There is a c<strong>on</strong>cern with regard <str<strong>on</strong>g>to</str<strong>on</strong>g> the length <str<strong>on</strong>g>of</str<strong>on</strong>g> the building. At 72 metres, it fills up the entire<br />

Lam<strong>on</strong>d Drive fr<strong>on</strong>tage. The resulting tunnel effect will block out all views/glimpses <str<strong>on</strong>g>to</str<strong>on</strong>g> the north<br />

and <str<strong>on</strong>g>to</str<strong>on</strong>g> the east (especially relevant when No’s 3–11 Lam<strong>on</strong>d Drive are developed).<br />

An improved outcome may <str<strong>on</strong>g>be</str<strong>on</strong>g> achieved by splitting the development in<str<strong>on</strong>g>to</str<strong>on</strong>g> two more symp<strong>at</strong>hetically<br />

scaled modules which more appropri<strong>at</strong>ely reflect the character <str<strong>on</strong>g>of</str<strong>on</strong>g> the locality. (Refer Reas<strong>on</strong> For<br />

Refusal No 2.2)<br />

Part 4.5 Residential Amenity<br />

4.5.2 Visual Privacy<br />

The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> s<strong>at</strong>isfy the minimum separ<strong>at</strong>i<strong>on</strong> requirements for the adjoining property <strong>at</strong><br />

No 5 Lam<strong>on</strong>d Drive. Overlooking from the ro<str<strong>on</strong>g>of</str<strong>on</strong>g> terraces <str<strong>on</strong>g>to</str<strong>on</strong>g> this property will also have a<br />

detrimental impact <strong>on</strong> th<strong>at</strong> property’s amenity. However, these c<strong>on</strong>cerns are diminished as No 5<br />

Lam<strong>on</strong>d Drive is included in the adjacent Development Applic<strong>at</strong>i<strong>on</strong> (No. 0077/05). In th<strong>at</strong> scheme,<br />

the dwelling is demolished <str<strong>on</strong>g>to</str<strong>on</strong>g> make way for an elev<strong>at</strong>ed driveway <str<strong>on</strong>g>to</str<strong>on</strong>g> the basement car park.<br />

4.5.5 Outdoor living<br />

The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide for outdoor living which is compliant with the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

DCP55. Specifically, Units A22, A32, A42, A23, A33 and A43do not provide for <strong>at</strong> least 12m 2 as<br />

required for two <str<strong>on</strong>g>be</str<strong>on</strong>g>droom units. Additi<strong>on</strong>ally, Units B21, B31 and B32 do not provide the required<br />

15m 2 which is necessary for 3 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom units. The above units are generally loc<strong>at</strong>ed closer <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

Pacific Highway where the use <str<strong>on</strong>g>of</str<strong>on</strong>g> these areas may <str<strong>on</strong>g>be</str<strong>on</strong>g> limited due <str<strong>on</strong>g>to</str<strong>on</strong>g> poise and polluti<strong>on</strong> impacts.<br />

Part 4.6 Safety and security:<br />

The proposed development will have high levels <str<strong>on</strong>g>of</str<strong>on</strong>g> safety and security due <str<strong>on</strong>g>to</str<strong>on</strong>g> its extensive length<br />

al<strong>on</strong>g Finlay Road and resultant possibilities for street surveillance.<br />

The three pedestrian p<strong>at</strong>hways are clearly visible from the streets, with unimpeded sightlines, and<br />

will <str<strong>on</strong>g>be</str<strong>on</strong>g> provided with lighting. Further, the residents’ basement parking areas all provide for lift<br />

access <str<strong>on</strong>g>to</str<strong>on</strong>g> units without the need <str<strong>on</strong>g>to</str<strong>on</strong>g> enter <strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> Finlay Road.<br />

All <str<strong>on</strong>g>of</str<strong>on</strong>g> the comm<strong>on</strong> open space areas will <str<strong>on</strong>g>be</str<strong>on</strong>g> overlooked by apartments, with no c<strong>on</strong>cealed or<br />

entrapment areas.<br />

Part 4.7 Social dimensi<strong>on</strong>s:<br />

The applic<strong>at</strong>i<strong>on</strong> provides for an acceptable housing mix, as is required by C<strong>on</strong>trol 5 <str<strong>on</strong>g>of</str<strong>on</strong>g> Part 4.7.<br />

This is evidenced by the fact th<strong>at</strong> a range, comprising <str<strong>on</strong>g>of</str<strong>on</strong>g> 4 x 1 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom apartments, 22 x 2 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom<br />

apartments and 16 x 3 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom apartments, is proposed.<br />
