assessing impacts <strong>on</strong> heritage items. Council has prepared a similar document <str<strong>on</strong>g>to</str<strong>on</strong>g> assist in<br />

prepar<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> impact assessments.<br />

Impact <strong>on</strong> nearby heritage items.<br />

The heritage report c<strong>on</strong>siders there is no impact <strong>on</strong> the nearby heritage items, mainly <str<strong>on</strong>g>be</str<strong>on</strong>g>cause they<br />

are separ<strong>at</strong>ed from the heritage items by a reas<strong>on</strong>able distance. The assumpti<strong>on</strong> here is th<strong>at</strong> the<br />

curtilage <str<strong>on</strong>g>of</str<strong>on</strong>g> the heritage items is limited and does not extend <str<strong>on</strong>g>to</str<strong>on</strong>g> include the subject site. The report<br />

maintains th<strong>at</strong> in the case <str<strong>on</strong>g>of</str<strong>on</strong>g> No 1359 Pacific Highway, almost directly opposite, separ<strong>at</strong>i<strong>on</strong> by the<br />

Pacific Highway is sufficient and in the case <strong>on</strong> No 1428 Pacific Highway, separ<strong>at</strong>i<strong>on</strong> by Lam<strong>on</strong>d<br />

Drive and <strong>on</strong>e other house lot is sufficient. It maintains th<strong>at</strong> 1428 Pacific Highway is <str<strong>on</strong>g>to</str<strong>on</strong>g>o far<br />

removed <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> affected. While I accept th<strong>at</strong> there is some physical and visual separ<strong>at</strong>i<strong>on</strong>, I c<strong>on</strong>clude<br />

th<strong>at</strong> the development would have impact as the scale <str<strong>on</strong>g>of</str<strong>on</strong>g> the development is much wider and higher<br />

than the existing c<strong>on</strong>text, which is <strong>on</strong>e and two s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey residential buildings in garden settings and it<br />

would <str<strong>on</strong>g>be</str<strong>on</strong>g> a visually dominant element in the immedi<strong>at</strong>e area. However, I acknowledge th<strong>at</strong> the<br />

proposed development would not diminish the view <str<strong>on</strong>g>of</str<strong>on</strong>g> the heritage items from the public areas,<br />

particularly the Pacific Highway.<br />

Impact <strong>on</strong> Urban C<strong>on</strong>serv<strong>at</strong>i<strong>on</strong> Area.<br />

The subject site is loc<strong>at</strong>ed rel<strong>at</strong>ively close <str<strong>on</strong>g>to</str<strong>on</strong>g> the N<strong>at</strong>i<strong>on</strong>al Trust UCA No 25 – Heyd<strong>on</strong> Avenue<br />

Warrawee. The precinct includes most <str<strong>on</strong>g>of</str<strong>on</strong>g> the land <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the Pacific Highway and the railway<br />

line from Redleaf Avenue <str<strong>on</strong>g>to</str<strong>on</strong>g> Finlay Road. Council has adopted a policy <str<strong>on</strong>g>of</str<strong>on</strong>g> reviewing the UCAs<br />

classified by the N<strong>at</strong>i<strong>on</strong>al Trust. UCA No 25 was reviewed in Oc<str<strong>on</strong>g>to</str<strong>on</strong>g><str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004. The draft report<br />

extends the precinct al<strong>on</strong>g the Pacific Highway <str<strong>on</strong>g>to</str<strong>on</strong>g> include No 1444, which is part <str<strong>on</strong>g>of</str<strong>on</strong>g> the subject site.<br />

Although Council has not exhibited the draft review for this area, it is apparent th<strong>at</strong> the subject site<br />

has some c<strong>on</strong>tribu<str<strong>on</strong>g>to</str<strong>on</strong>g>ry values <str<strong>on</strong>g>to</str<strong>on</strong>g> the UCA and the heritage impact assessment has not acknowledged<br />

this, or included reference <str<strong>on</strong>g>to</str<strong>on</strong>g> it in its assessment. The review <str<strong>on</strong>g>of</str<strong>on</strong>g> this precinct, c<strong>on</strong>cludes it has St<strong>at</strong>e<br />

heritage significance. The following is the St<strong>at</strong>ement <str<strong>on</strong>g>of</str<strong>on</strong>g> Significance, which supplements the<br />

st<strong>at</strong>ement in DCP 55:<br />

“The Heyd<strong>on</strong> Avenue Warrawee UCA is <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> the his<str<strong>on</strong>g>to</str<strong>on</strong>g>rically and aesthetically distinctive<br />

residential areas within Ku-ring-gai which exhibit excepti<strong>on</strong>al heritage significance and values<br />

in the integrity and qualities <str<strong>on</strong>g>of</str<strong>on</strong>g> their development p<strong>at</strong>tern and streetscapes, buildings and<br />

gardens. The subdivisi<strong>on</strong> p<strong>at</strong>tern <str<strong>on</strong>g>of</str<strong>on</strong>g> the area and its his<str<strong>on</strong>g>to</str<strong>on</strong>g>rical evoluti<strong>on</strong> remain legible,<br />

retaining vestiges <str<strong>on</strong>g>of</str<strong>on</strong>g> the early est<strong>at</strong>es in the boundaries and streets formed when subdivisi<strong>on</strong><br />

were pursued - allowing many <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing homes, which are the first buildings up<strong>on</strong> their<br />

sites, <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> built. Many <str<strong>on</strong>g>of</str<strong>on</strong>g> these houses are the work <str<strong>on</strong>g>of</str<strong>on</strong>g> notable c<strong>on</strong>temporary architects and<br />

retain their sophistic<strong>at</strong>ed garden settings, some <str<strong>on</strong>g>of</str<strong>on</strong>g> which are in turn the work <str<strong>on</strong>g>of</str<strong>on</strong>g> prominent<br />

landscape architects and gardeners. They are still <str<strong>on</strong>g>be</str<strong>on</strong>g>ing studies and their significance <str<strong>on</strong>g>be</str<strong>on</strong>g>tter<br />

unders<str<strong>on</strong>g>to</str<strong>on</strong>g>od.<br />

The areas predominantly residential character, established and maintained by its early<br />

residents and interrupted <strong>on</strong>ly by the well-known local people and priv<strong>at</strong>e schools, in<br />
