hospitals, clinics, laboratories, <strong>and</strong> other testing centers primarily, by ensuring<br />
the training <strong>of</strong> competent personnel who will provide such services in said<br />

WHEREAS, Republic <strong>Act</strong> 8504 otherwise known as "the <strong>Philippine</strong><br />
AIDS <strong>Prevention</strong> <strong>and</strong> Control <strong>Act</strong> <strong>of</strong> <strong>1998</strong>" was signed into Law by<br />
the President <strong>of</strong> the Republic <strong>of</strong> the <strong>Philippine</strong>s on February 13, <strong>1998</strong>.<br />
WHEREAS, <strong>The</strong> <strong>Philippine</strong> National AIDS Council, a multi-sectoral,<br />
central advisory, planning <strong>and</strong> policy making body is m<strong>and</strong>ated by<br />
Law to oversee a comprehensive <strong>and</strong> integrated HIV/AIDS prevention<br />
<strong>and</strong> <strong>control</strong> program in the <strong>Philippine</strong>s whose members were sworn<br />
into <strong>of</strong>fice by the President <strong>of</strong> the Republic <strong>of</strong> the <strong>Philippine</strong>s on April<br />
6, 1999.<br />
WHEREAS, Article IX, Section 49 <strong>of</strong> Republic <strong>Act</strong> 8504 states that<br />
within six (6) months after it is fully reconstituted, <strong>The</strong> <strong>Philippine</strong> National<br />
AIDS Council is m<strong>and</strong>ated to formulate <strong>and</strong> issue the appropriate<br />
rules <strong>and</strong> regulations necessary for the implementation <strong>of</strong> Republic<br />
<strong>Act</strong> 8504<br />
BE IT RESOLVED AS IT IS HEREBY RESOLVED, that We, <strong>The</strong> Members<br />
<strong>of</strong> the <strong>Philippine</strong> National AIDS Council do hereby order <strong>and</strong> issue<br />
the following Implementing Rules <strong>and</strong> Regulations.<br />
SUBJECT: Rules <strong>and</strong> Regulations Implementing Republic<br />
<strong>Act</strong> No. 8504 otherwise known as the "<strong>Philippine</strong> AIDS<br />
<strong>Prevention</strong> <strong>and</strong> Control <strong>Act</strong> <strong>of</strong> <strong>1998</strong>".<br />
Pursuant to Section 49 <strong>of</strong> Republic <strong>Act</strong> No. 8504, otherwise known<br />
as the <strong>Philippine</strong> AIDS <strong>Prevention</strong> <strong>and</strong> Control <strong>Act</strong> <strong>of</strong> <strong>1998</strong>, the<br />
following Implementing Rules <strong>and</strong> Regulations are hereby adopted.

Council (PNAC) shall ensure that all public health workers are trained<br />
on HIV/AIDS. In the private sector, it shall be the responsibility <strong>of</strong> the<br />
head <strong>of</strong> the health institution or agency to qualify the health workers<br />
under his or her jurisdiction as trainers <strong>and</strong> educators for the HIV/<br />
AIDS education <strong>and</strong> information program.<br />
