Opinion No. 2012-20 

Re: State Boards, Commissions and Authorities—State 

Lottery—Kansas Expanded Lottery Act; Restrictions on 

State and Local Officials and Affiliated Persons. 

Synopsis: K.S.A. 2011 Supp. 74-8762(b) provides that 

‘‘[n]o state or local official or affiliated person shall hold, 

directly or indirectly, an interest in’’ a casino. This prohibition 

refers to ownership or control of a legal or equitable 

interest in a casino; a person does not hold an 

interest in a casino merely by working for or owning a 

stake in a company that does business with the casino. 

For purposes of K.S.A. 2011 Supp. 74-8762(b), a state or 

local official, or affiliated person, is ‘‘employed by’’ a casino 

if the person is an ‘‘employee’’ of the casino, a term 

that does not include independent contractors or individuals

Application. 

Synopsis: The Organized Service Collection Act is triggered 

by a municipality’s decision to establish an organized 

collection service as defined by K.S.A. 2011 Supp. 

12-2035(b), and does not apply to the renewal or renegotiation 

of contracts for an existing organized collection 

service system. K.S.A. 2011 Supp. 12-2001(a)(6) does not 

prohibit a city or county from contracting for solid waste 

collection services in lieu of granting a franchise for such

Office of the Governor 

Notice of Available Grant Funding 

Grant funds are available from the Federal John R. Justice 

Grant Program for calendar year 2013. The purpose 

of this grant program is to provide student loan repayment 

assistance for full-time local, state and federal government 

public defenders and full-time local and state 

government prosecutors who commit to serving as public 

defenders and prosecutors for at least three years. The 

available grant award is $51,252, which will be split 

evenly between prosecutors ($25,626) and public defenders 

($25,626). Federal John R. Justice Grant funds awarded 

under this program are a supplement to, not a substitute 

for, personal student loan obligations. To be eligible to 

receive funding an attorney must not be in default on 

repayment of any federal student loans.

Request for Proposals 

Kansas Rehabilitation Services (KRS), a division of the 

Kansas Department for Children and Families, announces 

the release of a competitive request for proposals 

for centers for independent living to provide the four core 

independent living services (information and referral, independent 

living skills training, peer support, and individual 

and systems advocacy) and deinstitutionalization 

supports to persons with a disability in the following 

Kansas counties: Atchison, Doniphan, Brown and Jackson. 

Community-based private nonprofit, nonresidential 

agencies or organizations are eligible to submit proposals. 

Applicants must meet Section 725(c) (1) of the Rehabilitation 

Act of 1973, as amended, as well as 34 CFR 364.4 

(b), to be an eligible agency.

Request for Proposals 

The Kansas Department for Children and Families and 

the Kansas Children’s Cabinet and Trust Fund announce 

the release of a request for proposals for the Kansas Early 

Childhood Block Grant. This grant is designed to provide 

early childhood services to at-risk children (age 0-5) and 

their families to meet specific early childhood outcomes. 

Eligible applicants are nonprofit agencies/organizations, 

including faith-based and community organizations, 

with expertise in serving the at-risk birth to five populations 

and their families; and unified school districts or 

county governments. The proposals must reflect evidence-based 

approaches to achieve outcomes that enhance 

school readiness for at-risk children. Evidencebased 

practice (EBP) is the integration of the best 

available research within the context of the child, family 

and community characteristics. 

Vendors interested in submitting a proposal can download 

the RFP from the Kansas Children’s Cabinet website 

at www.kschildrenscabinet.org. Complete proposals 

should include one original and five copies and be sent 

to Kansas Children’s Cabinet and Trust Fund, Room 152, 

Landon State Office Building, 900 S.W. Jackson, Topeka,

Department of Transportation 

Request for Applications for FTA Program Funding 

The Kansas Department of Transportation, Office of 

Public Transportation is now accepting applications for 

the Federal Transit Administration (FTA) programs: 

• U.S.C. 49-5310 — Specialized Transportation for 

the Elderly and Disabled 

• U.S.C. 49-5311 — General Public Transportation 

in Nonurbanized Areas 

• U.S.C. 49-5311(f) — Intercity Public Transportation 

in Nonurbanized Areas 

• U.S.C. 49-5316 — Job Access Reverse Commute 

(JARC) 

• U.S.C. 49-5317 — New Freedom 

The application is to cover applicant agencies’ needs 

for state fiscal year 2014 (July 1, 2013 through June 30, 

2014). The application is required annually from all 

KDOT-funded 5310, 5311, 5316 and 5317 transit provider 

agencies including those not requesting capital and/or operating 

expenses. 

