> to one (1) felony count <strong>of</strong> Obtaining<br />

Money by False Pretense since his crime predated <strong>the</strong> insurance code. In exchange for Mr. Haynes’<br />

plea, pending charges against his wife for her role in <strong>the</strong> crime were dismissed. In 2003, <strong>the</strong> Haynes’<br />

had reported <strong>the</strong>ir 2001 Yamaha motorcycle missing and subsequently filed a police report and<br />

insurance claim. After a thorough investigation by <strong>the</strong> WVOIC Fraud Unit, <strong>the</strong> motorcycle was located<br />

still in <strong>the</strong> possession <strong>of</strong> <strong>the</strong> Haynes’s. Mr. Haynes was given probation and ordered to pay restitution<br />

in <strong>the</strong> amount that was determined by <strong>the</strong> Adult Probation Department.<br />

Amy E. Hedrick, age 35 <strong>of</strong> Jane Lew plead “no contest” to a reduced charge <strong>of</strong> misdemeanor count <strong>of</strong><br />

<strong>Insurance</strong> Application Fraud on May 21, <strong>2009</strong>. She received a $10.00 fine and $159.53 Court costs.<br />

Ms. Hedrick must also pay her Court Appointed Attorney fees. Ms. Hedrick falsified an application<br />

for health insurance coverage for her husband indicating <strong>the</strong>re were no pre-existing conditions. After a<br />

thorough investigation it was determined that <strong>the</strong>re were numerous pre-existing conditions for which<br />

her husband was subsequently hospitalized for approximately 30 days shortly after <strong>the</strong> policy was<br />

taken out, resulting in a loss <strong>of</strong> approximately $37,000 to <strong>the</strong> insurance company.<br />

Paul D. Krimm, age 50 <strong>of</strong> Hurricane plead guilty to a reduced count <strong>of</strong> filing a fraudulent claim to an<br />

insurance company on January 20, <strong>2009</strong> and received two (2) years probation and was ordered to pay<br />

restitution to State Farm in <strong>the</strong> amount <strong>of</strong> $49,286.75<br />

Mr. Krimm had reported his 2004 Mercedes Benz 500 was stolen and eventually filed an insurance<br />

claim after <strong>the</strong> car was found “burned out” approximately 2 miles from his mo<strong>the</strong>r in laws house.<br />

Andrew R. Talbott, age 33 <strong>of</strong> Martinsburg pleaded “No Contest” to one count <strong>of</strong> Forgery and was<br />

sentenced to six (6) months plus one (1) day and an additional thirty (30) days for providing False<br />

<strong>Insurance</strong> Information. The sentences were to run concurrently with each o<strong>the</strong>r and with any time<br />

sentenced on additional pending felony charges. He was also charged $319.00 for court costs. Ano<strong>the</strong>r<br />

charge for forgery was dismissed. On March 2, 2007, Mr. Talbott directed ano<strong>the</strong>r individual to<br />

present fraudulent insurance information to <strong>the</strong> Martinsburg Division <strong>of</strong> Motor Vehicles Office while<br />

attempting to submit two vehicle applications for titles.<br />

Delphia Trout , 52 <strong>of</strong> Genoa and Elwood Robertson age unknown <strong>of</strong> Genoa, each plead guilty to<br />

one (1) felony count <strong>of</strong> filing a false claim with an insurance company. Each were given identical<br />

sentences <strong>of</strong> twelve (12) months in jail, suspended in lieu <strong>of</strong> three (3) years probation and a fine <strong>of</strong><br />

$250 plus court costs. Delphia Trout reported a false insurance claim in which her vehicle (1995 Jeep)<br />

had supposedly sustained damage in a hit and run incident while her son, Mr. Robertson was in <strong>the</strong><br />

vehicle. It was later determined <strong>the</strong> vehicle had been wrecked by Ms. Trout’s husband while he was<br />

intoxicated a day earlier.<br />
