1. Inadequ<strong>at</strong>e Inform<strong>at</strong>i<strong>on</strong><br />

The document<strong>at</strong>i<strong>on</strong> and plans submitted are inadequ<strong>at</strong>e and fail <str<strong>on</strong>g>to</str<strong>on</strong>g> provide inform<strong>at</strong>i<strong>on</strong> in order for<br />

Council <str<strong>on</strong>g>to</str<strong>on</strong>g> properly assess the applic<strong>at</strong>i<strong>on</strong>.<br />

Particulars<br />

1.1 SEPP 1 objecti<strong>on</strong> - Deep soil landscaping<br />

The applic<strong>at</strong>i<strong>on</strong> proposes deep soil landscaping amounting <str<strong>on</strong>g>to</str<strong>on</strong>g> less than 50% <str<strong>on</strong>g>of</str<strong>on</strong>g> the site area.<br />

This discrepancy is due <str<strong>on</strong>g>to</str<strong>on</strong>g>:<br />

• the insufficient width <str<strong>on</strong>g>of</str<strong>on</strong>g> the terraces in Lam<strong>on</strong>d Drive which are excluded as deep soil<br />

area. (There is a discrepancy <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the architectural plans, secti<strong>on</strong>s and the landscape<br />

plans.)<br />

• the elev<strong>at</strong>ed tim<str<strong>on</strong>g>be</str<strong>on</strong>g>r walkways al<strong>on</strong>g the length <str<strong>on</strong>g>of</str<strong>on</strong>g> the northern boundary are shown <strong>on</strong><br />

the landscape plans and s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm w<strong>at</strong>er designs but not in the architectural plans. In<br />

additi<strong>on</strong> these are more than 1m wide and are therefore excluded from the deep soil<br />

planting area.<br />

• s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm w<strong>at</strong>er drainage plans show additi<strong>on</strong>al extensive paved areas in the western (rear)<br />

and northern (side) setback areas which are not reflected in the landscape nor in the<br />

architectural plans. The architectural plans show these areas as <str<strong>on</strong>g>be</str<strong>on</strong>g>ing levelled.<br />

• paved areas north <str<strong>on</strong>g>of</str<strong>on</strong>g> Unit A11 and the series <str<strong>on</strong>g>of</str<strong>on</strong>g> retaining walls required in this area do<br />

not s<strong>at</strong>isfy the requirements and do not c<strong>on</strong>stitute deep soil area.<br />

• the provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an electrical subst<strong>at</strong>i<strong>on</strong> and associ<strong>at</strong>ed manoeuvring space required by<br />

Energy Australia will further reduce the deep soil area.<br />

This fails <str<strong>on</strong>g>to</str<strong>on</strong>g> s<strong>at</strong>isfy the standard c<strong>on</strong>tained in Clause 25I 1(2) <str<strong>on</strong>g>of</str<strong>on</strong>g> LEP 194 th<strong>at</strong> requires sites<br />

with an area <str<strong>on</strong>g>of</str<strong>on</strong>g> 1,800 square metres or more <str<strong>on</strong>g>to</str<strong>on</strong>g> have deep soil landscaping for <strong>at</strong> least 50% <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the site area.<br />

A SEPP 1 objecti<strong>on</strong>, which should justify why it is unreas<strong>on</strong>able and unnecessary <str<strong>on</strong>g>to</str<strong>on</strong>g> apply the<br />

standard in this instance, has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided.<br />

1.2 Owner’s c<strong>on</strong>sent<br />

The applicant proposes demoliti<strong>on</strong> works <str<strong>on</strong>g>to</str<strong>on</strong>g> structures within an existing right <str<strong>on</strong>g>of</str<strong>on</strong>g> carriage<br />

way. The necessary c<strong>on</strong>sent from the owners <str<strong>on</strong>g>of</str<strong>on</strong>g> the dominant tenement has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en<br />

obtained.<br />

The applicant proposes <str<strong>on</strong>g>to</str<strong>on</strong>g> reduce the width <str<strong>on</strong>g>of</str<strong>on</strong>g> Kirawa Close and introduce landscaping in its<br />

stead. The driveway is reduced in width by 2m <str<strong>on</strong>g>to</str<strong>on</strong>g> 3.6m thus effectively halving its width and<br />

reducing its usability. The owners <str<strong>on</strong>g>of</str<strong>on</strong>g> No. 1446 Pacific Highway are <str<strong>on</strong>g>be</str<strong>on</strong>g>nefitted by a right <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

carriage way over the c<strong>on</strong>crete driveway and their c<strong>on</strong>sent has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en obtained.<br />
