114. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e the applicant shall cre<strong>at</strong>e a Positive Covenant and<br />
Restricti<strong>on</strong> <strong>on</strong> the Use <str<strong>on</strong>g>of</str<strong>on</strong>g> Land under Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyancing Act 1919, burdening<br />
the property with the requirement <str<strong>on</strong>g>to</str<strong>on</strong>g> maintain the <strong>on</strong>-site s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er detenti<strong>on</strong> and retenti<strong>on</strong><br />
facilities (including all ancillary reticul<strong>at</strong>i<strong>on</strong> plumbing) <strong>on</strong> the property. The terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />
instruments are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> generally in accordance with the Council's draft terms <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 88B<br />
instruments for protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>on</strong>-site detenti<strong>on</strong> and retenti<strong>on</strong> facilities (DCP47 appendix 14)<br />
and <str<strong>on</strong>g>to</str<strong>on</strong>g> the s<strong>at</strong>isfacti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Council. Registered title documents showing the covenants and<br />
restricti<strong>on</strong>s must <str<strong>on</strong>g>be</str<strong>on</strong>g> submitted and approved by the Principal Certifying Authority (PCA)<br />
prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e.<br />
115. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e the following must <str<strong>on</strong>g>be</str<strong>on</strong>g> provided <str<strong>on</strong>g>to</str<strong>on</strong>g> Council<br />
(<strong>at</strong>tenti<strong>on</strong> Development Engineer):<br />
- A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the approved C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er detenti<strong>on</strong>/retenti<strong>on</strong> design<br />
for the site, and<br />
- A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the works-as-executed drawing <str<strong>on</strong>g>of</str<strong>on</strong>g> the as-built <strong>on</strong>-site detenti<strong>on</strong>/retenti<strong>on</strong><br />
system, and<br />
- The Engineer’s certific<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the as-built system.<br />
This c<strong>on</strong>diti<strong>on</strong> is required so Council may maintain its d<strong>at</strong>abase <str<strong>on</strong>g>of</str<strong>on</strong>g> as-c<strong>on</strong>structed <strong>on</strong>-site<br />
s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er detenti<strong>on</strong>/retenti<strong>on</strong> systems, and also applies if the Principal Certifying Authority<br />
(PCA) is not the Council.<br />
116. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e the Secti<strong>on</strong> 73 Sydney W<strong>at</strong>er compliance<br />
certific<strong>at</strong>e must <str<strong>on</strong>g>be</str<strong>on</strong>g> obtained and submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> the Principal Certifying Authority (PCA).<br />
117. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e a certific<strong>at</strong>i<strong>on</strong> and a works-as-executed (WAE)<br />
plan, in rel<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the installed rainw<strong>at</strong>er retenti<strong>on</strong>/detenti<strong>on</strong> devices, are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> submitted <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
the Principal Certifying Authority (PCA). Certific<strong>at</strong>i<strong>on</strong> is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> provided by a suitably<br />
qualified c<strong>on</strong>sulting civil/hydraulic engineer and the WAE plan is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared by a<br />
registered surveyor. The Certific<strong>at</strong>e is <str<strong>on</strong>g>to</str<strong>on</strong>g> specifically st<strong>at</strong>e compliance with each <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />
relevant c<strong>on</strong>trols set out in appendix 6.2 <str<strong>on</strong>g>of</str<strong>on</strong>g> Council W<strong>at</strong>er Management Development C<strong>on</strong>trol<br />
Plan 47. The Works-as-Executed drawing(s) is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> marked up in red <strong>on</strong> the approved<br />
C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e design, and shall include:<br />
- As c<strong>on</strong>structed levels in comparis<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> design levels<br />
- As built loc<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> all tanks/retenti<strong>on</strong> devices <strong>on</strong> the property and distances <str<strong>on</strong>g>to</str<strong>on</strong>g> adjacent<br />
boundaries, buildings and easements<br />
- Dimensi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> all retenti<strong>on</strong> tanks/devices<br />
- Top w<strong>at</strong>er levels <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage areas and RL’s <strong>at</strong> overflow point(s).<br />
- S<str<strong>on</strong>g>to</str<strong>on</strong>g>rage volume(s) provided and supporting calcul<strong>at</strong>i<strong>on</strong>s/document<strong>at</strong>i<strong>on</strong>.<br />
- For the <strong>on</strong>-site detenti<strong>on</strong> c<strong>on</strong>trol installed, a separ<strong>at</strong>e certific<strong>at</strong>e is <str<strong>on</strong>g>to</str<strong>on</strong>g> specifically<br />
acknowledge compliance <str<strong>on</strong>g>of</str<strong>on</strong>g> the <strong>on</strong>-site detenti<strong>on</strong> system with the approved<br />
C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e plans and also compliance with the design requirements <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
appendix 5 in Councils W<strong>at</strong>er Management DCP 47 - “Design <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>on</strong>-site detenti<strong>on</strong><br />
systems”. The Works-as-Executed details shall <str<strong>on</strong>g>be</str<strong>on</strong>g> marked in red <strong>on</strong> the approved<br />
C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e design for the <strong>on</strong>-site detenti<strong>on</strong> system, and shall specifically<br />
include:<br />