The application is available on the KDOT Public Transportation 

website at http://www.ksdot.org/burTransPlan/ 

pubtrans/index.asp. 

The purpose of the U.S.C. 49-5310 program is to provide 

funds to support private nonprofit corporations and 

authorized governments to provide transportation services 

to meet the special needs of the elderly and persons 

with disabilities. Federal funding under this program is 

available for capital expenditures only. State funding is 

available for operating expenses up to maximum of 

$4,000. 

The purpose of the U.S.C. 49-5311 program is to provide 

funds to support rural and nonurbanized (cities less 

than 50,000 population) public transportation projects. 

The goal of the U.S.C. 49-5311 program is to provide services 

to the general public on an equal opportunity basis. 

Funds can be used for either operating or capital expenses. 

The purpose of the U.S.C. 49-5311(f) program is to support 

the connection between nonurbanized areas and the 

larger regional or national system of intercity bus and to 

support services to meet the intercity travel needs of residents 

in nonurbanized areas. 

The purpose of the U.S.C. 49-5316 Job Access & Reverse 

Commute (JARC) program is to improve access to transportation 

services to employment and employment-related 

activities for welfare recipients and eligible low income 

individuals and to transport residents of urbanized 

and nonurbanized areas to suburban employment opportunities. 

The U.S.C. 49-5317 New Freedom formula grant program 

aims to provide additional tools to overcome existing 

barriers facing Americans with disabilities and seeks 

to reduce the barriers to transportation services and expand 

the transportation mobility options available to 

people with disabilities beyond the requirements of the 

Americans with Disabilities Act (ADA) of 1990. 

The state funding for urban and rural public transportation 

for the state fiscal year 2014 is budgeted at $11 million. 

With the challenging financial situation facing the 

state of Kansas, it is possible that state fund availability 

could be reduced, which may increase the requirement 

for local match. 

Applications for the 5310, 5311, 5316 and 5317 funds 

must be local units of government, Indian Tribes, or private 

nonprofit organizations registered with the Kansas 

secretary of state to do business in Kansas. In addition, 

all applicants must be an active member in good standing 

of their Coordinated Transit District (CTD) in order to 

receive funding. Those agencies applying for funds in the 

metropolitan areas of Kansas City, Wichita, Lawrence 

and Topeka need to contact their respective Metropolitan 

Planning Organization (MPO) to ensure that their application 

request is included in the MPO’s Transportation 

Improvement Program (TIP). 

When downloading the applications from the Internet, 

potential applicants will need the appropriate application 

form, application instructions and vehicle cost estimates. 

The CTD and KDOT contact lists also are available on the 

website. Any potential applicants that do not have Internet 

access can request an application by contacting the 

KDOT Public Transit Office. 

The application must indicate whether the request is 

for replacement vehicles, an expansion of services currently 

provided, a new start application, or if the application 

is for the funding of only operating assistance. 

‘‘New start’’ is defined as any proposed service that was 

not previously in existence. ‘‘Expansion’’ is defined as 

adding transit service to areas not already receiving services 

(for example, providing services to new locations or 

adding evening and weekend service). 

KDOT has developed selection criteria to be used by 

the Kansas Coordinated Transit District Council 

(KCTDC) in evaluating the capital request applications. 

The applications will be ranked by the KCTDC in January 

2013. After the application ranking by the KCTDC, KDOT 

staff will use the selection criteria in its evaluation of the 

applications. It should be noted that all items on the application 

must be completed. Points will be deducted in 

the ranking process for missing or incomplete information. 

All applications must be received by 3 p.m. Friday, November 

30, at the KDOT Office of Public Transportation,

Opinion No. 2012-05 – Revised

Synopsis: A state employee may be substantially involved 

in the preparation of or participate in the making 

of a contract with any business in which the brother of 

the employee’s husband has a substantial interest. Thus, 

a state employee is allowed to participate in the review 

of proposals, the selection of bids and/or the negotiation 

process for the new contracts resulting from the RFP for 

child welfare programs delivered by licensed child placing 

agencies if the company that employs the brother of 

employee’s husband submits a bid.

Dear Ms. Long: 

This opinion is in response to your letter dated July 30, 

2012, wherein you request an opinion from the Kansas 

Governmental Ethics Commission, concerning application 

of the state conflict of interest laws, K.S.A. 46-215 et 

seq. We note at the outset that the Commission’s jurisdiction 

is limited to the applicability of K.S.A. 46-215 et seq., 

and the Commission’s opinion does not address whether 

some other statutory system, common law theory, or 

agency rule or regulation applies to your inquiry. 

