Synopsis: K.S.A. 2011 Supp. 74-8762(b) provides that<br />
‘‘[n]o state or local <strong>of</strong>ficial or affiliated person shall hold,<br />
directly or indirectly, an interest in’’ a casino. This prohibition<br />
refers to ownership or control <strong>of</strong> a legal or equitable<br />
interest in a casino; a person does not hold an<br />
interest in a casino merely by working for or owning a<br />
stake in a company that does business with the casino.<br />
For purposes <strong>of</strong> K.S.A. 2011 Supp. 74-8762(b), a state or<br />
local <strong>of</strong>ficial, or affiliated person, is ‘‘employed by’’ a casino<br />
if the person is an ‘‘employee’’ <strong>of</strong> the casino, a term<br />
that does not include independent contractors or individuals<br />

Synopsis: The Organized Service Collection Act is triggered<br />
by a municipality’s decision to establish an organized<br />
collection service as defined by K.S.A. 2011 Supp.<br />
12-2035(b), and does not apply to the renewal or renegotiation<br />
<strong>of</strong> contracts for an existing organized collection<br />
service system. K.S.A. 2011 Supp. 12-2001(a)(6) does not<br />
prohibit a city or county from contracting for solid waste<br />
collection services in lieu <strong>of</strong> granting a franchise for such<br />

Notice <strong>of</strong> Available Grant Funding<br />
Grant funds are available from the Federal John R. Justice<br />
Grant Program for calendar year 2013. The purpose<br />
<strong>of</strong> this grant program is to provide student loan repayment<br />
assistance for full-time local, state and federal government<br />
public defenders and full-time local and state<br />
government prosecutors who commit to serving as public<br />
defenders and prosecutors for at least three years. The<br />
available grant award is $51,252, which will be split<br />
evenly between prosecutors ($25,626) and public defenders<br />
($25,626). Federal John R. Justice Grant funds awarded<br />
under this program are a supplement to, not a substitute<br />
for, personal student loan obligations. To be eligible to<br />
receive funding an attorney must not be in default on<br />
repayment <strong>of</strong> any federal student loans.<br />

the release <strong>of</strong> a competitive request for proposals<br />
for centers for independent living to provide the four core<br />
independent living services (information and referral, independent<br />
living skills training, peer support, and individual<br />
and systems advocacy) and deinstitutionalization<br />
supports to persons with a disability in the following<br />
<strong>Kansas</strong> counties: Atchison, Doniphan, Brown and Jackson.<br />
Community-based private nonpr<strong>of</strong>it, nonresidential<br />
agencies or organizations are eligible to submit proposals.<br />
Applicants must meet Section 725(c) (1) <strong>of</strong> the Rehabilitation<br />
Act <strong>of</strong> 1973, as amended, as well as 34 CFR 364.4<br />
(b), to be an eligible agency.<br />

Request for Proposals<br />
The <strong>Kansas</strong> Department for Children and Families and<br />
the <strong>Kansas</strong> Children’s Cabinet and Trust Fund announce<br />
the release <strong>of</strong> a request for proposals for the <strong>Kansas</strong> Early<br />
Childhood Block Grant. This grant is designed to provide<br />
early childhood services to at-risk children (age 0-5) and<br />
their families to meet specific early childhood outcomes.<br />
Eligible applicants are nonpr<strong>of</strong>it agencies/organizations,<br />
including faith-based and community organizations,<br />
with expertise in serving the at-risk birth to five populations<br />
and their families; and unified school districts or<br />
county governments. The proposals must reflect evidence-based<br />
approaches to achieve outcomes that enhance<br />
school readiness for at-risk children. Evidencebased<br />
practice (EBP) is the integration <strong>of</strong> the best<br />
available research within the context <strong>of</strong> the child, family<br />
and community characteristics.<br />
Vendors interested in submitting a proposal can download<br />

