distance from the south facing windows <str<strong>on</strong>g>of</str<strong>on</strong>g> dwelling houses <strong>on</strong> the northern side <str<strong>on</strong>g>of</str<strong>on</strong>g> Marian Street.<br />

Retenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> two 24m high blue gum trees and extensive landscaping are proposed within this<br />

setback.<br />

In rel<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed n<strong>on</strong>-compliance with the setback from Caithness Street, the following<br />

comments are made.<br />

The Caithness Street elev<strong>at</strong>i<strong>on</strong> is approxim<strong>at</strong>ely <strong>26</strong>.5m in length and set back <str<strong>on</strong>g>be</str<strong>on</strong>g>tween 10-12m for<br />

the majority <str<strong>on</strong>g>of</str<strong>on</strong>g> the elev<strong>at</strong>i<strong>on</strong>, 14m for 3.3m in the centre <str<strong>on</strong>g>of</str<strong>on</strong>g> the elev<strong>at</strong>i<strong>on</strong>, then increases <str<strong>on</strong>g>to</str<strong>on</strong>g> 16.4 m<br />

for 4m (in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> setback requirements) <strong>at</strong> the south-eastern corner <str<strong>on</strong>g>of</str<strong>on</strong>g> the building, where the site<br />

widens.<br />

The site is irregular in shape, <str<strong>on</strong>g>be</str<strong>on</strong>g>ing narrow <strong>at</strong> the Marian and Caithness intersecti<strong>on</strong> and widening<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the rear. As a result <str<strong>on</strong>g>of</str<strong>on</strong>g> this c<strong>on</strong>figur<strong>at</strong>i<strong>on</strong>, the setbacks vary c<strong>on</strong>siderably despite the uniformity<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the building line, as reflected in the setbacks proposed.<br />

To <str<strong>on</strong>g>of</str<strong>on</strong>g>fset any undue dominance <str<strong>on</strong>g>of</str<strong>on</strong>g> built form the building has addressed the corner (<strong>at</strong> the narrowest<br />

point <str<strong>on</strong>g>of</str<strong>on</strong>g> the site) through effective building articul<strong>at</strong>i<strong>on</strong> th<strong>at</strong> breaks down the size <str<strong>on</strong>g>of</str<strong>on</strong>g> the building <strong>at</strong><br />

this point. Adequ<strong>at</strong>e area for deep soil landscaping is provided within the setback. The building<br />

will <str<strong>on</strong>g>be</str<strong>on</strong>g> separ<strong>at</strong>ed from the west facing windows <str<strong>on</strong>g>of</str<strong>on</strong>g> the dwelling house <strong>at</strong> 24 Marian Street by 22m<br />

and provides adequ<strong>at</strong>e separ<strong>at</strong>i<strong>on</strong> for privacy. It is further noted th<strong>at</strong> DCP55 allows for a lesser<br />

setback <strong>on</strong> streets less than 12m wide, such as Caithness Street. Accordingly, the setback proposed<br />

is acceptable.<br />

Having regard <str<strong>on</strong>g>to</str<strong>on</strong>g> the above, the setbacks <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed development are s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry, and<br />

c<strong>on</strong>sistent with the objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP 55.<br />

Part 4.4 Built form and articul<strong>at</strong>i<strong>on</strong>:<br />

The <str<strong>on</strong>g>to</str<strong>on</strong>g>tal building width <str<strong>on</strong>g>to</str<strong>on</strong>g> the Marian Street fr<strong>on</strong>tage is gre<strong>at</strong>er than 36m but reads <str<strong>on</strong>g>to</str<strong>on</strong>g> the street as<br />

two pavili<strong>on</strong>s due <str<strong>on</strong>g>to</str<strong>on</strong>g> the recessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the central part <str<strong>on</strong>g>of</str<strong>on</strong>g> the building (19.5m from the Marian Street<br />

fr<strong>on</strong>tage and 21m from the southern (rear) boundary). This reduces the overall perceived scale and<br />

bulk <str<strong>on</strong>g>of</str<strong>on</strong>g> built form and provides for extensive landscaped outdoor areas c<strong>on</strong>tributing <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>on</strong> site<br />

amenity and occupants <str<strong>on</strong>g>of</str<strong>on</strong>g> the development.<br />

The elev<strong>at</strong>i<strong>on</strong>s are str<strong>on</strong>gly modelled and articul<strong>at</strong>ed. This is mainly achieved through recessed and<br />

projecting balc<strong>on</strong>ies, a deep central recess, and the increased setback <str<strong>on</strong>g>of</str<strong>on</strong>g> the upper floor which<br />

c<strong>on</strong>tributes <str<strong>on</strong>g>to</str<strong>on</strong>g> reducing overall scale.<br />

Pedestrian entrances <str<strong>on</strong>g>to</str<strong>on</strong>g> Marian Street are defined by p<strong>at</strong>hways and visible entry points <str<strong>on</strong>g>to</str<strong>on</strong>g> the site<br />

providing s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry address <str<strong>on</strong>g>to</str<strong>on</strong>g> the street.<br />

Part 4.5 Residential amenity<br />

Unit num<str<strong>on</strong>g>be</str<strong>on</strong>g>rs 1, 4, 7, 10, 16, 19, 22, 25 <str<strong>on</strong>g>to</str<strong>on</strong>g>wards the centre <str<strong>on</strong>g>of</str<strong>on</strong>g> the building have a maximum<br />

separ<strong>at</strong>i<strong>on</strong> distance <str<strong>on</strong>g>of</str<strong>on</strong>g> 9.5m <str<strong>on</strong>g>be</str<strong>on</strong>g>tween family room windows. The primary windows for these rooms<br />

are loc<strong>at</strong>ed al<strong>on</strong>g the northern elev<strong>at</strong>i<strong>on</strong> and these family rooms are further separ<strong>at</strong>ed by priv<strong>at</strong>e<br />