Factual Statement 

You request this opinion in your capacity as a program 

administrator for the Division of Prevention and Protection 

Services of the Department for Children and Family 

Services (DCF). You explain that your responsibilities include 

administration and oversight of the foster care and 

adoption programs. Services under these child welfare 

programs are delivered by licensed child placing agencies 

under contract with DCF. The contracts are the result of 

negotiated, competitive bids submitted in response to a 

request for proposals (RFP). The next RFP is being developed 

and you are participating in the RFP development 

process. 

You indicate that your husband’s brother is employed 

by TFI Family Services Inc. (TFI). TFI was one of the successful 

bidders during the last procurement process. You 

state that whether TFI submits a proposal or not, you 

would like to participate in the review of proposals, the 

selection of bids and/or the negotiation process for the 

new contracts resulting from the RFP. 

Question 

Do the conflict of interest laws prohibit or limit your 

participation in the review of proposals, the selection of 

bids and/or the negotiation process for the new contracts 

if TFI submits a proposal? 

Analysis and Opinion 

K.S.A. 2011 Supp. 46-233(a) places restrictions on a 

state employee’s participation in state contracts. That statute 

states in pertinent part as follows: 

(1) No state officer or employee shall in the capacity as 

such officer or employee be substantially involved in the 

preparation of or participate in the making of a contract with 

any person or business by which such officer or employee 

is employed or in whose business such officer or employee 

or any member of such officer’s or employee’s immediate 

family has a substantial interest. . . . 1 

‘‘Substantially involved in the preparation or participate 

in the making of a contract’’ means ‘‘having approved 

or disapproved a contract or having provided significant 

factual or specific information or advice or 

recommendations in relation to the negotiated terms of 

the contract.’’ 2 Based on your assertion that you would 

participate in the review of proposals, the selection of 

bids and/or the negotiation process for the new contracts 

resulting from the RFP, you would be substantially involved 

in the preparation or participation in the making 

of a contract that resulted from the RFP. 

The next issue to consider is whether your husband’s 

brother is a member of your ‘‘immediate family,’’ which 

is not defined in K.S.A. 2011 Supp. 46-233 or anywhere 

in the state level conflict of interest laws. ‘‘Family member’’ 

is defined in a regulation concerning nepotism under 

the state level conflict of interest laws, K.A.R. 19-40- 

4(b)(1). That definition includes ‘‘parent, child, or sibling 

related by marriage as denoted by the suffix of ‘in-law’.’’ 

It is significant that the nepotism law uses the more general 

term, ‘‘family member,’’ while K.S.A. 2011 Supp. 46- 

233 uses the qualifier ‘‘immediate’’ before ‘‘family.’’ We 

believe that ‘‘immediate family’’ is more limited than 

‘‘family member.’’ Black’s Law Dictionary defines ‘‘immediate 

family’’ as a ‘‘[t]erm generally referring to one’s 

parents, wife or husband, children, and brothers and sisters.’’ 

3 It is our opinion that the term ‘‘immediate family’’ 

as used in K.S.A. 2011 Supp. 46-233 includes parents, children, 

brothers and sisters, and a spouse, but does not 

include persons related by marriage as denoted by the 

suffix of ‘‘in-law.’’ 

Your husband’s brother is thus not a member of your 

‘‘immediate family.’’ 

A final issue to determine is whether a member of your 

immediate family has a ‘‘substantial interest’’ in TFI, Inc. 

The answer is found in K.S.A. 46-229(b): 

If any individual or an individual’s spouse, either individually 

or collectively, has received during the preceding 

calendar year compensation which is or will be required 

to be included as taxable income on federal income tax 

returns of the individual and spouse in an aggregate 

amount of $2,000 from any business or combination of 

businesses, the individual has a substantial interest in that 

business or combination of businesses. 

The brother of your husband would have a substantial 

interest in TFI from the time his taxable income from TFI 

equals or exceeds $2,000. However, he is not considered 

to be a member of your immediate family. 

Therefore, as a state employee, you may be substantially 

involved in the preparation of or participate in the 

making of a contract with any business in which your 

husband’s brother, has a substantial interest. This allows 

you to participate in the review of proposals, the selection 

of bids and/or the negotiation process for the new contracts 

resulting from the RFP for child welfare programs 

delivered by licensed child placing agencies if TFI, Inc. 

submits a bid.

The Kansas Department of Health and Environment is 

soliciting comments regarding a proposed air quality operating

Direct written comments or questions regarding the

to be considered in formulating a final permit decision, 

written comments must be received before the close of 

business November 13. 

A person may request a public hearing be held on the 

proposed permit. The request for a public hearing shall 

be in writing and set forth the basis for the request. The 

written request must be submitted to Sharon Burrell, 

KDHE, Bureau of Air, not later than the close of business 

November 13 in order for the secretary of health and environment 

to consider the request. 

