eceives notice from another agency or when <strong>TCEQ</strong> independently documents a case<br />

of groundwater contamination, the <strong>TCEQ</strong> must make every effort to provide notice,<br />

via first class mail, to each owner of a private drinking water well that may be<br />

affected by the contamination. The notice must be provided within 30 days of the<br />

determination (or receipt of information from another agency). Additionally, notice<br />

must also be provided to any applicable groundwater conservation district.<br />

The TGPC adopted rules as required by the statute to “prescribe the form <strong>and</strong> content<br />

of notice” provided by the <strong>TCEQ</strong>. New 31 TAC §601.10 became effective on<br />

November 12, 2003 (Appendix 4). The <strong>TCEQ</strong> Executive Director sent letters to other<br />

members of the TGPC to alert them of the statute <strong>and</strong> their need to inform <strong>TCEQ</strong> of<br />

new cases of contamination. Since the statute became effective on September 1,<br />

2003, <strong>TCEQ</strong> staff has implemented various activities resulting in mailed notice to<br />

well owners within the m<strong>and</strong>ated timeframe. 39 new cases of contamination during<br />

calendar year 2009 required notice to private drinking water well owners <strong>and</strong> are<br />

listed in Figure 4.<br />
