The applic<strong>at</strong>i<strong>on</strong> does not technically comply with the deep soil requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> 50%. This is due <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the inclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> areas including garden <str<strong>on</strong>g>be</str<strong>on</strong>g>ds, stairs and p<strong>at</strong>hs where they provide less than 2 metres<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> deep soil area or where the p<strong>at</strong>hs are over 1.0 metres wide. This area amounts <str<strong>on</strong>g>to</str<strong>on</strong>g> approxim<strong>at</strong>ely<br />

2.43% <str<strong>on</strong>g>of</str<strong>on</strong>g> the site area, which, when subtracted from the nomin<strong>at</strong>ed deep soil landscaping<br />

percentage, will result in 48.2% <str<strong>on</strong>g>of</str<strong>on</strong>g> the site <str<strong>on</strong>g>be</str<strong>on</strong>g>ing available for deep soil landscaping.<br />

The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> provide for compliant deep soil landscaping areas. A SEPP 1 objecti<strong>on</strong> is<br />

required but was not submitted. Without this Council is not able <str<strong>on</strong>g>to</str<strong>on</strong>g> grant approval <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

development, even if it were <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> acceptable. Given the str<strong>on</strong>g intent <str<strong>on</strong>g>of</str<strong>on</strong>g> the Deep Soil<br />

Landscaping requirement within both LEP194 and DCP55, serious c<strong>on</strong>sider<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this m<strong>at</strong>ter<br />

would <str<strong>on</strong>g>be</str<strong>on</strong>g> required (see recommended reas<strong>on</strong> for refusal No.(ii)).<br />

Num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys (cl.25K):<br />

Due <str<strong>on</strong>g>to</str<strong>on</strong>g> the steep slope <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, the development is subject <str<strong>on</strong>g>to</str<strong>on</strong>g> a steep slope c<strong>on</strong>cessi<strong>on</strong>, which<br />

provides for a maximum <str<strong>on</strong>g>of</str<strong>on</strong>g> 6 s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys without the need for a SEPP1 objecti<strong>on</strong>.<br />

It would appear, from the inform<strong>at</strong>i<strong>on</strong> provided, th<strong>at</strong> the development proposes in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> 6<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>reys in height. This is apparent <strong>at</strong> the point <str<strong>on</strong>g>be</str<strong>on</strong>g>ne<strong>at</strong>h the northern-most lift, where the basement<br />

would appear <str<strong>on</strong>g>to</str<strong>on</strong>g> exceed 1.2 metres in height and where a covered ro<str<strong>on</strong>g>of</str<strong>on</strong>g> area (counting as a separ<strong>at</strong>e<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey) has <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided.<br />

The plans therefore appear <str<strong>on</strong>g>to</str<strong>on</strong>g> propose n<strong>on</strong>-compliances for which a SEPP1 has again not <str<strong>on</strong>g>be</str<strong>on</strong>g>en<br />

provided. Without a SEPP1 justific<strong>at</strong>i<strong>on</strong> Council is not able <str<strong>on</strong>g>to</str<strong>on</strong>g> grant c<strong>on</strong>sent <str<strong>on</strong>g>to</str<strong>on</strong>g> the development<br />
