Where approval ong>ofong> the ‘Work Zone’ is resolved by the Committee, the necessary ‘Work Zone’ signage shall ong>beong> installed and the adopted fee paid prior ong>toong> commencement ong>ofong> any works on the site. Where such a ‘Work Zone’ is not considered ong>toong> ong>beong> feasible by Council Traffic Engineers, the zone will not ong>beong> required. This condition is ong>toong> facilitate a dedicated on-street parking area for construction related vehicles during work hours. A need for a ‘Work Zone’ arises given the scale ong>ofong> the works, existing on-street parking restrictions around the site and the existing high demand for on-street parking in this location. CONDITIONS TO BE COMPLIED WITH PRIOR TO OCCUPATION 111. Prior ong>toong> the release ong>ofong> any occupation certificate, a compliance certificate must ong>beong> obtained from an accredited certifier, certifying that the building works for the building ong>toong> ong>beong> occupied comply with the plans and specifications approved by this development consent; and any construction certificate associated with this consent for the buildings ong>toong> ong>beong> occupied. If the PCA is not the Council, then this compliance certificate must ong>beong> submitted ong>toong> the Council at the same time as the occupation certificate is submitted ong>toong> the Council in accordance with Clause 151(2) ong>ofong> the E P & A Act regulations. 112. Prior ong>toong> issue ong>ofong> the Occupation Certificate, a complete record ong>ofong> geotechnical inspections, testing and moniong>toong>ring with certifications as specified in the “Report ong>toong> Mr Cameron Nelson on Geotechnical Investigation for Proposed Residential Development at 1 ong>toong> 5 Lynbarra avenue and 12 Porters Lane, St Ives NSW” (project 18895VBrpt, dated 21 st Ocong>toong>ong>beong>r 2004) prepared by Jeffery and Katauskas Consulting Engineers, must ong>beong> supplied ong>toong> the Principal Certifying Authority for approval. 113. Prior ong>toong> issue ong>ofong> an Occupation Certificate the following works must ong>beong> completed ong>toong> the satisfaction ong>ofong> Council Engineers: - Completion ong>ofong> the new driveway crossings in accordance with levels and specifications issued by Council. - Full reconstruction ong>ofong> the concrete footpath over the entire site frontage ong>ofong> Ada Avenue. - Removal ong>ofong> all redundant driveway crossings and kerb laybacks (or sections thereong>ofong>). Full reinstatement ong>ofong> these areas ong>toong> footway, turfed verge and upright kerb and gutter ong>toong> the satisfaction ong>ofong> Council. Reinstatement works shall match surrounding adjacent infrastructure with respect ong>toong> integration ong>ofong> levels and materials. - Full repair and resealing ong>ofong> any road surface damaged during construction. - Full replacement ong>ofong> damaged sections ong>ofong> grass verge with a non-friable turf ong>ofong> native variety ong>toong> match existing. All works must ong>beong> completed in accordance with the General Specification for the Construction ong>ofong> Road and Drainage Works in Ku-ring-gai Council, dated Novemong>beong>r 2004. Any damaged public infrastructure caused as a result ong>ofong> construction works on the subject site (including damage caused by, but not limited ong>toong>, delivery vehicles, waste collection, contracong>toong>rs, sub contracong>toong>rs, concrete vehicles, crane use) must ong>beong> fully repaired ong>toong> the satisfaction ong>ofong> Council Engineers. Prior ong>toong> issue ong>ofong> an Occupation Certificate the applicant shall create a Positive Covenant and Restriction on the Use ong>ofong> Land under Section 88B ong>ofong> the Conveyancing Act 1919, burdening the property with the requirement ong>toong> maintain the on-site song>toong>rmwater detention and retention facilities (including all ancillary reticulation plumbing) on the property. The terms ong>ofong> the instruments are ong>toong> ong>beong> generally in accordance with the Council's draft terms ong>ofong> Section 88B instruments for protection ong>ofong> on-site detention and retention facilities (DCP47 appendix 14) and ong>toong> the satisfaction ong>ofong> Council. Registered title documents showing the covenants and restrictions must ong>beong> submitted and approved by the Principal Certifying Authority (PCA) prior ong>toong> issue ong>ofong> an Occupation Certificate. 115. Prior ong>toong> issue ong>ofong> an Occupation Certificate the following must ong>beong> provided ong>toong> Council (attention Development Engineer): - A copy ong>ofong> the approved Construction Certificate song>toong>rmwater detention/retention design for the site, and - A copy ong>ofong> the works-as-executed drawing ong>ofong> the as-built on-site detention/retention system, and - The Engineer’s certification ong>ofong> the as-built system. This condition is required so Council may maintain its database ong>ofong> as-constructed on-site song>toong>rmwater detention/retention systems, and also applies if the Principal Certifying Authority (PCA) is not the Council. 116. Prior ong>toong> issue ong>ofong> an Occupation Certificate the Section 73 Sydney Water compliance certificate must ong>beong> obtained and submitted ong>toong> the Principal Certifying Authority (PCA). 117. Prior ong>toong> issue ong>ofong> an Occupation Certificate a certification and a works-as-executed (WAE) plan, in relation ong>toong> the installed rainwater retention/detention devices, are ong>toong> ong>beong> submitted ong>toong> the Principal Certifying Authority (PCA). Certification is ong>toong> ong>beong> provided by a suitably qualified consulting civil/hydraulic engineer and the WAE plan is ong>toong> ong>beong> prepared by a registered surveyor. The Certificate is ong>toong> specifically state compliance with each ong>ofong> the relevant controls set out in appendix 6.2 ong>ofong> Council Water Management Development Control Plan 47. The Works-as-Executed drawing(s) is ong>toong> ong>beong> marked up in red on the approved Construction Certificate design, and shall include: - As constructed levels in comparison ong>toong> design levels - As built location ong>ofong> all tanks/retention devices on the property and distances ong>toong> adjacent boundaries, buildings and easements - Dimensions ong>ofong> all retention tanks/devices - Top water levels ong>ofong> song>toong>rage areas and RL’s at overflow point(s). - Song>toong>rage volume(s) provided and supporting calculations/documentation. - For the on-site detention control installed, a separate certificate is ong>toong> specifically acknowledge compliance ong>ofong> the on-site detention system with the approved Construction Certificate plans and also compliance with the design requirements ong>ofong> appendix 5 in Councils Water Management DCP 47 - “Design ong>ofong> on-site detention systems”. - A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the approved C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er detenti<strong>on</strong>/retenti<strong>on</strong> design<br />