The U.S. Environmental Protection Agency has a 45- 

day review period, which will start concurrently with the 

30-day public comment period, within which to object to 

the proposed permit. If the EPA has not objected in writing 

to the issuance of the permit within the 45-day review 

period, any person may petition the administrator of the 

EPA to review the permit. The 60-day public petition period 

will directly follow the EPA’s 45-day review period. 

Interested parties may contact KDHE to determine if the 

EPA’s 45-day review period has been waived. 

Any such petition shall be based only on objections to 

the permit that were raised with reasonable specificity 

during the public comment period provided for in this 

notice, unless the petitioner demonstrates that it was impracticable 

to raise such objections within such period, or 

unless the grounds for such objection arose after such period.

4-28-6. Fees; food establishment. Each food establishment 

shall be licensed by the secretary. (a) Each person 

operating or intending to operate a food establishment 

shall submit an application on a form provided by 

the department with the following fees, as applicable: 

(1) Food establishment with only retail food service. 

(A) Application fee. Each person shall submit a onetime 

application fee based on the size of the food establishment 

as follows: 

(i) Less than 5,000 square feet: $50; 

(ii) 5,000 to 15,000 square feet: $100; and 

(iii) more than 15,000 square feet: $150. 

(B) License fee. Each person shall submit a license fee 

based on the size of the food establishment as follows:

(d) Each of the following terms, as used in this regulation, 

shall have the meaning specified in this subsection: 

(1) ‘‘Retail food service’’ means that food and food 

products are offered to the consumer and intended for 

off-premises consumption. This term shall include the offering 

of such food and food products by any delicatessen 

that offers prepared food in bulk quantities only. 

(2) ‘‘Non-retail food service’’ means that food is served 

or is prepared for sale or service on the premises or elsewhere. 

This term shall include the sale or service of such 

food by any fixed or mobile restaurant, coffee shop, cafeteria, 

short-order cafe, luncheonette, grill, tea room, 

sandwich shop, soda fountain, tavern, private club, roadside 

stand, industrial-feeding establishment, catering 

kitchen, commissary, any other private, public, or nonprofit 

organization or institution routinely serving food, 

and any other eating or drinking establishment or operation 

where food is served or provided for the public with

4-28-31. Fees; education facility with a school 

lunch program or satellite school lunch program. Each 

education facility with a school lunch program or satellite 

school lunch program subject to the national school lunch 

act, 42 U.S.C. §1751 et seq., shall be licensed by the secretary. 

(a) Each of the following terms, as used in this regulation, 

shall have the meaning specified in this subsection: 

(1) ‘‘Education facility with a school lunch program’’ 

means any school, institution, or other organization providing 

meals to children through the national school 

lunch program of the division of food and nutrition services, 

United States department of agriculture. 

(2) ‘‘Satellite school lunch program’’ means any program 

offered through an education facility with a school 

lunch program that is operated at a different location as 

designated by the education facility. A satellite school 

lunch program does not have on-site food preparation, 

except portioning food for service. 

(b) Each person operating or wanting to operate an education 

facility with a school lunch program or satellite 

school lunch program shall submit an application on 

forms provided by the department with the following 

fees, as applicable: 

(1) Application fee: $200; and 

(2)(A) License fee for an education facility with a school 

lunch program: $415; or 

(B) license fee for an education facility with a satellite 

school lunch program: $340. 

(c) Each license shall expire on the first March 31 following 

the date of issuance. 

(d) Any licensee may renew a license before the expiration 

date of the license by submitting an application for 

renewal on a form supplied by the department and the 

applicable license fee specified in paragraph (b)(2). 

(e)(1) Each license renewal application received within 

30 days after the license expiration date shall require annual 

renewal by the licensee’s submission of an application 

for renewal on a form supplied by the department, 

the applicable license fee specified in paragraph (b)(2), 

and a late fee of $25, pursuant to 2012 Sen. Sub. for HB 

2730, sec. 1 and amendments thereto. 

(2) License renewal applications received by the department 

on or after May 1 shall not be approved before 

the licensee submits the fees prescribed in paragraphs 

(b)(1) and (b)(2) and the licensee’s food establishment is 

inspected pursuant to K.S.A. 65-689, and amendments 

thereto. 

(f) For an education facility with a school lunch program 

or satellite school lunch program licensed before 

July 1, 2012, the difference between the original license 

fee paid and the current license fee shall be paid for the 

license year ending March 31, 2013. In subsequent years, 

the full license fee shall be paid. (Authorized by and implementing
