overland flow <strong>of</strong> the property will naturally <strong>be</strong> affected through the cut required for the basement
parking levels.
2. The existing tree canopy and remnant vegetation on the site (Figure 2 & 3) will <strong>be</strong> protected
by:
(a) Locating new buildings within the areas currently occupied by the footprints <strong>of</strong> existing
dwellings and other large structures such as pools and tennis courts;
(b) Locating buildings outside the drip-line <strong>of</strong> trees in the central area <strong>of</strong> the site;
(c) Protecting the vegetation on the steep lower slopes;
(d) Planting canopy trees <strong>to</strong> the Pacific Highway frontage.
The proposed building is sited within the already developed area <strong>of</strong> the site, in accordance with
Figures 2 and 3 <strong>of</strong> the Code. However, the placement <strong>of</strong> the building in this area will still result in
the loss <strong>of</strong> trees at the southern end <strong>of</strong> the site, due <strong>to</strong> the change in soakage and water levels
brought about by construction. These southern trees have also <strong>be</strong>en subject <strong>to</strong> s<strong>to</strong>rm damage in the
past and are not ideal specimens.
3. Regional public views <strong>to</strong> the south from the Pacific Highway will <strong>be</strong> protected by:
(a) Providing a 10m wide view corridor through the site <strong>be</strong>tween Finlay Road and Lamond
Drive; and
(b) Providing a 10m wide view corridor through the site <strong>be</strong>tween Lamond Drive and Duff
Street.
The extensive width <strong>of</strong> the front elevation does not allow for a view through <strong>to</strong> the adjoining sites in
accordance with this requirement.
4. The significance <strong>of</strong> the two heritage buildings on the site will <strong>be</strong> protected by:
(a) Providing a minimum curtilage <strong>of</strong> 10 metres around each heritage building;
(b) Siting new development so that no part <strong>of</strong> the heritage item is obstructed from the
adjoining street or streets;
(c) Siting new development so that it forms a subtle backdrop <strong>to</strong> the heritage item and is
partially screened by vegetation.

As noted above, the heritage item at 1458 Pacific Highway has <strong>be</strong>en protected through the side
setback provided <strong>to</strong> this part <strong>of</strong> the site. Nine metres has <strong>be</strong>en provided <strong>to</strong> the northern boundary.
This will result in a setback (as measured <strong>be</strong>tween buildings) <strong>of</strong> at least 25 metres. No part <strong>of</strong> the
heritage building will <strong>be</strong> obstructed from the street. With respect <strong>to</strong> the requirement <strong>to</strong> form a
subtle backdrop <strong>to</strong> the heritage building, the side setback will enable some screening <strong>to</strong> <strong>be</strong>
established, however, the buildings will <strong>be</strong> evident when looking south from the heritage site.
5. Pedestrian access <strong>to</strong> Turramurra rail station will <strong>be</strong> enhanced by:
(a) Providing a new public access way through the sites <strong>be</strong>tween Duff Street and Lamond
Street and <strong>be</strong>tween Finlay Road and Lamond Drive.
Pedestrian access has not <strong>be</strong>en provided in accordance with this requirement.
