The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide <strong>on</strong>e area <str<strong>on</strong>g>of</str<strong>on</strong>g> deep soil landscaping as required by C-1, and fails <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

provide accur<strong>at</strong>e details <str<strong>on</strong>g>of</str<strong>on</strong>g> tree replenishment in order <str<strong>on</strong>g>to</str<strong>on</strong>g> meet with C-8 <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP55. Without this<br />

level <str<strong>on</strong>g>of</str<strong>on</strong>g> inform<strong>at</strong>i<strong>on</strong> it is questi<strong>on</strong>able as <str<strong>on</strong>g>to</str<strong>on</strong>g> whether adequ<strong>at</strong>e tall canopy trees can <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

accommod<strong>at</strong>ed <strong>on</strong> site.<br />

Further, the inform<strong>at</strong>i<strong>on</strong> submitted does not provide sufficient detail <str<strong>on</strong>g>to</str<strong>on</strong>g> fully assess and loc<strong>at</strong>e the<br />

existing trees <strong>on</strong> site. These are necessary <str<strong>on</strong>g>to</str<strong>on</strong>g> properly assess the c<strong>on</strong>sequential impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

proposed works (see recommended reas<strong>on</strong> for refusal No.(x)).<br />

Part 4.3 Setbacks:<br />

The applic<strong>at</strong>i<strong>on</strong> provides for sufficient side setbacks but fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide for adequ<strong>at</strong>e fr<strong>on</strong>t and rear<br />

setbacks.<br />

A minimum distance <str<strong>on</strong>g>of</str<strong>on</strong>g> 9.0 metres has <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided as a setback from Finlay Road, with the<br />

basement parking extending the entire width <str<strong>on</strong>g>of</str<strong>on</strong>g> the building (60 metres) <strong>at</strong> 9.6 metres from the fr<strong>on</strong>t<br />

boundary. This will not provide for an adequ<strong>at</strong>e fr<strong>on</strong>t setback as envisaged within either LEP194 or<br />

DCP55 and will not <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>ducive <str<strong>on</strong>g>to</str<strong>on</strong>g> the establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> a tall tree canopy.<br />

The applic<strong>at</strong>i<strong>on</strong> also proposes <str<strong>on</strong>g>to</str<strong>on</strong>g> site priv<strong>at</strong>e courtyards within the fr<strong>on</strong>t setback, <strong>at</strong> a minimum<br />

distance <str<strong>on</strong>g>of</str<strong>on</strong>g> 3.6 metres from the fr<strong>on</strong>t boundary. DCP55 requires, through C<strong>on</strong>trols C-7 and C-8 <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Secti<strong>on</strong> 4.3, courtyards <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> set back 8 metres from the fr<strong>on</strong>t boundary, and th<strong>at</strong> the setback<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>tween 8 and 10 metres is limited <str<strong>on</strong>g>to</str<strong>on</strong>g> 15% courtyard. The applic<strong>at</strong>i<strong>on</strong> provides for courtyards well<br />

in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> the 8 metres line. The courtyards will preclude the establishment and maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

canopy trees which will result in adverse impact up<strong>on</strong> the streetscape <str<strong>on</strong>g>of</str<strong>on</strong>g> Finlay Road (see<br />

recommended reas<strong>on</strong> for refusal No.(i)).<br />

The applic<strong>at</strong>i<strong>on</strong> proposes a rear setback <str<strong>on</strong>g>of</str<strong>on</strong>g> 3.6 metres. This occurs <strong>at</strong> basement level for a length <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

28 metres – half <str<strong>on</strong>g>of</str<strong>on</strong>g> the building infringes <str<strong>on</strong>g>to</str<strong>on</strong>g> the rear. Above ground, balc<strong>on</strong>ies project <str<strong>on</strong>g>to</str<strong>on</strong>g> within 4.7<br />

metres <str<strong>on</strong>g>of</str<strong>on</strong>g> the rear boundary.<br />

The purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> the rear setback c<strong>on</strong>trol is <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure adequ<strong>at</strong>e planting <str<strong>on</strong>g>to</str<strong>on</strong>g> reduce visual bulk impacts,<br />

and ensure th<strong>at</strong> the amenity <str<strong>on</strong>g>of</str<strong>on</strong>g> neighbouring development will not <str<strong>on</strong>g>be</str<strong>on</strong>g> unreas<strong>on</strong>ably affected. The<br />

loc<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the basement parking, particularly five levels <str<strong>on</strong>g>of</str<strong>on</strong>g> basement parking and for such a length<br />

will not allow for adequ<strong>at</strong>e planting. This is particularly significant given the proposed adjacent<br />

development, which is also provided with limited side setbacks. These c<strong>on</strong>cerns have also <str<strong>on</strong>g>be</str<strong>on</strong>g>en reiter<strong>at</strong>ed<br />

by Council’s Landscape Officer.<br />

The limited rear balc<strong>on</strong>y setbacks raise further c<strong>on</strong>cern with respect <str<strong>on</strong>g>to</str<strong>on</strong>g> the privacy and amenity <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

future adjoining occupants. Additi<strong>on</strong>ally, the balc<strong>on</strong>ies protrude further than the recommended 1.2<br />

metres and will thus <str<strong>on</strong>g>be</str<strong>on</strong>g> visually obvious and obtrusive <str<strong>on</strong>g>to</str<strong>on</strong>g> the property adjoining <str<strong>on</strong>g>to</str<strong>on</strong>g> the rear (see<br />

recommended reas<strong>on</strong> for refusal No.(i)).<br />

Part 4.4 Built form and articul<strong>at</strong>i<strong>on</strong>:<br />

The development provides for two wall plane areas which are in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> 81m 2 – these are <strong>at</strong> the<br />

sides <str<strong>on</strong>g>of</str<strong>on</strong>g> the building (North-East and South-West). The elev<strong>at</strong>i<strong>on</strong>s show a broken wall with<br />
