A 6m setback is proposed <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the terrace/pergola <str<strong>on</strong>g>of</str<strong>on</strong>g> Unit A11 and the northern boundary<br />

(1446 Pacific Highway). The 6m available for landscaping is reduced by:<br />

a) A series <str<strong>on</strong>g>of</str<strong>on</strong>g> retaining walls th<strong>at</strong> cre<strong>at</strong>e a planter box app. 1.6m wide and 2-3m high,<br />

b) a p<strong>at</strong>h (1.2m wide) almost stretching the entire length <str<strong>on</strong>g>of</str<strong>on</strong>g> the rear boundary and<br />

c) in additi<strong>on</strong> 2m <str<strong>on</strong>g>to</str<strong>on</strong>g> 3.6m <str<strong>on</strong>g>of</str<strong>on</strong>g> the remaining setback area currently forms part <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

c<strong>on</strong>creted area <str<strong>on</strong>g>of</str<strong>on</strong>g> Kirawa Close. The necessary c<strong>on</strong>sent has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

demolish part <str<strong>on</strong>g>of</str<strong>on</strong>g> the driveway and replace those areas with landscaping.<br />

With or without the above c<strong>on</strong>sent, the effective area for deep soil landscaping in the side<br />

setback adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> Unit A11 is gre<strong>at</strong>ly reduced. This is not sufficient <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure the<br />

establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> effective landscaping and canopy trees th<strong>at</strong> would screen the adjacent<br />

property No. 1446 Pacific Highway or provide appropri<strong>at</strong>e separ<strong>at</strong>i<strong>on</strong>. This is especially<br />

relevant in light <str<strong>on</strong>g>of</str<strong>on</strong>g> the fact th<strong>at</strong> No 1446 was not incorpor<strong>at</strong>ed in<str<strong>on</strong>g>to</str<strong>on</strong>g> DA 0077/05 and may end<br />

up as an isol<strong>at</strong>ed dwelling <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the two high density developments.<br />

2.7 The proposed finishes <str<strong>on</strong>g>of</str<strong>on</strong>g> the development is c<strong>on</strong>sidered inappropri<strong>at</strong>e as it fails <str<strong>on</strong>g>to</str<strong>on</strong>g> harm<strong>on</strong>ise<br />

with existing envir<strong>on</strong>ment and c<strong>on</strong>text which reflects mid <str<strong>on</strong>g>to</str<strong>on</strong>g>ne <str<strong>on</strong>g>to</str<strong>on</strong>g> dark colours and gre<strong>at</strong>er use<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> brick and tim<str<strong>on</strong>g>be</str<strong>on</strong>g>r.<br />

3. IMPACT ON TREES<br />

The proposed development will result in the clearing <str<strong>on</strong>g>of</str<strong>on</strong>g> the site. The site analysis plan shows<br />

the retenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>on</strong>ly 6 <str<strong>on</strong>g>of</str<strong>on</strong>g> the 55 trees identified as <str<strong>on</strong>g>be</str<strong>on</strong>g>ing associ<strong>at</strong>ed with the site, <str<strong>on</strong>g>of</str<strong>on</strong>g> which<br />

three (3) or 50% are loc<strong>at</strong>ed <str<strong>on</strong>g>of</str<strong>on</strong>g>f site. The trees <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> retained are No’s 382, 383, 4<strong>26</strong>, 428,<br />

436, and 424. Tree No’s 395 - 419 are part <str<strong>on</strong>g>of</str<strong>on</strong>g> an existing tree grouping/stand loc<strong>at</strong>ed<br />

centrally <strong>on</strong> site. Given the scale <str<strong>on</strong>g>of</str<strong>on</strong>g> development for the site, it is not possible <str<strong>on</strong>g>to</str<strong>on</strong>g> retain these<br />

trees due <str<strong>on</strong>g>to</str<strong>on</strong>g> their central loc<strong>at</strong>i<strong>on</strong>.<br />

The removal <str<strong>on</strong>g>of</str<strong>on</strong>g> Tree No. 427 Eucalyptus saligna (Bluegum), misidentified as Eucalyptus<br />

pilularis (Blackbutt), is unacceptable and cannot <str<strong>on</strong>g>be</str<strong>on</strong>g> supported. The tree, which is loc<strong>at</strong>ed<br />

adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> the southern site boundary, is outwardly in excellent health and c<strong>on</strong>diti<strong>on</strong>, has not<br />

suffered s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm damage and is significant within the broader landscape. The tree forms part <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the interc<strong>on</strong>necting canopy th<strong>at</strong> typifies the locality and as the c<strong>on</strong>sulting arborist st<strong>at</strong>es “the<br />

retenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the these trees [including #427] allows them as comp<strong>on</strong>ents <str<strong>on</strong>g>of</str<strong>on</strong>g> the current<br />

curtilage <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> transferred <str<strong>on</strong>g>to</str<strong>on</strong>g> the new dwellings, maintaining elements <str<strong>on</strong>g>of</str<strong>on</strong>g> a c<strong>on</strong>tinuous<br />

landscape, providing a more harm<strong>on</strong>ious integr<strong>at</strong>i<strong>on</strong> and transiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the use <str<strong>on</strong>g>of</str<strong>on</strong>g> the land”.<br />
