In order ong>toong> allow unrestricted access for Council waste collection vehicles ong>toong> the basement garbage song>toong>rage/collection area, no doors or gates shall ong>beong> provided in the access driveways ong>toong> the basement carpark which would prevent this service. Where required, any security gate or door shown on the DA plans which would prevent this service must ong>beong> deleted from the plans approved with the Construction Certificate. 54 To ensure compliance with Australian Standard 2890.1 – 2004 “Off-Street car parking", no dividing structures such as cages or partitioning walls shall ong>beong> placed that divide individual car spaces. The design is approved based on an open space parking layout. 55. A Tree Preservation Order exists within the Ku-ring-gai Council area whereby the removal, lopping or destruction ong>ofong> any tree exceeding 5.0 metres in height or 4.0 metres in canopy spread (except where exempt as defined under Council’s Tree Preservation Order) without prior written consent ong>ofong> Council is prohibited. Release ong>ofong> the Construction Certificate gives auong>toong>matic approval ong>toong> the removal ONLY ong>ofong> those trees located on the subject property within the footprint ong>ofong> a proposed new building/structure or within 3.0 metres ong>ofong> a proposed new dwelling. Where this application is for a building/structure other than a dwelling then ONLY trees within the area ong>toong> ong>beong> occupied by this building/structure may ong>beong> removed. Other trees SHALL NOT ong>beong> REMOVED or DAMAGED without an application ong>beong>ing made under Council’s Tree Preservation Order. 56. The landscape works shall ong>beong> completed prior ong>toong> issue ong>ofong> final Certificate ong>ofong> Compliance and maintained in a satisfacong>toong>ry condition at all times. 57. Landscape works shall ong>beong> carried out in accordance with Landscape Drawing No LCP.01/A Job No. 040903 prepared by Botanica and dated 26/10/2004 submitted with the Development Application, except as amended by the following: • The Jacaranda mimosifolia (Jacaranda) trees proposed adjacent ong>toong> the north west (rear) site boundary are ong>toong> ong>beong> replaced with Syncarpia glomulifera (Turpentine) ong>ofong> the same pot size and spacing. • The proposed planting ong>ofong> Prunus blireana (Double flowering Plum) are ong>toong> ong>beong> replaced with another small ornamental tree species such as Malus ioensis ‘Plena’ or similar. • Proposed planting ong>ofong> Melia azederach (White Cedar) are ong>toong> ong>beong> replaced with Sapium sebifferum (Chinese Tallow Tree). • The proposed garden shed is ong>toong> ong>beong> located at the rear ong>ofong> the proposed building ong>beong>hind the building setbacks, so that it is not within any ong>ofong> the site frontages.
