CONCLUSION Having regard ong>toong> the provisions ong>ofong> section 79C ong>ofong> the Environmental Planning and Assessment Act 1979, the proposed development is considered ong>toong> ong>beong> satisfacong>toong>ry. RECOMMENDATION Pursuant ong>toong> Section 80(1) ong>ofong> the Environmental Planning and Assessment Act, 1979 THAT the Council, as the consent authority, grant development consent ong>toong> DA 1243/04 for the demolition ong>ofong> three (3) residential dwellings and construction ong>ofong> a five (5) song>toong>rey residential flat building containing twenty seven (27) units and basement car parking for sixty one (61) vehicles on land at 26-30 Marian Street, Killara, on a Deferred Commencement basis, for a period ong>ofong> two (2) years from the date ong>ofong> the Notice ong>ofong> Determination subject ong>toong> the following conditions: SCHEDULE A 1. In order ong>toong> activate the consent, the Applicant shall obtain a resolution from Ku-ring-gai Council that it will consent ong>toong> the extinguishment ong>ofong> the existing Council easement(s) for drainage which currently burden the subject property. As the easement for drainage will no longer ong>beong> required over the subject site (pipes are ong>toong> ong>beong> re-diverted in the frontage road reserve), approval is not required ong>toong> re-create easements for drainage on the subject property. Councils Technical Services department will ong>beong> responsible for preparing the necessary report ong>toong> Council regarding the extinguishment ong>ofong> the existing easement burdening the site, subject ong>toong> payment ong>ofong> the adopted fee for the preparation ong>ofong> such reports. NOTE: NOTE: The matters referred ong>toong> in Schedule A must ong>beong> completed ong>toong> Council's satisfaction within TWO YEARS from the date ong>ofong> this Deferred Commencement Approval ong>beong>fore the Consent operates. It is the applicant's responsibility ong>toong> check the title ong>ofong> the subject land ong>toong> establish if the application is affected by any easements, covenants or restrictions on the use ong>ofong> the land that may affect the proposed structure.
