The proposed level <str<strong>on</strong>g>of</str<strong>on</strong>g> visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r parking fails <str<strong>on</strong>g>to</str<strong>on</strong>g> comply with the requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> LEP194.<br />

Eleven spaces are required, whereas ten have <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided. No SEPP1 objecti<strong>on</strong> has <str<strong>on</strong>g>be</str<strong>on</strong>g>en<br />

submitted. (Refer: LEP194, Secti<strong>on</strong> 25J(2)(b)‘<strong>on</strong>e space is provided for every 4 dwellings or<br />

part there<str<strong>on</strong>g>of</str<strong>on</strong>g>’).<br />

Inadequ<strong>at</strong>e inform<strong>at</strong>i<strong>on</strong>/plan inc<strong>on</strong>sistencies<br />

The C<strong>on</strong>cept S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er Drainage & On-site Retenti<strong>on</strong> Details Plan submitted with the<br />

applic<strong>at</strong>i<strong>on</strong> shows a 1.5m wide drainage easement through the adjoining property <str<strong>on</strong>g>to</str<strong>on</strong>g> discharge<br />

in<str<strong>on</strong>g>to</str<strong>on</strong>g> the existing n<strong>at</strong>ural overland flow p<strong>at</strong>h. This area <str<strong>on</strong>g>of</str<strong>on</strong>g> the adjoining site has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en<br />

surveyed and the loc<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> existing trees and veget<strong>at</strong>i<strong>on</strong> has not accur<strong>at</strong>ely <str<strong>on</strong>g>be</str<strong>on</strong>g>en undertaken.<br />

Further inform<strong>at</strong>i<strong>on</strong> is necessary <str<strong>on</strong>g>to</str<strong>on</strong>g> determine the potential adverse impacts <strong>on</strong> existing trees<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the drainage easement.<br />

x. The submitted arborist’s report is uns<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry as it does not provide sufficient detail <str<strong>on</strong>g>to</str<strong>on</strong>g> fully<br />

assess and loc<strong>at</strong>e the existing trees <strong>on</strong> site and the impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> the associ<strong>at</strong>ed works. A revised<br />

arborist’s report is required (further details are provided within the St<strong>at</strong>ement <str<strong>on</strong>g>of</str<strong>on</strong>g> Basic Facts).<br />

C<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> downstream property owners (1456a and 1454 Pacific Highway ) <str<strong>on</strong>g>to</str<strong>on</strong>g> grant an<br />

interallotment drainage easement has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided, as required by Ku-ring-gai W<strong>at</strong>er<br />

Management Development C<strong>on</strong>trol Plan 47.<br />

The C<strong>on</strong>structi<strong>on</strong> Management Plan has not indic<strong>at</strong>ed the Loc<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Works Z<strong>on</strong>e, <strong>on</strong> site<br />

parking for employees and tradesmen (if available), c<strong>on</strong>structi<strong>on</strong> vehicle routes <str<strong>on</strong>g>to</str<strong>on</strong>g> and from<br />

the west and correct hours <str<strong>on</strong>g>of</str<strong>on</strong>g> work.<br />

xiii. The s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er management plan has not provided the level <str<strong>on</strong>g>of</str<strong>on</strong>g> detail required within<br />

Appendix 13 <str<strong>on</strong>g>of</str<strong>on</strong>g> Council’s DCP 47 W<strong>at</strong>er Management, including: separ<strong>at</strong>e s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

rainw<strong>at</strong>er and s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er, w<strong>at</strong>er quality measures, c<strong>on</strong>cept design for the proposed<br />

interallotment drainage through 1456a and 1454 Pacific Highway, pipes laid outside deep soil<br />

z<strong>on</strong>e, w<strong>at</strong>er balance <str<strong>on</strong>g>to</str<strong>on</strong>g> dem<strong>on</strong>str<strong>at</strong>e <strong>at</strong>tenu<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> discharge, or the provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an <strong>on</strong> site<br />

detenti<strong>on</strong> comp<strong>on</strong>ent.<br />

xiv. The plans are insufficient <str<strong>on</strong>g>to</str<strong>on</strong>g> ascertain levels <str<strong>on</strong>g>of</str<strong>on</strong>g> the floors from n<strong>at</strong>ural ground level. Levels<br />

from n<strong>at</strong>ural ground level are not provided in secti<strong>on</strong>s <strong>at</strong> critical points over the building.<br />

Particulars:<br />

a. The point <str<strong>on</strong>g>of</str<strong>on</strong>g> the northern-most lift the levels from the survey as compared <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

elev<strong>at</strong>i<strong>on</strong>s would suggest a level <str<strong>on</strong>g>of</str<strong>on</strong>g> gre<strong>at</strong>er than 1.2 metres for basement 1. This results<br />

in a c<strong>on</strong>sequent seventh floor (depicted as ‘ro<str<strong>on</strong>g>of</str<strong>on</strong>g> level’), for which a SEPP1 objecti<strong>on</strong><br />

would need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> provided. An elev<strong>at</strong>i<strong>on</strong> through this critical point needs <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

provided <str<strong>on</strong>g>to</str<strong>on</strong>g> clarify this n<strong>on</strong>-compliance.<br />
