Furthermore, the site adjoining the southern (rear) boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> the development is z<strong>on</strong>ed for multi<br />

unit residential development, as are sites <str<strong>on</strong>g>be</str<strong>on</strong>g>y<strong>on</strong>d. This z<strong>on</strong>ing will result in buildings <str<strong>on</strong>g>of</str<strong>on</strong>g> a similar<br />

scale, bulk and height <str<strong>on</strong>g>be</str<strong>on</strong>g>ing c<strong>on</strong>structed <str<strong>on</strong>g>be</str<strong>on</strong>g>hind and around the proposed development.<br />

Five s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey development is out <str<strong>on</strong>g>of</str<strong>on</strong>g> character with the existing built envir<strong>on</strong>ment.<br />

Five-s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey multi-unit residential developments are permissible under the z<strong>on</strong>ing and are therefore<br />

anticip<strong>at</strong>ed within the area. The development complies with the prescri<str<strong>on</strong>g>be</str<strong>on</strong>g>d c<strong>on</strong>trols <str<strong>on</strong>g>of</str<strong>on</strong>g> LEP194, in<br />

particular maximum height, num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys and site coverage, and has adequ<strong>at</strong>e provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

deep soil landscaping and large tree planting, c<strong>on</strong>sistent with the established landscaped character<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the area.<br />

Adjoining properties <str<strong>on</strong>g>to</str<strong>on</strong>g> the west and south <str<strong>on</strong>g>of</str<strong>on</strong>g> the development site are also z<strong>on</strong>ed for multi-unit<br />

residential development This proposal resp<strong>on</strong>ds effectively <str<strong>on</strong>g>to</str<strong>on</strong>g> the objectives and development<br />

standards <str<strong>on</strong>g>of</str<strong>on</strong>g> LEP194 and DCP55 and is therefore in accordance with the desired future character <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the area.<br />

Pers<strong>on</strong>al security for residents <str<strong>on</strong>g>of</str<strong>on</strong>g> Marian Street potentially compromised as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

proposed development.<br />

The development provides open comm<strong>on</strong> spaces, clear definiti<strong>on</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g>tween public and priv<strong>at</strong>e spaces<br />

and enhances street level activity through higher density living. Due c<strong>on</strong>sider<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> security has<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>en given through the siting and design <str<strong>on</strong>g>of</str<strong>on</strong>g> the building and the large terrace and balc<strong>on</strong>y areas<br />

provided for each dwelling <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure a high level <str<strong>on</strong>g>of</str<strong>on</strong>g> informal surveillance <str<strong>on</strong>g>of</str<strong>on</strong>g> the street.<br />

Potential reducti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> parking availability al<strong>on</strong>g Marian Street<br />

The development will provide a <str<strong>on</strong>g>to</str<strong>on</strong>g>tal <str<strong>on</strong>g>of</str<strong>on</strong>g> 61 car parking spaces within a two level basement car park.<br />

This num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> parking spaces is well in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> the requirements under DCP 55 and provides a<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g>tal <str<strong>on</strong>g>of</str<strong>on</strong>g> two spaces per unit with seven visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r spaces. Accordingly, there is more than adequ<strong>at</strong>e <strong>on</strong><br />

site parking available for residents and visi<str<strong>on</strong>g>to</str<strong>on</strong>g>rs <str<strong>on</strong>g>of</str<strong>on</strong>g> the development with no dependency for parking<br />

<strong>on</strong> Marian Street itself.<br />

Property values<br />

The proposal is permissible under the z<strong>on</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> the site and potential impacts <strong>on</strong> property values is<br />

not a valid planning c<strong>on</strong>sider<strong>at</strong>i<strong>on</strong> under s79C <str<strong>on</strong>g>of</str<strong>on</strong>g> the Envir<strong>on</strong>mental Planning and Assessment<br />

1979.<br />

Insufficient tree protecti<strong>on</strong> and landscaping<br />

The development complies with the 50% deep soil landscaping development standard under<br />

LEP194 and provides for extensive landscaping throughout the site, including planting <str<strong>on</strong>g>of</str<strong>on</strong>g> an<br />

additi<strong>on</strong>al thirteen large canopy trees. The proposal also retains two 24m high Sydney Gum trees<br />

al<strong>on</strong>g the fr<strong>on</strong>t boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> the site which c<strong>on</strong>tribute significantly <str<strong>on</strong>g>to</str<strong>on</strong>g> the streetscape. Councils<br />

Landscape Officer Mr Ge<str<strong>on</strong>g>of</str<strong>on</strong>g>f Bird has reviewed the proposal in rel<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> tree protecti<strong>on</strong> and<br />

supports the development subject <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s (Refer C<strong>on</strong>diti<strong>on</strong> No’s 43-56, 85-87, 105-108).<br />
