CONCLUSION<br />
Having regard <str<strong>on</strong>g>to</str<strong>on</strong>g> the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> secti<strong>on</strong> 79C <str<strong>on</strong>g>of</str<strong>on</strong>g> the Envir<strong>on</strong>mental Planning and Assessment Act<br />
1979, the proposed development is c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry. Therefore, it is recommended th<strong>at</strong><br />
the applic<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g> approved.<br />
RECOMMENDATION<br />
Pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> Secti<strong>on</strong> 80(1) <str<strong>on</strong>g>of</str<strong>on</strong>g> the Envir<strong>on</strong>mental Planning and Assessment Act, 1979<br />
THAT the Council, as the c<strong>on</strong>sent authority, grant development c<strong>on</strong>sent <str<strong>on</strong>g>to</str<strong>on</strong>g> DA 1243/04 for the<br />
demoliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> three (3) residential dwellings and c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a five (5) s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey residential fl<strong>at</strong><br />
building c<strong>on</strong>taining twenty seven (27) units and basement car parking for sixty <strong>on</strong>e (61) vehicles <strong>on</strong><br />
land <strong>at</strong> <strong>26</strong>-30 Marian Street, Killara, <strong>on</strong> a Deferred Commencement basis, for a period <str<strong>on</strong>g>of</str<strong>on</strong>g> two (2)<br />
years from the d<strong>at</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> the Notice <str<strong>on</strong>g>of</str<strong>on</strong>g> Determin<strong>at</strong>i<strong>on</strong> subject <str<strong>on</strong>g>to</str<strong>on</strong>g> the following c<strong>on</strong>diti<strong>on</strong>s:<br />
SCHEDULE A<br />
1. In order <str<strong>on</strong>g>to</str<strong>on</strong>g> activ<strong>at</strong>e the c<strong>on</strong>sent, the Applicant shall obtain a resoluti<strong>on</strong> from Ku-ring-gai<br />
Council th<strong>at</strong> it will c<strong>on</strong>sent <str<strong>on</strong>g>to</str<strong>on</strong>g> the extinguishment <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing Council easement(s) for<br />
drainage which currently burden the subject property. As the easement for drainage will no<br />
l<strong>on</strong>ger <str<strong>on</strong>g>be</str<strong>on</strong>g> required over the subject site (pipes are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> re-diverted in the fr<strong>on</strong>tage road<br />
reserve), approval is not required <str<strong>on</strong>g>to</str<strong>on</strong>g> re-cre<strong>at</strong>e easements for drainage <strong>on</strong> the subject property.<br />
Councils Technical Services department will <str<strong>on</strong>g>be</str<strong>on</strong>g> resp<strong>on</strong>sible for preparing the necessary report<br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> Council regarding the extinguishment <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing easement burdening the site, subject<br />
<str<strong>on</strong>g>to</str<strong>on</strong>g> payment <str<strong>on</strong>g>of</str<strong>on</strong>g> the adopted fee for the prepar<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> such reports.<br />

within TWO YEARS from the d<strong>at</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> this Deferred Commencement Approval<br />
<str<strong>on</strong>g>be</str<strong>on</strong>g>fore the C<strong>on</strong>sent oper<strong>at</strong>es.<br />
It is the applicant's resp<strong>on</strong>sibility <str<strong>on</strong>g>to</str<strong>on</strong>g> check the title <str<strong>on</strong>g>of</str<strong>on</strong>g> the subject land <str<strong>on</strong>g>to</str<strong>on</strong>g> establish<br />
if the applic<strong>at</strong>i<strong>on</strong> is affected by any easements, covenants or restricti<strong>on</strong>s <strong>on</strong> the use<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> the land th<strong>at</strong> may affect the proposed structure.<br />
THIS CONSENT will <str<strong>on</strong>g>be</str<strong>on</strong>g> ISSUED SUBJECT TO CONDITIONS OF APPROVAL as<br />
specified hereunder in Schedule B.<br />
This permit shall <str<strong>on</strong>g>be</str<strong>on</strong>g> read in c<strong>on</strong>juncti<strong>on</strong> with the approved plans and specific<strong>at</strong>i<strong>on</strong>s.<br />
