even if the exceedence <str<strong>on</strong>g>of</str<strong>on</strong>g> the development standard were <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> acceptable <strong>on</strong> merit (see<br />

recommended reas<strong>on</strong> for refusal No.(xiv)).<br />

Num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> car parking spaces (cl.25J):<br />

Only 10 visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r parking spaces have <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided. LEP194 requires the minimum provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> 11<br />

visi<str<strong>on</strong>g>to</str<strong>on</strong>g>r parking spaces.<br />

It is likely th<strong>at</strong> the above is an error and can <str<strong>on</strong>g>be</str<strong>on</strong>g> amended easily, however, <strong>at</strong> present Council<br />

requires a SEPP 1 justific<strong>at</strong>i<strong>on</strong> for such a departure and is not able <str<strong>on</strong>g>to</str<strong>on</strong>g> grant c<strong>on</strong>sent <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

development in its absence, even if this were <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> acceptable <strong>on</strong> merit (see recommended reas<strong>on</strong><br />

for refusal No.(viii)).<br />

Heritage /c<strong>on</strong>serv<strong>at</strong>i<strong>on</strong> areas (cl.61D – 61I):<br />

The site is loc<strong>at</strong>ed adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> a heritage listed residential dwelling <strong>at</strong> 1458 Pacific Highway. The<br />

applic<strong>at</strong>i<strong>on</strong> is accompanied by a heritage st<strong>at</strong>ement addressing the impact up<strong>on</strong> this listed building.<br />

Due <str<strong>on</strong>g>to</str<strong>on</strong>g> the separ<strong>at</strong>i<strong>on</strong> distance from this heritage item (<strong>at</strong> no point closer than 25 metres) and due <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the slope <str<strong>on</strong>g>of</str<strong>on</strong>g> the land away from the Pacific Highway, the development will not impact up<strong>on</strong> this<br />

item.<br />

The <strong>on</strong>ly m<strong>at</strong>ter for c<strong>on</strong>cern in this regard is the proposed m<strong>at</strong>erials <str<strong>on</strong>g>of</str<strong>on</strong>g> the development. As was<br />

noted by Council’s Urban Design C<strong>on</strong>sultant, the m<strong>at</strong>erials proposed for the development are stark<br />

by c<strong>on</strong>trast with the surrounding, darker, brick buildings. It is therefore recommended th<strong>at</strong>, should<br />

any c<strong>on</strong>sent <str<strong>on</strong>g>be</str<strong>on</strong>g> given, the m<strong>at</strong>erials <str<strong>on</strong>g>of</str<strong>on</strong>g> the building <str<strong>on</strong>g>be</str<strong>on</strong>g> changed <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> more in keeping with the area<br />

and c<strong>on</strong>trast less sharply.<br />

The applic<strong>at</strong>i<strong>on</strong> meets with the c<strong>on</strong>trols <str<strong>on</strong>g>of</str<strong>on</strong>g> 61 D – 61 I <str<strong>on</strong>g>of</str<strong>on</strong>g> the KPSO as amended by LEP194.<br />

Residential z<strong>on</strong>e objectives:<br />

The development fails <str<strong>on</strong>g>to</str<strong>on</strong>g> s<strong>at</strong>isfy the objectives for residential z<strong>on</strong>es as prescri<str<strong>on</strong>g>be</str<strong>on</strong>g>d in clause 25D. In<br />

particular, the following objectives have not <str<strong>on</strong>g>be</str<strong>on</strong>g>en met:<br />

(a) <str<strong>on</strong>g>to</str<strong>on</strong>g> provide rear setbacks th<strong>at</strong> ensure rear gardens are adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> rear gardens <str<strong>on</strong>g>of</str<strong>on</strong>g> other<br />

properties and th<strong>at</strong> sufficient ground area is available for tall tree planting, c<strong>on</strong>sistent with<br />

the objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> this Part;<br />

(b) <str<strong>on</strong>g>to</str<strong>on</strong>g> encourage the protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> existing trees within setback areas and <str<strong>on</strong>g>to</str<strong>on</strong>g> encourage the<br />

provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> sufficient viable deep soil landscaping and tall trees in rear and fr<strong>on</strong>t gardens<br />

where new development is carried out;<br />

The above objectives have not <str<strong>on</strong>g>be</str<strong>on</strong>g>en met due <str<strong>on</strong>g>to</str<strong>on</strong>g>:<br />

• The limited fr<strong>on</strong>t and rear setbacks, which will not provide for adequ<strong>at</strong>e tall tree canopies;<br />

• The insufficient amount <str<strong>on</strong>g>of</str<strong>on</strong>g> deep soil landscaping;<br />

• The use <str<strong>on</strong>g>of</str<strong>on</strong>g> the fr<strong>on</strong>t setback for courtyard areas; and<br />
