complemented by the pervading treed landscape <str<strong>on</strong>g>of</str<strong>on</strong>g> Ku-ring-gai, which is also underpinned by<br />

the m<strong>at</strong>ure and diverse priv<strong>at</strong>e gardens <str<strong>on</strong>g>of</str<strong>on</strong>g> the locality.<br />

The area joins with other parts <str<strong>on</strong>g>of</str<strong>on</strong>g> Warrawee and Wahro<strong>on</strong>ga, some forming separ<strong>at</strong>ely<br />

recognized c<strong>on</strong>serv<strong>at</strong>i<strong>on</strong> areas, <str<strong>on</strong>g>to</str<strong>on</strong>g> form the distinctive suburb which is quintessential <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

character <str<strong>on</strong>g>of</str<strong>on</strong>g> Ku-ring-gai ad <str<strong>on</strong>g>to</str<strong>on</strong>g> the l<strong>on</strong>g established identity <str<strong>on</strong>g>of</str<strong>on</strong>g> Sydney’s Upper North Shore”.<br />

Some weight should <str<strong>on</strong>g>be</str<strong>on</strong>g> given <str<strong>on</strong>g>to</str<strong>on</strong>g> the significance <str<strong>on</strong>g>of</str<strong>on</strong>g> this area and the implic<strong>at</strong>i<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> future change.<br />

The UCA review has reviewed 11 other areas in depth and found th<strong>at</strong> <strong>on</strong>ly <strong>on</strong>e UCA has St<strong>at</strong>e<br />

heritage significance. The grading th<strong>at</strong> Council’s c<strong>on</strong>sultant places <strong>on</strong> this precinct (St<strong>at</strong>e<br />

significance) should not <str<strong>on</strong>g>be</str<strong>on</strong>g> ignored. This is an indica<str<strong>on</strong>g>to</str<strong>on</strong>g>r th<strong>at</strong> future change in the precinct should<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g> carefully managed. Clearly this development <str<strong>on</strong>g>of</str<strong>on</strong>g> five s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys in height does not fit with the<br />

existing character and heritage values in the UCA. If we accept the recommend grading and<br />

boundaries in the draft report, this applic<strong>at</strong>i<strong>on</strong> would result in demoliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>on</strong>e c<strong>on</strong>tribu<str<strong>on</strong>g>to</str<strong>on</strong>g>ry item.<br />

If the N<strong>at</strong>i<strong>on</strong>al Trust UCA is c<strong>on</strong>sidered, this site is <strong>on</strong> the edge <str<strong>on</strong>g>of</str<strong>on</strong>g> the UCA and a development <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

this scale would have c<strong>on</strong>siderable visual and c<strong>on</strong>textual impacts.<br />

Heritage impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed development<br />

The proposed development is <str<strong>on</strong>g>of</str<strong>on</strong>g> five s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys height al<strong>on</strong>g the Pacific Highway. This is a housing<br />

form foreign <str<strong>on</strong>g>to</str<strong>on</strong>g> the immedi<strong>at</strong>e area. It would <str<strong>on</strong>g>be</str<strong>on</strong>g> a dominant building if built as proposed. If the<br />

c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> the UCA is c<strong>on</strong>sidered, this development would <str<strong>on</strong>g>be</str<strong>on</strong>g> a very poor fit given the existing area.<br />

The development would require demoliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a house graded as c<strong>on</strong>tribu<str<strong>on</strong>g>to</str<strong>on</strong>g>ry <str<strong>on</strong>g>to</str<strong>on</strong>g> the UCA and<br />

would <str<strong>on</strong>g>be</str<strong>on</strong>g> partially within the amended UCA area.<br />

When c<strong>on</strong>sidering the site, it falls sharply <str<strong>on</strong>g>to</str<strong>on</strong>g> the west which allows a c<strong>on</strong>siderable part <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

building <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> loc<strong>at</strong>ed <str<strong>on</strong>g>be</str<strong>on</strong>g>low the Pacific Highway level and away from the main public view<br />

corridor. However, the western façade, which is the highest part <str<strong>on</strong>g>of</str<strong>on</strong>g> the building is orient<strong>at</strong>ed <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

Pacific Highway which increased its visual presence and would have impacts <strong>on</strong> the adjoining UCA<br />

and <str<strong>on</strong>g>to</str<strong>on</strong>g> a limited extent the nearby heritage items. It is unfortun<strong>at</strong>e th<strong>at</strong> the Pacific Highway<br />

elev<strong>at</strong>i<strong>on</strong> was not reduced in scale. I acknowledge th<strong>at</strong> the c<strong>on</strong>trols in DCP55 have resulted in the<br />

proposed development, but a <str<strong>on</strong>g>be</str<strong>on</strong>g>tter outcome might have <str<strong>on</strong>g>be</str<strong>on</strong>g>en achieved if some mechanism was<br />

available <str<strong>on</strong>g>to</str<strong>on</strong>g> allow more density in the parts <str<strong>on</strong>g>of</str<strong>on</strong>g> the site set down from the Pacific Highway or more<br />

density <str<strong>on</strong>g>to</str<strong>on</strong>g> other sites recently subject <str<strong>on</strong>g>to</str<strong>on</strong>g> rez<strong>on</strong>ing, such as a mechanism for transfer <str<strong>on</strong>g>of</str<strong>on</strong>g> floor space<br />

potential <str<strong>on</strong>g>to</str<strong>on</strong>g> other sites.<br />