Request for Applications for FTA Program Funding<br />
The <strong>Kansas</strong> Department <strong>of</strong> Transportation, Office <strong>of</strong><br />
Public Transportation is now accepting applications for<br />
the Federal Transit Administration (FTA) programs:<br />
• U.S.C. 49-5310 — Specialized Transportation for<br />
the Elderly and Disabled<br />
• U.S.C. 49-5311 — General Public Transportation<br />
in Nonurbanized Areas<br />
• U.S.C. 49-5311(f) — Intercity Public Transportation<br />
in Nonurbanized Areas<br />
• U.S.C. 49-5316 — Job Access Reverse Commute<br />
(JARC)<br />
• U.S.C. 49-5317 — New Freedom<br />
The application is to cover applicant agencies’ needs<br />
for state fiscal year 2014 (July 1, 2013 through June 30,<br />
2014). The application is required annually from all<br />
KDOT-funded 5310, 5311, 5316 and 5317 transit provider<br />
agencies including those not requesting capital and/or operating<br />
expenses.<br />
The application is available on the KDOT Public Transportation<br />

pubtrans/index.asp.<br />
The purpose <strong>of</strong> the U.S.C. 49-5310 program is to provide<br />
funds to support private nonpr<strong>of</strong>it corporations and<br />
authorized governments to provide transportation services<br />
to meet the special needs <strong>of</strong> the elderly and persons<br />
with disabilities. Federal funding under this program is<br />
available for capital expenditures only. <strong>State</strong> funding is<br />
available for operating expenses up to maximum <strong>of</strong><br />
$4,000.<br />
The purpose <strong>of</strong> the U.S.C. 49-5311 program is to provide<br />
funds to support rural and nonurbanized (cities less<br />
than 50,000 population) public transportation projects.<br />
The goal <strong>of</strong> the U.S.C. 49-5311 program is to provide services<br />
to the general public on an equal opportunity basis.<br />
Funds can be used for either operating or capital expenses.<br />
The purpose <strong>of</strong> the U.S.C. 49-5311(f) program is to support<br />
the connection between nonurbanized areas and the<br />
larger regional or national system <strong>of</strong> intercity bus and to<br />
support services to meet the intercity travel needs <strong>of</strong> residents<br />
in nonurbanized areas.<br />
The purpose <strong>of</strong> the U.S.C. 49-5316 Job Access & Reverse<br />
Commute (JARC) program is to improve access to transportation<br />
services to employment and employment-related<br />
activities for welfare recipients and eligible low income<br />
individuals and to transport residents <strong>of</strong> urbanized<br />
and nonurbanized areas to suburban employment opportunities.<br />
The U.S.C. 49-5317 New Freedom formula grant program<br />
aims to provide additional tools to overcome existing<br />
barriers facing Americans with disabilities and seeks<br />
to reduce the barriers to transportation services and expand<br />
the transportation mobility options available to<br />
people with disabilities beyond the requirements <strong>of</strong> the<br />
Americans with Disabilities Act (ADA) <strong>of</strong> 1990.<br />
The state funding for urban and rural public transportation<br />
for the state fiscal year 2014 is budgeted at $11 million.<br />
With the challenging financial situation facing the<br />
state <strong>of</strong> <strong>Kansas</strong>, it is possible that state fund availability<br />
could be reduced, which may increase the requirement<br />
for local match.<br />
Applications for the 5310, 5311, 5316 and 5317 funds<br />
must be local units <strong>of</strong> government, Indian Tribes, or private<br />
nonpr<strong>of</strong>it organizations registered with the <strong>Kansas</strong><br />
secretary <strong>of</strong> state to do business in <strong>Kansas</strong>. In addition,<br />
all applicants must be an active member in good standing<br />
<strong>of</strong> their Coordinated Transit District (CTD) in order to<br />
receive funding. Those agencies applying for funds in the<br />
metropolitan areas <strong>of</strong> <strong>Kansas</strong> City, Wichita, Lawrence<br />

When downloading the applications from the Internet,<br />
potential applicants will need the appropriate application<br />
form, application instructions and vehicle cost estimates.<br />
The CTD and KDOT contact lists also are available on the<br />
website. Any potential applicants that do not have Internet<br />
access can request an application by contacting the<br />
KDOT Public Transit Office.<br />
The application must indicate whether the request is<br />
for replacement vehicles, an expansion <strong>of</strong> services currently<br />
provided, a new start application, or if the application<br />
is for the funding <strong>of</strong> only operating assistance.<br />
‘‘New start’’ is defined as any proposed service that was<br />
not previously in existence. ‘‘Expansion’’ is defined as<br />
adding transit service to areas not already receiving services<br />
(for example, providing services to new locations or<br />
adding evening and weekend service).<br />
KDOT has developed selection criteria to be used by<br />
the <strong>Kansas</strong> Coordinated Transit District Council<br />
(KCTDC) in evaluating the capital request applications.<br />
The applications will be ranked by the KCTDC in January<br />
2013. After the application ranking by the KCTDC, KDOT<br />
staff will use the selection criteria in its evaluation <strong>of</strong> the<br />
applications. It should be noted that all items on the application<br />
must be completed. Points will be deducted in<br />
the ranking process for missing or incomplete information.<br />

