25 January <strong>2005</strong> Preliminary comments from Council’s Development Engineer and Heritage<br />

Officer provided <str<strong>on</strong>g>to</str<strong>on</strong>g> applicant.<br />

10 February <strong>2005</strong> Council informs applicant <str<strong>on</strong>g>of</str<strong>on</strong>g> a num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>cerns with the applic<strong>at</strong>i<strong>on</strong>.<br />

22 February <strong>2005</strong> A class 1 appeal is lodged with the Land and Envir<strong>on</strong>ment Court against the<br />

deemed refusal <str<strong>on</strong>g>of</str<strong>on</strong>g> Development Applic<strong>at</strong>i<strong>on</strong> No 1099/04.<br />

28 February <strong>2005</strong> Applicant submits amended plans and indic<strong>at</strong>es th<strong>at</strong> further amended plans<br />

will <str<strong>on</strong>g>be</str<strong>on</strong>g> furnished in due course.<br />

30 March <strong>2005</strong> C<strong>on</strong>trary <str<strong>on</strong>g>to</str<strong>on</strong>g> previous advice, applicant informs Council th<strong>at</strong> no further<br />

amended plans will <str<strong>on</strong>g>be</str<strong>on</strong>g> submitted.<br />

8 April <strong>2005</strong> Issues filed by Council in resp<strong>on</strong>se <str<strong>on</strong>g>to</str<strong>on</strong>g> the deemed refusal appeal as follows:<br />

The document<strong>at</strong>i<strong>on</strong> and plans submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> Council are c<strong>on</strong>sidered inadequ<strong>at</strong>e and<br />

fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide inform<strong>at</strong>i<strong>on</strong> in order for Council <str<strong>on</strong>g>to</str<strong>on</strong>g> properly determine the<br />

applic<strong>at</strong>i<strong>on</strong>.<br />

The applic<strong>at</strong>i<strong>on</strong> proposes deep soil landscaping amounting <str<strong>on</strong>g>to</str<strong>on</strong>g> less than 50%<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the site area. This discrepancy is due <str<strong>on</strong>g>to</str<strong>on</strong>g>:<br />
