Part 4.7 Social dimensi<strong>on</strong>s:<br />

The applic<strong>at</strong>i<strong>on</strong> provides for a range <str<strong>on</strong>g>of</str<strong>on</strong>g> dwelling sizes, c<strong>on</strong>sisting <str<strong>on</strong>g>of</str<strong>on</strong>g> 4 x 1 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom apartments, 22 x<br />

2 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom apartments and 16 x 3 <str<strong>on</strong>g>be</str<strong>on</strong>g>droom apartments.<br />

The development provides a suitable variety <str<strong>on</strong>g>of</str<strong>on</strong>g> unit sizes <str<strong>on</strong>g>to</str<strong>on</strong>g> meet market demand for a range <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

medium density accommod<strong>at</strong>i<strong>on</strong> needs.<br />

Part 4.8 Resource, energy and w<strong>at</strong>er efficiency:<br />

DCP55 requires th<strong>at</strong> 90% <str<strong>on</strong>g>of</str<strong>on</strong>g> units meet the N<strong>at</strong>HERS r<strong>at</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> 4.5 stars and above. The applic<strong>at</strong>i<strong>on</strong><br />

proposes 100% <str<strong>on</strong>g>of</str<strong>on</strong>g> units which meet with the 3.5 star N<strong>at</strong>HERS r<strong>at</strong>ing but <strong>on</strong>ly 57% <str<strong>on</strong>g>of</str<strong>on</strong>g> units which<br />

comply with the N<strong>at</strong>HERS 4.5 star r<strong>at</strong>ing (see recommended reas<strong>on</strong> for refusal No.(v)).<br />

Part 5.0 Parking and vehicular access:<br />

The applic<strong>at</strong>i<strong>on</strong> provides 10 visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r parking spaces, whereas 11 are required. This is likely an error<br />

<strong>on</strong> the plans and can <str<strong>on</strong>g>be</str<strong>on</strong>g> clarified easily. However, <strong>at</strong> present a SEPP1 is required for such a<br />

departure from LEP194 which has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en submitted (see recommended reas<strong>on</strong> for refusal<br />

No.(viii)).<br />

Of further note is th<strong>at</strong> the applic<strong>at</strong>i<strong>on</strong> provides for two pedestrian ramps (central and southern)<br />

which extend entirely up <str<strong>on</strong>g>to</str<strong>on</strong>g> Finlay Road. This will not allow for pedestrian movement al<strong>on</strong>g the<br />

fr<strong>on</strong>t <str<strong>on</strong>g>of</str<strong>on</strong>g> the property now or <strong>at</strong> any time in future and also will not allow for pedestrians <str<strong>on</strong>g>to</str<strong>on</strong>g> exit the<br />

site when a vehicle is parked <strong>at</strong> the end <str<strong>on</strong>g>of</str<strong>on</strong>g> these ramps. The pedestrian entrances do not allow for<br />

ease <str<strong>on</strong>g>of</str<strong>on</strong>g> movement and are therefore uns<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry (see recommended reas<strong>on</strong> for refusal No.(vi)).<br />

Development C<strong>on</strong>trol Code - Finlay Road, Lam<strong>on</strong>d Drive and Duff Street Turramurra<br />

– Design Principles.<br />

The purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> the Code (adopted 5 April <strong>2005</strong>) is <str<strong>on</strong>g>to</str<strong>on</strong>g> provide design principles <str<strong>on</strong>g>to</str<strong>on</strong>g> guide the future<br />

development <str<strong>on</strong>g>of</str<strong>on</strong>g> land in the vicinity <str<strong>on</strong>g>of</str<strong>on</strong>g> Finlay Road, Lam<strong>on</strong>d Drive and Duff Street, Turramurra for<br />

the purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> residential fl<strong>at</strong> buildings.<br />

The design principles c<strong>on</strong>tained in this code are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>sidered in the assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> any<br />

applic<strong>at</strong>i<strong>on</strong> for a residential fl<strong>at</strong> building <strong>on</strong> land covered by this Code in accordance with clause<br />

33(d) <str<strong>on</strong>g>of</str<strong>on</strong>g> the Ku-ring-gai Planning Scheme Ordinance 1971 (as amended).<br />

1. New development will resp<strong>on</strong>d <str<strong>on</strong>g>to</str<strong>on</strong>g> the site <str<strong>on</strong>g>to</str<strong>on</strong>g>pography (Figure 1) by:<br />

(a) Loc<strong>at</strong>ing new buildings within existing terraced areas formed by existing pools;<br />

(b) Avoiding the steep lower (southern) slopes <str<strong>on</strong>g>of</str<strong>on</strong>g> the site (refer site analysis);<br />

(c) Allow for n<strong>at</strong>ural overland flow so as <str<strong>on</strong>g>to</str<strong>on</strong>g> minimise changes <str<strong>on</strong>g>to</str<strong>on</strong>g> the site hydrology; and<br />

(d) New buildings <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> loc<strong>at</strong>ed <str<strong>on</strong>g>to</str<strong>on</strong>g> align with the <str<strong>on</strong>g>to</str<strong>on</strong>g>pography (perpendicular <str<strong>on</strong>g>to</str<strong>on</strong>g>, or parallel<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g>, the c<strong>on</strong><str<strong>on</strong>g>to</str<strong>on</strong>g>urs).<br />

The building will encompass the three existing dwellings already <strong>on</strong> site, furthermore, the building<br />

is loc<strong>at</strong>ed 9 metres <str<strong>on</strong>g>of</str<strong>on</strong>g>f the steep southern porti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, in accordance with 1(b). The n<strong>at</strong>ural<br />