30, at the KDOT Office <strong>of</strong> Public Transportation,<br />
2nd Floor (Planning), Eisenhower <strong>State</strong> Office Building,<br />

Synopsis: A state employee may be substantially involved<br />
in the preparation <strong>of</strong> or participate in the making<br />
<strong>of</strong> a contract with any business in which the brother <strong>of</strong><br />
the employee’s husband has a substantial interest. Thus,<br />
a state employee is allowed to participate in the review<br />
<strong>of</strong> proposals, the selection <strong>of</strong> bids and/or the negotiation<br />
process for the new contracts resulting from the RFP for<br />
child welfare programs delivered by licensed child placing<br />
agencies if the company that employs the brother <strong>of</strong><br />
employee’s husband submits a bid.<br />

Dear Ms. Long:<br />
This opinion is in response to your letter dated July 30,<br />
2012, wherein you request an opinion from the <strong>Kansas</strong><br />
Governmental Ethics Commission, concerning application<br />
<strong>of</strong> the state conflict <strong>of</strong> interest laws, K.S.A. 46-215 et<br />
seq. We note at the outset that the Commission’s jurisdiction<br />
is limited to the applicability <strong>of</strong> K.S.A. 46-215 et seq.,<br />
and the Commission’s opinion does not address whether<br />
some other statutory system, common law theory, or<br />
agency rule or regulation applies to your inquiry.<br />
Factual <strong>State</strong>ment<br />
You request this opinion in your capacity as a program<br />
administrator for the Division <strong>of</strong> Prevention and Protection<br />
Services <strong>of</strong> the Department for Children and Family<br />
Services (DCF). You explain that your responsibilities include<br />
administration and oversight <strong>of</strong> the foster care and<br />
adoption programs. Services under these child welfare<br />
programs are delivered by licensed child placing agencies<br />
under contract with DCF. The contracts are the result <strong>of</strong><br />
negotiated, competitive bids submitted in response to a<br />
request for proposals (RFP). The next RFP is being developed<br />
and you are participating in the RFP development<br />
process.<br />
You indicate that your husband’s brother is employed<br />
by TFI Family Services Inc. (TFI). TFI was one <strong>of</strong> the successful<br />
bidders during the last procurement process. You<br />
state that whether TFI submits a proposal or not, you<br />
would like to participate in the review <strong>of</strong> proposals, the<br />
selection <strong>of</strong> bids and/or the negotiation process for the<br />
new contracts resulting from the RFP.<br />
Question<br />
Do the conflict <strong>of</strong> interest laws prohibit or limit your<br />
participation in the review <strong>of</strong> proposals, the selection <strong>of</strong><br />
bids and/or the negotiation process for the new contracts<br />
if TFI submits a proposal?<br />
Analysis and Opinion<br />
K.S.A. 2011 Supp. 46-233(a) places restrictions on a<br />
state employee’s participation in state contracts. That statute<br />
states in pertinent part as follows:<br />
(1) No state <strong>of</strong>ficer or employee shall in the capacity as<br />
such <strong>of</strong>ficer or employee be substantially involved in the<br />
preparation <strong>of</strong> or participate in the making <strong>of</strong> a contract with<br />
any person or business by which such <strong>of</strong>ficer or employee<br />
is employed or in whose business such <strong>of</strong>ficer or employee<br />
or any member <strong>of</strong> such <strong>of</strong>ficer’s or employee’s immediate<br />
family has a substantial interest. . . . 1<br />
‘‘Substantially involved in the preparation or participate<br />
in the making <strong>of</strong> a contract’’ means ‘‘having approved<br />
or disapproved a contract or having provided significant<br />
factual or specific information or advice or<br />
recommendations in relation to the negotiated terms <strong>of</strong><br />
the contract.’’ 2 Based on your assertion that you would<br />
participate in the review <strong>of</strong> proposals, the selection <strong>of</strong><br />
bids and/or the negotiation process for the new contracts<br />
resulting from the RFP, you would be substantially involved<br />
in the preparation or participation in the making<br />
<strong>of</strong> a contract that resulted from the RFP.<br />
The next issue to consider is whether your husband’s<br />
brother is a member <strong>of</strong> your ‘‘immediate family,’’ which<br />
is not defined in K.S.A. 2011 Supp. 46-233 or anywhere<br />
in the state level conflict <strong>of</strong> interest laws. ‘‘Family member’’<br />
is defined in a regulation concerning nepotism under<br />
the state level conflict <strong>of</strong> interest laws, K.A.R. 19-40-<br />
4(b)(1). That definition includes ‘‘parent, child, or sibling<br />
related by marriage as denoted by the suffix <strong>of</strong> ‘in-law’.’’<br />
It is significant that the nepotism law uses the more general<br />
term, ‘‘family member,’’ while K.S.A. 2011 Supp. 46-<br />
233 uses the qualifier ‘‘immediate’’ before ‘‘family.’’ We<br />
believe that ‘‘immediate family’’ is more limited than<br />
‘‘family member.’’ Black’s Law Dictionary defines ‘‘immediate<br />
family’’ as a ‘‘[t]erm generally referring to one’s<br />
parents, wife or husband, children, and brothers and sisters.’’<br />
3 It is our opinion that the term ‘‘immediate family’’<br />
as used in K.S.A. 2011 Supp. 46-233 includes parents, children,<br />
brothers and sisters, and a spouse, but does not<br />
include persons related by marriage as denoted by the<br />
suffix <strong>of</strong> ‘‘in-law.’’<br />
Your husband’s brother is thus not a member <strong>of</strong> your<br />
‘‘immediate family.’’<br />
A final issue to determine is whether a member <strong>of</strong> your<br />
immediate family has a ‘‘substantial interest’’ in TFI, Inc.<br />
The answer is found in K.S.A. 46-229(b):<br />
If any individual or an individual’s spouse, either individually<br />
or collectively, has received during the preceding<br />
calendar year compensation which is or will be required<br />
to be included as taxable income on federal income tax<br />
returns <strong>of</strong> the individual and spouse in an aggregate<br />
amount <strong>of</strong> $2,000 from any business or combination <strong>of</strong><br />
businesses, the individual has a substantial interest in that<br />
business or combination <strong>of</strong> businesses.<br />
The brother <strong>of</strong> your husband would have a substantial<br />
interest in TFI from the time his taxable income from TFI<br />
equals or exceeds $2,000. However, he is not considered<br />
to be a member <strong>of</strong> your immediate family.<br />
Therefore, as a state employee, you may be substantially<br />
involved in the preparation <strong>of</strong> or participate in the<br />
making <strong>of</strong> a contract with any business in which your<br />
husband’s brother, has a substantial interest. This allows<br />
you to participate in the review <strong>of</strong> proposals, the selection<br />
<strong>of</strong> bids and/or the negotiation process for the new contracts<br />
resulting from the RFP for child welfare programs<br />
delivered by licensed child placing agencies if TFI, Inc.<br />
submits a bid.<br />

