The Deep Soil Z<strong>on</strong>e provisi<strong>on</strong> is 48.2%, r<strong>at</strong>her than the 50.6% as suggested within the<br />

applic<strong>at</strong>i<strong>on</strong>. A SEPP1 is required for this departure from the standard. (Refer LEP194 Secti<strong>on</strong><br />

25I(2)(c)) (N.B. Further details c<strong>on</strong>tained within the St<strong>at</strong>ement <str<strong>on</strong>g>of</str<strong>on</strong>g> Basic Facts. This can<br />

likely <str<strong>on</strong>g>be</str<strong>on</strong>g> resolved by increasing the setbacks <str<strong>on</strong>g>of</str<strong>on</strong>g>f the site boundaries for the pool and retaining<br />

walls <str<strong>on</strong>g>to</str<strong>on</strong>g> a minimum 2.0m <str<strong>on</strong>g>to</str<strong>on</strong>g> comply with LEP194).<br />

Tree #1/54 Nyssa sylv<strong>at</strong>ica (Tupelo) loc<strong>at</strong>ed adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> the eastern site boundary and<br />

adjoining heritage listed property is not shown <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> retained. The tree provides amenity <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the site and the adjoining property. As the tree is outside <str<strong>on</strong>g>of</str<strong>on</strong>g> development works, it is required<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> retained. This will require some alter<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed landscape works/turf area.<br />

The proposed swimming pool, loc<strong>at</strong>ed in the south-east corner <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, has a setback <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

approxim<strong>at</strong>ely 1.4m <str<strong>on</strong>g>to</str<strong>on</strong>g> the w<strong>at</strong>er line. To maximise landscape amenity and deep soil<br />

landscaping, the pool should have a minimum 2.0m setback from site boundaries <str<strong>on</strong>g>to</str<strong>on</strong>g> the outer<br />

coping edge.<br />

Residential amenity<br />

v. The proposed development fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide for adequ<strong>at</strong>e visual privacy, internal amenity and<br />

outdoor open space in accordance with the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP55.<br />

Particulars<br />

a. The applic<strong>at</strong>i<strong>on</strong> provides instances where the privacy <str<strong>on</strong>g>of</str<strong>on</strong>g> future residents is not assured.<br />

In particular, the pedestrian ramps will have neg<strong>at</strong>ive impact <strong>on</strong> those dwellings<br />

immedi<strong>at</strong>ely <str<strong>on</strong>g>to</str<strong>on</strong>g> the fr<strong>on</strong>t <str<strong>on</strong>g>of</str<strong>on</strong>g> the ramp. Specifically, there are c<strong>on</strong>cerns with respect <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the northern pedestrian ramp and views in<str<strong>on</strong>g>to</str<strong>on</strong>g> Unit B11 <strong>at</strong> RL177.00, and from the central<br />

pedestrian ramp in<str<strong>on</strong>g>to</str<strong>on</strong>g> Units C21 and C22 <strong>at</strong> RL174.00 (Refer: DCP55, Part 4.5).<br />

b. The applic<strong>at</strong>i<strong>on</strong> provides several instances where the internal corridor layout width, and<br />

the width <strong>at</strong> lift lobbies, is narrow. This provides for limited manoeuvring space for<br />

furniture removals (Refer: DCP55, Part 4.5, C<strong>on</strong>trol C-5).<br />

c. The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide open space with dimensi<strong>on</strong>s in accordance with DCP55.<br />

In particular, units C11, C21, D11, D21 and D31 are undersized or have minimal<br />

widths (Refer: DCP55, Part 4.5, C<strong>on</strong>trols C-1, C-2, C-4).<br />

Site access<br />

vi.<br />

The raised pedestrian entry ramps are <str<strong>on</strong>g>of</str<strong>on</strong>g> minimum width with no landing. This will prevent<br />

pedestrian access al<strong>on</strong>g the fr<strong>on</strong>tage <str<strong>on</strong>g>of</str<strong>on</strong>g> this site, particularly if a vehicle is parked <strong>on</strong> Finlay<br />

Road.<br />

Energy efficiency<br />

vii.<br />

The proposal fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide for an adequ<strong>at</strong>e N<strong>at</strong>HERS energy efficiency r<strong>at</strong>ing in accordance<br />

with the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP55. Only 57% <str<strong>on</strong>g>of</str<strong>on</strong>g> the units have achieved a 4.5 star r<strong>at</strong>ing, where it<br />

is anticip<strong>at</strong>ed th<strong>at</strong> <strong>at</strong> least 90% <str<strong>on</strong>g>of</str<strong>on</strong>g> the units should achieve a 4.5 star r<strong>at</strong>ing (Refer: DCP55,<br />

Part 4.8.1, C-4).<br />
