established in 1947 by the Legislature<br />

as a protected title, using<br />

the final recommended criteria<br />

developed last year, and according<br />

to Board schedule.<br />

The Board discussed the staff<br />

review in c<strong>on</strong>siderable detail and<br />

listened to testim<strong>on</strong>y from witnesses.<br />

This is the first <str<strong>on</strong>g>of</str<strong>on</strong>g> 13 preliminary<br />

reports to be compiled by<br />

the Board for reviewer comment<br />

during the next 3 to 4 m<strong>on</strong>ths, in<br />

resp<strong>on</strong>se to the recommendati<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the "Schulman Report" <str<strong>on</strong>g>of</str<strong>on</strong>g> last<br />

year.<br />

Copies <str<strong>on</strong>g>of</str<strong>on</strong>g> this initial report will<br />

be distributed to the entire Board<br />

mailing list. Subsequent reports<br />

will be limited to those pers<strong>on</strong>s<br />

desiring to be placed <strong>on</strong> a special<br />

mailing list for future reports.<br />

The Board accepted the report<br />

and approved distributi<strong>on</strong>.<br />

Listening to the lengthy discussi<strong>on</strong>s<br />

by the Board, a number <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

impressi<strong>on</strong>s about the present<br />

Board's attitudes and c<strong>on</strong>cerns<br />

could be discerned:<br />

1. The Board's attitudes about<br />

the "grandfather" c<strong>on</strong>cept is very<br />

low. While "vested rights" were<br />

not specifically menti<strong>on</strong>ed, I feel<br />

that the two go hand-in-hand, <strong>on</strong>e<br />

cannot functi<strong>on</strong> without the<br />

other. Hence, <strong>on</strong>e must c<strong>on</strong>clude<br />

that "vested rights" are also law.<br />

2. An interesting effect <str<strong>on</strong>g>of</str<strong>on</strong>g> SB 2<br />

was also c<strong>on</strong>sidered by the Board.<br />

An ROE who let his license lapse,<br />

had requested reinstatement.<br />

This particular individual had<br />

specialized in land surveying. The<br />

Board had to decide whether<br />

reinstatement after January 1,<br />

1982 subjected him to the provisi<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> SB 2.<br />

3. The Board also had to decide<br />

whether the present Director <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Cal-Trans should be disciplined<br />

for practicing civil engineering<br />

without a hcense. (The bridge<br />

width c<strong>on</strong>troversy in Mendocino<br />

County).<br />

After much discussi<strong>on</strong>, the<br />

Board accepted counsel's opini<strong>on</strong><br />

that the Board lacked jurisdicti<strong>on</strong>.<br />

5. The Board has amendments<br />

proposed for Board Rule 424<br />

(experience). Affects Secti<strong>on</strong>s<br />

8741 and 8742 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Land Surveyors<br />

Act.<br />
