99. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e the applicant shall submit, for approval by the<br />

Principal Certifying Authority (PCA), full c<strong>on</strong>structi<strong>on</strong> drawings for the proposed method <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

achieving Council s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage volume requirements for the <strong>on</strong>-site s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er retenti<strong>on</strong> system.<br />

The minimum s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage volumes and designs shall comply with Councils W<strong>at</strong>er Management<br />

DCP 47 (available <strong>on</strong> the Council website and <strong>at</strong> Council cus<str<strong>on</strong>g>to</str<strong>on</strong>g>mer services), any<br />

manufacturers’ specific<strong>at</strong>i<strong>on</strong>s and the relevant plumbing codes. Rainw<strong>at</strong>er tank(s) shall <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

designed <str<strong>on</strong>g>to</str<strong>on</strong>g> capture and retain run<str<strong>on</strong>g>of</str<strong>on</strong>g>f from the entire ro<str<strong>on</strong>g>of</str<strong>on</strong>g> area as a minimum. Overflow shall<br />

revert <str<strong>on</strong>g>to</str<strong>on</strong>g> the main drainage system. The design and c<strong>on</strong>structi<strong>on</strong> plans, with all supporting<br />

document<strong>at</strong>i<strong>on</strong>, are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared by a qualified and experienced civil/hydraulic engineer.<br />

The design is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> in accordance with the C<strong>on</strong>cept S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er Management &<br />

Envir<strong>on</strong>mental Site Management C<strong>on</strong>cept Plans, C1A, C2D, C3A, C4A & C5A, d<strong>at</strong>ed<br />

Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004 and February <strong>2005</strong>, by Appleyard Forrest C<strong>on</strong>sulting Engineers submitted<br />

with the development applic<strong>at</strong>i<strong>on</strong>, and advanced as necessary for c<strong>on</strong>structi<strong>on</strong> issue purposes.<br />

100. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e the applicant shall submit, for approval by the<br />

Principal Certifying Authority (PCA), c<strong>on</strong>structi<strong>on</strong> design drawings and calcul<strong>at</strong>i<strong>on</strong>s for the<br />

property drainage system comp<strong>on</strong>ents. The property drainage system (including but not<br />

limited <str<strong>on</strong>g>to</str<strong>on</strong>g> gutters, downpipes, pits, joints, flushing facilities and all ancillary plumbing) shall<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g> designed for a 235mm/hour rainfall intensity for a dur<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> five (5) minutes (1:50 year<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm recurrence) and shall <str<strong>on</strong>g>be</str<strong>on</strong>g> comp<strong>at</strong>ible with the necessary retenti<strong>on</strong> and detenti<strong>on</strong> devices.<br />

Plans and calcul<strong>at</strong>i<strong>on</strong>s are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared by a suitably qualified and experienced<br />

civil/hydraulic engineer in accordance with Councils W<strong>at</strong>er Management Development<br />

C<strong>on</strong>trol Plan 47. New c<strong>on</strong>necti<strong>on</strong> points <str<strong>on</strong>g>to</str<strong>on</strong>g> the Council drainage system must <str<strong>on</strong>g>be</str<strong>on</strong>g> shown<br />

accur<strong>at</strong>ely <strong>on</strong> the plan and shall <str<strong>on</strong>g>be</str<strong>on</strong>g> made in accordance with the General Specific<strong>at</strong>i<strong>on</strong> for the<br />

C<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Road and Drainage Works in Ku-ring-gai Council, d<strong>at</strong>ed Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004.<br />

The design <str<strong>on</strong>g>of</str<strong>on</strong>g> these drainage comp<strong>on</strong>ents may <str<strong>on</strong>g>be</str<strong>on</strong>g> in accordance with the C<strong>on</strong>cept S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er<br />

Management & Envir<strong>on</strong>mental Site Management C<strong>on</strong>cept Plans, C1A, C2D, C3A, C4A &<br />

C5A, d<strong>at</strong>ed Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004 and February <strong>2005</strong>, by Appleyard Forrest C<strong>on</strong>sulting Engineers<br />

submitted with the development applic<strong>at</strong>i<strong>on</strong>, and advanced as necessary for c<strong>on</strong>structi<strong>on</strong> issue<br />

purposes.<br />

101. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> the issue <str<strong>on</strong>g>of</str<strong>on</strong>g> a C<strong>on</strong>structi<strong>on</strong> Certific<strong>at</strong>e the applicant shall lodge a $50,000 (fifty<br />

thousand dollar) public infrastructure damage b<strong>on</strong>d with Council. This b<strong>on</strong>d is applied under<br />

Secti<strong>on</strong> 97 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Local Government Act <str<strong>on</strong>g>to</str<strong>on</strong>g> cover the res<str<strong>on</strong>g>to</str<strong>on</strong>g>r<strong>at</strong>i<strong>on</strong> by Council <str<strong>on</strong>g>of</str<strong>on</strong>g> any damage <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

public infrastructure not repaired in full, caused as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> works, in close<br />

proximity <str<strong>on</strong>g>to</str<strong>on</strong>g> the subject development. The b<strong>on</strong>d will also cover the finishing <str<strong>on</strong>g>of</str<strong>on</strong>g> any<br />

incomplete works required in the road reserve under this c<strong>on</strong>sent and/or as part <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

approved development. The b<strong>on</strong>d shall <str<strong>on</strong>g>be</str<strong>on</strong>g> refundable following completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> all works<br />

rel<strong>at</strong>ing <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed development and <strong>at</strong> the end <str<strong>on</strong>g>of</str<strong>on</strong>g> any maintenance period stipul<strong>at</strong>ed<br />

by c<strong>on</strong>sent c<strong>on</strong>diti<strong>on</strong>s up<strong>on</strong> approval by Council’s Engineers. Further, Council shall have full<br />

authority <str<strong>on</strong>g>to</str<strong>on</strong>g> make use <str<strong>on</strong>g>of</str<strong>on</strong>g> the b<strong>on</strong>d for such res<str<strong>on</strong>g>to</str<strong>on</strong>g>r<strong>at</strong>i<strong>on</strong> works as deemed necessary by Council<br />

in the following circumstances:<br />

a) Where the damage c<strong>on</strong>stitutes a hazard in which case Council may make use <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

b<strong>on</strong>d immedi<strong>at</strong>ely, and<br />

b) The applicant has not repaired nor commenced repairing the damage within 48 hours <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the issue by Council in writing <str<strong>on</strong>g>of</str<strong>on</strong>g> instructi<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> undertake such repairs or works.<br />