The <strong>Kansas</strong> Department <strong>of</strong> Health and Environment is<br />
soliciting comments regarding a proposed air quality operating<br />
permit. Linn Operating, Inc. has applied for a<br />
Class I operating permit renewal in accordance with the<br />
provisions <strong>of</strong> K.A.R. 28-19-510 et al. The purpose <strong>of</strong> a<br />
Class I permit is to identify the sources and types <strong>of</strong> regulated<br />
air pollutants emitted from the facility; the emission<br />
limitations, standards and requirements applicable<br />
to each source; and the monitoring, record keeping and<br />
reporting requirements applicable to each source as <strong>of</strong> the<br />
effective date <strong>of</strong> permit issuance.<br />

November 13 in order for the secretary <strong>of</strong> health and environment<br />

The U.S. Environmental Protection Agency has a 45-<br />
day review period, which will start concurrently with the<br />
30-day public comment period, within which to object to<br />
the proposed permit. If the EPA has not objected in writing<br />
to the issuance <strong>of</strong> the permit within the 45-day review<br />
period, any person may petition the administrator <strong>of</strong> the<br />
EPA to review the permit. The 60-day public petition period<br />
will directly follow the EPA’s 45-day review period.<br />
Interested parties may contact KDHE to determine if the<br />
EPA’s 45-day review period has been waived.<br />
Any such petition shall be based only on objections to<br />
the permit that were raised with reasonable specificity<br />
during the public comment period provided for in this<br />
notice, unless the petitioner demonstrates that it was impracticable<br />
to raise such objections within such period, or<br />
unless the grounds for such objection arose after such period.<br />

shall submit a license fee based on the size <strong>of</strong> the food<br />
establishment as follows:<br />
(i) Less than 5,000 square feet: $250;<br />

