overland flow <str<strong>on</strong>g>of</str<strong>on</strong>g> the property will n<strong>at</strong>urally <str<strong>on</strong>g>be</str<strong>on</strong>g> affected through the cut required for the basement<br />

parking levels.<br />

2. The existing tree canopy and remnant veget<strong>at</strong>i<strong>on</strong> <strong>on</strong> the site (Figure 2 & 3) will <str<strong>on</strong>g>be</str<strong>on</strong>g> protected<br />

by:<br />

(a) Loc<strong>at</strong>ing new buildings within the areas currently occupied by the footprints <str<strong>on</strong>g>of</str<strong>on</strong>g> existing<br />

dwellings and other large structures such as pools and tennis courts;<br />

(b) Loc<strong>at</strong>ing buildings outside the drip-line <str<strong>on</strong>g>of</str<strong>on</strong>g> trees in the central area <str<strong>on</strong>g>of</str<strong>on</strong>g> the site;<br />

(c) Protecting the veget<strong>at</strong>i<strong>on</strong> <strong>on</strong> the steep lower slopes;<br />

(d) Planting canopy trees <str<strong>on</strong>g>to</str<strong>on</strong>g> the Pacific Highway fr<strong>on</strong>tage.<br />

The proposed building is sited within the already developed area <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, in accordance with<br />

Figures 2 and 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Code. However, the placement <str<strong>on</strong>g>of</str<strong>on</strong>g> the building in this area will still result in<br />

the loss <str<strong>on</strong>g>of</str<strong>on</strong>g> trees <strong>at</strong> the southern end <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, due <str<strong>on</strong>g>to</str<strong>on</strong>g> the change in soakage and w<strong>at</strong>er levels<br />

brought about by c<strong>on</strong>structi<strong>on</strong>. These southern trees have also <str<strong>on</strong>g>be</str<strong>on</strong>g>en subject <str<strong>on</strong>g>to</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm damage in the<br />

past and are not ideal specimens.<br />

3. Regi<strong>on</strong>al public views <str<strong>on</strong>g>to</str<strong>on</strong>g> the south from the Pacific Highway will <str<strong>on</strong>g>be</str<strong>on</strong>g> protected by:<br />

(a) Providing a 10m wide view corridor through the site <str<strong>on</strong>g>be</str<strong>on</strong>g>tween Finlay Road and Lam<strong>on</strong>d<br />

Drive; and<br />

(b) Providing a 10m wide view corridor through the site <str<strong>on</strong>g>be</str<strong>on</strong>g>tween Lam<strong>on</strong>d Drive and Duff<br />

Street.<br />

The extensive width <str<strong>on</strong>g>of</str<strong>on</strong>g> the fr<strong>on</strong>t elev<strong>at</strong>i<strong>on</strong> does not allow for a view through <str<strong>on</strong>g>to</str<strong>on</strong>g> the adjoining sites in<br />

accordance with this requirement.<br />

4. The significance <str<strong>on</strong>g>of</str<strong>on</strong>g> the two heritage buildings <strong>on</strong> the site will <str<strong>on</strong>g>be</str<strong>on</strong>g> protected by:<br />

(a) Providing a minimum curtilage <str<strong>on</strong>g>of</str<strong>on</strong>g> 10 metres around each heritage building;<br />

(b) Siting new development so th<strong>at</strong> no part <str<strong>on</strong>g>of</str<strong>on</strong>g> the heritage item is obstructed from the<br />

adjoining street or streets;<br />

(c) Siting new development so th<strong>at</strong> it forms a subtle backdrop <str<strong>on</strong>g>to</str<strong>on</strong>g> the heritage item and is<br />

partially screened by veget<strong>at</strong>i<strong>on</strong>.<br />

As noted above, the heritage item <strong>at</strong> 1458 Pacific Highway has <str<strong>on</strong>g>be</str<strong>on</strong>g>en protected through the side<br />

setback provided <str<strong>on</strong>g>to</str<strong>on</strong>g> this part <str<strong>on</strong>g>of</str<strong>on</strong>g> the site. Nine metres has <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided <str<strong>on</strong>g>to</str<strong>on</strong>g> the northern boundary.<br />

This will result in a setback (as measured <str<strong>on</strong>g>be</str<strong>on</strong>g>tween buildings) <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>at</strong> least 25 metres. No part <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

heritage building will <str<strong>on</strong>g>be</str<strong>on</strong>g> obstructed from the street. With respect <str<strong>on</strong>g>to</str<strong>on</strong>g> the requirement <str<strong>on</strong>g>to</str<strong>on</strong>g> form a<br />

subtle backdrop <str<strong>on</strong>g>to</str<strong>on</strong>g> the heritage building, the side setback will enable some screening <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

established, however, the buildings will <str<strong>on</strong>g>be</str<strong>on</strong>g> evident when looking south from the heritage site.<br />

5. Pedestrian access <str<strong>on</strong>g>to</str<strong>on</strong>g> Turramurra rail st<strong>at</strong>i<strong>on</strong> will <str<strong>on</strong>g>be</str<strong>on</strong>g> enhanced by:<br />

(a) Providing a new public access way through the sites <str<strong>on</strong>g>be</str<strong>on</strong>g>tween Duff Street and Lam<strong>on</strong>d<br />

Street and <str<strong>on</strong>g>be</str<strong>on</strong>g>tween Finlay Road and Lam<strong>on</strong>d Drive.<br />

Pedestrian access has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided in accordance with this requirement.<br />
