Part 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP 55 requires c<strong>on</strong>sider<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing and desired future character <str<strong>on</strong>g>of</str<strong>on</strong>g> the area in<br />

which the site is loc<strong>at</strong>ed, the maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> Ku-ring-gai’s landscape and visual character and<br />

c<strong>on</strong>sider<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> relevant c<strong>on</strong>serv<strong>at</strong>i<strong>on</strong> areas and heritage buildings.<br />

One <str<strong>on</strong>g>of</str<strong>on</strong>g> the most important desired visi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP55 is <str<strong>on</strong>g>to</str<strong>on</strong>g> accommod<strong>at</strong>e additi<strong>on</strong>al housing whilst <strong>at</strong><br />

the same time achieving a landscaped setting. A tall tree canopy should <str<strong>on</strong>g>be</str<strong>on</strong>g> the dominant<br />

impressi<strong>on</strong>. This is also str<strong>on</strong>gly reinforced throughout LEP194.<br />

This visi<strong>on</strong> is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> achieved through the retenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> existing significant trees, and the planting <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

additi<strong>on</strong>al trees <str<strong>on</strong>g>to</str<strong>on</strong>g> reach a minimum height <str<strong>on</strong>g>of</str<strong>on</strong>g> 13 metres within a generous fr<strong>on</strong>t setback.<br />

The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide a large fr<strong>on</strong>t setback. Nine metres instead <str<strong>on</strong>g>of</str<strong>on</strong>g> the prescri<str<strong>on</strong>g>be</str<strong>on</strong>g>d 12<br />

metres has <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided as the setback from Finlay Road. Further, the quality <str<strong>on</strong>g>of</str<strong>on</strong>g> the fr<strong>on</strong>t setback<br />

has <str<strong>on</strong>g>be</str<strong>on</strong>g>en jeopardized through the placement <str<strong>on</strong>g>of</str<strong>on</strong>g> priv<strong>at</strong>e courtyards within this space. This will not<br />

provide for canopy trees envisaged by LEP194. The impact <str<strong>on</strong>g>of</str<strong>on</strong>g> this lack <str<strong>on</strong>g>of</str<strong>on</strong>g> veget<strong>at</strong>i<strong>on</strong> will <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

further exacerb<strong>at</strong>ed by the length <str<strong>on</strong>g>of</str<strong>on</strong>g> the building, <strong>at</strong> 60 metres in length <str<strong>on</strong>g>be</str<strong>on</strong>g>ing almost double the<br />

maximum <str<strong>on</strong>g>of</str<strong>on</strong>g> 36 metres, which will provide for little visual relief from Finlay Road.<br />

Due <str<strong>on</strong>g>to</str<strong>on</strong>g> the failure <str<strong>on</strong>g>to</str<strong>on</strong>g> provide for an adequ<strong>at</strong>e fr<strong>on</strong>t setback, the development does not appropri<strong>at</strong>ely<br />

resp<strong>on</strong>d <str<strong>on</strong>g>to</str<strong>on</strong>g> the desired future medium density character <str<strong>on</strong>g>of</str<strong>on</strong>g> the area (see recommended reas<strong>on</strong> for<br />

refusal No.(i)).<br />
