90. Prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate the Applicant must consolidate the existing
Torrens lots which will form the development site. Evidence <strong>of</strong> lot consolidation, in the form
<strong>of</strong> a plan registered with Land and Property Information, must <strong>be</strong> submitted for approval <strong>of</strong>
the Principal Certifying Authority prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate. This
condition is imposed <strong>to</strong> ensure continuous structures will not <strong>be</strong> placed across separate titles.
91. Prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate any security gate, grille or door shown on the
DA plans, which would prevent unrestricted access for Council waste collection vehicles <strong>to</strong>
the basement garbage s<strong>to</strong>rage/collection area, must <strong>be</strong> deleted from the plans <strong>to</strong> <strong>be</strong> approved
with the Construction Certificate. Such details shall <strong>be</strong> <strong>to</strong> the satisfaction <strong>of</strong> the Principal
Certifying Authority (PCA).
92. Prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate , a plan detailing services trenches in accordance
with the relevant supply authorities (including electricity, gas, telephone, water and
sewerage), shall <strong>be</strong> submitted for approval by the Principal Certifying Authority (PCA). The
notice <strong>of</strong> requirements for Sydney Water must <strong>be</strong> obtained prior <strong>to</strong> issue <strong>of</strong> the Construction
Certificate.
93. Prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate the Applicant shall contact Energy Australia
regarding power supply for the subject development. A written response detailing the full
requirements <strong>of</strong> Energy Australia (including cabling, need for substations or similar within
the development) shall <strong>be</strong> submitted <strong>to</strong> the Principal Certifying Authority (PCA) for approval
prior <strong>to</strong> Construction Certificate issue. Any structures or requirements <strong>of</strong> Energy Australia
shall <strong>be</strong> reflected on the plans issued with the Construction Certificate <strong>to</strong> the satisfaction <strong>of</strong>
the PCA. The requirements <strong>of</strong> the utility provider shall <strong>be</strong> met in full prior <strong>to</strong> issue <strong>of</strong> the
Occupation Certificate.
94. Prior <strong>to</strong> issue <strong>of</strong> any Construction Certificate the applicant shall submit, for approval by the
Principal Certifying Authority (with a copy forwarded <strong>to</strong> Council) a full dilapidation report on
the visible and structural condition <strong>of</strong> all neighbouring buildings within the ‘zone <strong>of</strong>
influence’ <strong>of</strong> the excavation. This is <strong>to</strong> <strong>be</strong> defined as the horizontal distance from the edge <strong>of</strong>
the excavation face <strong>to</strong> twice the excavation depth. The report must <strong>be</strong> completed by a
consulting structural/geotechnical engineer as determined necessary by that pr<strong>of</strong>essional
based on the excavations for the proposal and the recommendations <strong>of</strong> the submitted Report
on Geotechnical Investigation by Jeffery and Katauskas Consulting Engineers (refer report
18987Vrpt dated 5 th Novem<strong>be</strong>r 2004). A second dilapidation report, recording structural
conditions <strong>of</strong> all structures originally assessed prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate,
must <strong>be</strong> carried out at the completion <strong>of</strong> the works and <strong>be</strong> submitted <strong>to</strong> Council. The report
shall have regard <strong>to</strong> protecting the Applicant from spurious claims for structural damage and
shall <strong>be</strong> verified by all stakeholders as far as practicable.
95. Prior <strong>to</strong> issue <strong>of</strong> the Construction Certificate, footpath and driveway levels for the required
driveway crossing <strong>be</strong>tween the property boundary and road alignment must <strong>be</strong> obtained from
Council. Such levels are only able <strong>to</strong> <strong>be</strong> issued by Council under the Roads Act 1993. All
footpath crossings, laybacks and driveways are <strong>to</strong> <strong>be</strong> constructed according <strong>to</strong> Council's
specifications "Construction <strong>of</strong> Gutter Crossings and Footpath Crossings" or as specified by
