The development proposes a floor space r<strong>at</strong>io <str<strong>on</strong>g>of</str<strong>on</strong>g> 1.397:1 and reflects the desired future character <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
the area. The density is appropri<strong>at</strong>e for the site and can <str<strong>on</strong>g>be</str<strong>on</strong>g> serviced adequ<strong>at</strong>ely by existing physical<br />
infrastructure with no adverse impact <str<strong>on</strong>g>to</str<strong>on</strong>g> the area. Each dwelling within the development will <str<strong>on</strong>g>be</str<strong>on</strong>g><br />
afforded appropri<strong>at</strong>e solar access and cross ventil<strong>at</strong>i<strong>on</strong> due <str<strong>on</strong>g>to</str<strong>on</strong>g> the c<strong>on</strong>sidered size and layout. The<br />
floor area <str<strong>on</strong>g>of</str<strong>on</strong>g> the development is slightly larger than anticip<strong>at</strong>ed, however, the departure is minimal<br />
in the numerical sense and indiscernible in the visual c<strong>on</strong>text. Accordingly, the proposed floor<br />
space r<strong>at</strong>io is acceptable.<br />
Part 4.3 Setbacks:<br />
The proposal complies with the side (western) and rear (southern) setback requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> 6m. The<br />
subject site is a corner allotment with fr<strong>on</strong>tages <str<strong>on</strong>g>of</str<strong>on</strong>g> 77m and 50m <str<strong>on</strong>g>to</str<strong>on</strong>g> Marian Street and Caithness<br />
Street, respectively.<br />
Pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> DCP55, the respective street fr<strong>on</strong>tages require a building line setback <str<strong>on</strong>g>of</str<strong>on</strong>g> 13-15m. In<br />
rel<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> Marian Street, <str<strong>on</strong>g>be</str<strong>on</strong>g>ing the primary fr<strong>on</strong>tage, the proposed setback is <str<strong>on</strong>g>be</str<strong>on</strong>g>tween12.2m-19.8m.<br />
The proposed setback from the Caithness Street (sec<strong>on</strong>dary) fr<strong>on</strong>tage is <str<strong>on</strong>g>be</str<strong>on</strong>g>tween 10m-16m.<br />
In rel<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed n<strong>on</strong>-compliance with the setback from Marian Street, the following<br />
comments are made.<br />
The Marian Street elev<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the building measures 55m in length. The building line setback is<br />
broken down as follows<br />
43% - 12.2m setback,<br />
28% - 14.2m setback,<br />
17% - 19.8m setback,<br />
9% - 13m setback.<br />
Accordingly, 54% <str<strong>on</strong>g>of</str<strong>on</strong>g> the building line setback <str<strong>on</strong>g>to</str<strong>on</strong>g> Marian Street will <str<strong>on</strong>g>be</str<strong>on</strong>g> in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> 13m.<br />
The upper floor will <str<strong>on</strong>g>be</str<strong>on</strong>g> recessed from the perimeter <str<strong>on</strong>g>of</str<strong>on</strong>g> the building, and further setback from the<br />
Marian Street fr<strong>on</strong>tage by <str<strong>on</strong>g>be</str<strong>on</strong>g>tween 14.3m -22m. The ground floor <str<strong>on</strong>g>of</str<strong>on</strong>g> the building will <str<strong>on</strong>g>be</str<strong>on</strong>g> largely<br />
c<strong>on</strong>cealed from the street due <str<strong>on</strong>g>to</str<strong>on</strong>g> the fall <str<strong>on</strong>g>of</str<strong>on</strong>g> the site away from Marian Street and landscaping within<br />
the setback, reducing the overall height <str<strong>on</strong>g>of</str<strong>on</strong>g> building when viewed from Marian Street.<br />
Recessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the central part <str<strong>on</strong>g>of</str<strong>on</strong>g> the building for up <str<strong>on</strong>g>to</str<strong>on</strong>g> almost 20m (19.8m <strong>on</strong> northern elev<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
Marian Street) significantly reduces the perceived building mass by cre<strong>at</strong>ing two pavili<strong>on</strong>s <strong>at</strong> either<br />
end <str<strong>on</strong>g>of</str<strong>on</strong>g> the Marian Street elev<strong>at</strong>i<strong>on</strong> r<strong>at</strong>her than reading as <strong>on</strong>e c<strong>on</strong>tinuous building. Extensive<br />
articul<strong>at</strong>i<strong>on</strong> and modelling <str<strong>on</strong>g>of</str<strong>on</strong>g> the building further assist in breaking up fl<strong>at</strong> wall areas and reduce the<br />
bulk <str<strong>on</strong>g>of</str<strong>on</strong>g> built form <str<strong>on</strong>g>to</str<strong>on</strong>g> the street. The Marian Street setbacks will further maintain a 44m separ<strong>at</strong>i<strong>on</strong><br />