(iii) more than 15,000 square feet: $350.<br />
(C) License fee for mobile retail ice cream vendor. Each<br />
mobile retail ice cream vendor engaged solely in the sales<br />
<strong>of</strong> prepackaged frozen desserts shall submit a license fee<br />
<strong>of</strong> $5.<br />
(b) Each license shall expire on the first March 31 following<br />
the date <strong>of</strong> issuance.<br />
(c) Each license shall require annual renewal by the licensee’s<br />
submission <strong>of</strong> an application for renewal, on a<br />
form supplied by the department, and the applicable license<br />
fee specified in subsection (a).<br />
(d) Each <strong>of</strong> the following terms, as used in this regulation,<br />
shall have the meaning specified in this subsection:<br />
(1) ‘‘Retail food service’’ means that food and food<br />
products are <strong>of</strong>fered to the consumer and intended for<br />
<strong>of</strong>f-premises consumption. This term shall include the <strong>of</strong>fering<br />
<strong>of</strong> such food and food products by any delicatessen<br />
that <strong>of</strong>fers prepared food in bulk quantities only.<br />
(2) ‘‘Non-retail food service’’ means that food is served<br />
or is prepared for sale or service on the premises or elsewhere.<br />
This term shall include the sale or service <strong>of</strong> such<br />
food by any fixed or mobile restaurant, c<strong>of</strong>fee shop, cafeteria,<br />
short-order cafe, luncheonette, grill, tea room,<br />
sandwich shop, soda fountain, tavern, private club, roadside<br />
stand, industrial-feeding establishment, catering<br />
kitchen, commissary, any other private, public, or nonpr<strong>of</strong>it<br />
organization or institution routinely serving food,<br />
and any other eating or drinking establishment or operation<br />
where food is served or provided for the public with<br />

4-28-31. Fees; education facility with a school<br />
lunch program or satellite school lunch program. Each<br />
education facility with a school lunch program or satellite<br />
school lunch program subject to the national school lunch<br />
act, 42 U.S.C. §1751 et seq., shall be licensed by the secretary.<br />
(a) Each <strong>of</strong> the following terms, as used in this regulation,<br />
shall have the meaning specified in this subsection:<br />
(1) ‘‘Education facility with a school lunch program’’<br />
means any school, institution, or other organization providing<br />
meals to children through the national school<br />
lunch program <strong>of</strong> the division <strong>of</strong> food and nutrition services,<br />
United <strong>State</strong>s department <strong>of</strong> agriculture.<br />
(2) ‘‘Satellite school lunch program’’ means any program<br />
<strong>of</strong>fered through an education facility with a school<br />
lunch program that is operated at a different location as<br />
designated by the education facility. A satellite school<br />
lunch program does not have on-site food preparation,<br />
except portioning food for service.<br />
(b) Each person operating or wanting to operate an education<br />
facility with a school lunch program or satellite<br />
school lunch program shall submit an application on<br />
forms provided by the department with the following<br />
fees, as applicable:<br />
(1) Application fee: $200; and<br />
(2)(A) License fee for an education facility with a school<br />
lunch program: $415; or<br />
(B) license fee for an education facility with a satellite<br />
school lunch program: $340.<br />
(c) Each license shall expire on the first March 31 following<br />
the date <strong>of</strong> issuance.<br />
(d) Any licensee may renew a license before the expiration<br />
date <strong>of</strong> the license by submitting an application for<br />
renewal on a form supplied by the department and the<br />
applicable license fee specified in paragraph (b)(2).<br />
(e)(1) Each license renewal application received within<br />
30 days after the license expiration date shall require annual<br />
renewal by the licensee’s submission <strong>of</strong> an application<br />
for renewal on a form supplied by the department,<br />
the applicable license fee specified in paragraph (b)(2),<br />
and a late fee <strong>of</strong> $25, pursuant to 2012 Sen. Sub. for HB<br />
2730, sec. 1 and amendments thereto.<br />
(2) License renewal applications received by the department<br />
on or after May 1 shall not be approved before<br />
the licensee submits the fees prescribed in paragraphs<br />
(b)(1) and (b)(2) and the licensee’s food establishment is<br />
inspected pursuant to K.S.A. 65-689, and amendments<br />
thereto.<br />
(f) For an education facility with a school lunch program<br />
or satellite school lunch program licensed before<br />
July 1, 2012, the difference between the original license<br />
fee paid and the current license fee shall be paid for the<br />
license year ending March 31, 2013. In subsequent years,<br />