for the site, and<br />

- A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the works-as-executed drawing <str<strong>on</strong>g>of</str<strong>on</strong>g> the as-built <strong>on</strong>-site detenti<strong>on</strong>/retenti<strong>on</strong><br />

system, and<br />

- The Engineer’s certific<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the as-built system.<br />

This c<strong>on</strong>diti<strong>on</strong> is required so Council may maintain its d<strong>at</strong>abase <str<strong>on</strong>g>of</str<strong>on</strong>g> as-c<strong>on</strong>structed <strong>on</strong>-site<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er detenti<strong>on</strong>/retenti<strong>on</strong> systems, and also applies if the Principal Certifying Authority<br />

(PCA) is not the Council.<br />

116. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e the Secti<strong>on</strong> 73 Sydney W<strong>at</strong>er compliance<br />

certific<strong>at</strong>e must <str<strong>on</strong>g>be</str<strong>on</strong>g> obtained and submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> the Principal Certifying Authority (PCA).<br />

117. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occup<strong>at</strong>i<strong>on</strong> Certific<strong>at</strong>e a certific<strong>at</strong>i<strong>on</strong> and a works-as-executed (WAE)<br />

plan, in rel<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the installed rainw<strong>at</strong>er retenti<strong>on</strong>/detenti<strong>on</strong> devices, are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> submitted <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the Principal Certifying Authority (PCA). Certific<strong>at</strong>i<strong>on</strong> is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> provided by a suitably<br />

qualified c<strong>on</strong>sulting civil/hydraulic engineer and the WAE plan is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared by a<br />

registered surveyor. The Certific<strong>at</strong>e is <str<strong>on</strong>g>to</str<strong>on</strong>g> specifically st<strong>at</strong>e compliance with each <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

relevant c<strong>on</strong>trols set out in appendix 6.2 <str<strong>on</strong>g>of</str<strong>on</strong>g> Council W<strong>at</strong>er Management Development C<strong>on</strong>trol<br />
