33 Marian Street is a Walter Burley Griffin design and <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> his larger commissi<strong>on</strong>s in<br />

Australia. It is c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> St<strong>at</strong>e heritage significance, but not currently included <strong>on</strong><br />

the St<strong>at</strong>e Heritage Register. It is included in most n<strong>on</strong> st<strong>at</strong>u<str<strong>on</strong>g>to</str<strong>on</strong>g>ry heritage registers including<br />

the N<strong>at</strong>i<strong>on</strong>al Trust and the Australian Heritage Commissi<strong>on</strong>. It is c<strong>on</strong>sidered th<strong>at</strong> the<br />

curtilage <str<strong>on</strong>g>of</str<strong>on</strong>g> the item will not <str<strong>on</strong>g>be</str<strong>on</strong>g> affected by the proposed development as it does not extend <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the opposite side <str<strong>on</strong>g>of</str<strong>on</strong>g> the road. The heritage provisi<strong>on</strong>s in DCP 55 are s<strong>at</strong>isfied. The northern<br />

side <str<strong>on</strong>g>of</str<strong>on</strong>g> Marian Street has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en rez<strong>on</strong>ed, so the rel<strong>at</strong>i<strong>on</strong>ship <str<strong>on</strong>g>of</str<strong>on</strong>g> No 33 Marian Street with<br />

its immedi<strong>at</strong>ely neighbours will not <str<strong>on</strong>g>be</str<strong>on</strong>g> altered.<br />

The heritage item <strong>at</strong> 39 Marian Street is a large Feder<strong>at</strong>i<strong>on</strong> period house th<strong>at</strong> has <str<strong>on</strong>g>be</str<strong>on</strong>g>en<br />

altered <str<strong>on</strong>g>be</str<strong>on</strong>g>fore. Its primary elev<strong>at</strong>i<strong>on</strong> is <str<strong>on</strong>g>to</str<strong>on</strong>g> Marian Street, but its other more public elev<strong>at</strong>i<strong>on</strong> is<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the Pacific Highway. In my opini<strong>on</strong> the curtilage <str<strong>on</strong>g>of</str<strong>on</strong>g> this item will not <str<strong>on</strong>g>be</str<strong>on</strong>g> affected by the<br />

proposed development. The heritage requirements in DCP 555 are met.<br />

The building <strong>at</strong> No 1 Caithness Street is loc<strong>at</strong>ed <strong>at</strong> the southern end <str<strong>on</strong>g>of</str<strong>on</strong>g> the lot and the<br />

northern part <str<strong>on</strong>g>of</str<strong>on</strong>g> the garden is planted with substantial trees which screen the house from<br />

Marian Street and would largely screen views <str<strong>on</strong>g>to</str<strong>on</strong>g> and from the proposed medium density<br />

building. Give the c<strong>on</strong>trols in DCP 55, adequ<strong>at</strong>e physical and visual separ<strong>at</strong>i<strong>on</strong> would <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

achieved.<br />

I note th<strong>at</strong> several sites immedi<strong>at</strong>ely adjoining No 1 Caithness Street have also <str<strong>on</strong>g>be</str<strong>on</strong>g>en rez<strong>on</strong>ed<br />

and th<strong>at</strong> the impact from possible future developments <strong>on</strong> those adjoining sites may<br />

potentially <str<strong>on</strong>g>be</str<strong>on</strong>g> more severe th<strong>at</strong> any impacts from this proposed development. Future<br />

developments <strong>on</strong> the sites adjoining No 1 Caithness Street will need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> carefully addressed<br />

when applic<strong>at</strong>i<strong>on</strong>s for those sites are received.<br />

The applicant submitted a heritage report with the applic<strong>at</strong>i<strong>on</strong>. It st<strong>at</strong>es th<strong>at</strong> the nearby<br />

heritage items would not <str<strong>on</strong>g>be</str<strong>on</strong>g> adversely affected by the proposed development:<br />

There will <str<strong>on</strong>g>be</str<strong>on</strong>g> no diminuti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> appreci<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the nearby heritage items in Marian Street,<br />

Caithness Street or their visibility from publicly accessible secti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the street arising from<br />

the applic<strong>at</strong>i<strong>on</strong>.<br />

I note th<strong>at</strong> the heritage item <strong>at</strong> 1 Caithness Street was not menti<strong>on</strong>ed in the heritage report<br />

prepared by the applicant’s c<strong>on</strong>sultant, Noel Bell Ridley Smith and Partners. A letter from<br />

the c<strong>on</strong>sultant d<strong>at</strong>ed 7 February <strong>2005</strong> was submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> address the omissi<strong>on</strong>. It st<strong>at</strong>es:<br />

There was no purpose in not specifically referring <str<strong>on</strong>g>to</str<strong>on</strong>g> the item but simply as acceptance th<strong>at</strong><br />

the impacts would <str<strong>on</strong>g>be</str<strong>on</strong>g> very limited.<br />

The letter st<strong>at</strong>es th<strong>at</strong> No 1 Caithness Street is 57m from the proposed building, separ<strong>at</strong>ed by a<br />

roadway and screened by substantial landscape elements.<br />
