(3) All car parking provided must not <str<strong>on</strong>g>be</str<strong>on</strong>g> open air car parking unless it is for visi<str<strong>on</strong>g>to</str<strong>on</strong>g>rs, in which case<br />

it must <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>structed with w<strong>at</strong>er-permeable paving unless the paving is directly above part <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

basement.<br />

Based <strong>on</strong> the requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> the LEP, the proposal therefore requires a minimum <str<strong>on</strong>g>of</str<strong>on</strong>g> 51 resident<br />

spaces and 13 visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r spaces. The proposal provides 89 resident spaces and 13 visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r spaces and<br />

therefore exceeds the requirements the LEP.<br />

The traffic gener<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this development has <str<strong>on</strong>g>be</str<strong>on</strong>g>en estim<strong>at</strong>ed using the RTA “Guide <str<strong>on</strong>g>to</str<strong>on</strong>g> Traffic<br />

Gener<strong>at</strong>ing Developments” as follows:<br />

In terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the impact <str<strong>on</strong>g>of</str<strong>on</strong>g> the development <strong>on</strong> the road network, this can <str<strong>on</strong>g>be</str<strong>on</strong>g> ascertained generally by<br />

the capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> the affected intersecti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>at</strong>er for the increased traffic loading. C<strong>on</strong>sidering th<strong>at</strong><br />

Lam<strong>on</strong>d Drive is a cul-de-sac, placing the net additi<strong>on</strong>al traffic figures <strong>at</strong> the Pacific<br />

Highway/Lam<strong>on</strong>d Drive intersecti<strong>on</strong> is not c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> cre<strong>at</strong>e a problem, however this is<br />

c<strong>on</strong>diti<strong>on</strong>al th<strong>at</strong> exit from Lam<strong>on</strong>d Drive <strong>on</strong><str<strong>on</strong>g>to</str<strong>on</strong>g> Pacific Hwy is restricted <str<strong>on</strong>g>to</str<strong>on</strong>g> the left turn <strong>on</strong>ly. The<br />

right turn movement from Lam<strong>on</strong>d Ave in<str<strong>on</strong>g>to</str<strong>on</strong>g> the Pacific Hwy is currently permitted, however is<br />

c<strong>on</strong>sidered dangerous due <str<strong>on</strong>g>to</str<strong>on</strong>g> poor sight distance and approach speed <strong>on</strong> the highway. The<br />

install<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> “No right turn” signage is supported in the applicants DA submissi<strong>on</strong> traffic report,<br />

secti<strong>on</strong> 4.5, where it is st<strong>at</strong>ed “we c<strong>on</strong>cur with this proposal (<str<strong>on</strong>g>to</str<strong>on</strong>g> install no right turn signage) and<br />

the safety <str<strong>on</strong>g>be</str<strong>on</strong>g>nefits <str<strong>on</strong>g>of</str<strong>on</strong>g> this proposal far outweigh the neg<strong>at</strong>ive impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> residents having <str<strong>on</strong>g>to</str<strong>on</strong>g> travel<br />

further <str<strong>on</strong>g>to</str<strong>on</strong>g> travel south al<strong>on</strong>g the Pacific Highway”.<br />

Accordingly, it will <str<strong>on</strong>g>be</str<strong>on</strong>g> a requirement th<strong>at</strong> the applicant seek <str<strong>on</strong>g>to</str<strong>on</strong>g> install “no-right turn” signage <strong>at</strong><br />

the intersecti<strong>on</strong>, which will restrict access <str<strong>on</strong>g>to</str<strong>on</strong>g> and from Lam<strong>on</strong>d Ave <str<strong>on</strong>g>to</str<strong>on</strong>g> a left in, left out movement<br />

<strong>on</strong>ly. The install<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this signage will <str<strong>on</strong>g>be</str<strong>on</strong>g> subject <str<strong>on</strong>g>to</str<strong>on</strong>g> the final approval <str<strong>on</strong>g>of</str<strong>on</strong>g> the RTA (who will<br />

require a Traffic Management Plan (TMP) <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared). In the interests <str<strong>on</strong>g>of</str<strong>on</strong>g> safety during<br />

c<strong>on</strong>structi<strong>on</strong>, this signage shall <str<strong>on</strong>g>be</str<strong>on</strong>g> put in place prior <str<strong>on</strong>g>to</str<strong>on</strong>g> the commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> any works <strong>on</strong> site.<br />

As the install<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the signage is dependant up<strong>on</strong> RTA approval, the necessary c<strong>on</strong>diti<strong>on</strong><br />

requiring the applicant <str<strong>on</strong>g>to</str<strong>on</strong>g> install the signage will <str<strong>on</strong>g>be</str<strong>on</strong>g> placed as a deferred commencement c<strong>on</strong>diti<strong>on</strong>.<br />

C<strong>on</strong>structi<strong>on</strong> Management<br />

A detailed c<strong>on</strong>structi<strong>on</strong> management plan must <str<strong>on</strong>g>be</str<strong>on</strong>g> submitted for re view by Council Engineers prior<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> any works <strong>on</strong> site. This has <str<strong>on</strong>g>be</str<strong>on</strong>g>en c<strong>on</strong>diti<strong>on</strong>ed.<br />
