Given the c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> these trees, should the development applic<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g> approved, it is<br />
recommended th<strong>at</strong> it <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>ed th<strong>at</strong> an aerial inspecti<strong>on</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g> undertaken <str<strong>on</strong>g>to</str<strong>on</strong>g> report <strong>on</strong><br />
the health and stability <str<strong>on</strong>g>of</str<strong>on</strong>g> these trees with particular reference <str<strong>on</strong>g>to</str<strong>on</strong>g> any decay in the trunk<br />
as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> previous s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm damage. Any recommended works from this report would<br />
<str<strong>on</strong>g>be</str<strong>on</strong>g> subject <str<strong>on</strong>g>to</str<strong>on</strong>g> approval by Council and should <str<strong>on</strong>g>be</str<strong>on</strong>g> undertaken <strong>at</strong> the developer's expense.<br />
STATUTORY PROVISIONS<br />
St<strong>at</strong>e Envir<strong>on</strong>mental Planning Policy No. 65 – Design quality <str<strong>on</strong>g>of</str<strong>on</strong>g> residential fl<strong>at</strong><br />
development<br />
The applic<strong>at</strong>i<strong>on</strong> includes a design verific<strong>at</strong>i<strong>on</strong> st<strong>at</strong>ement by the project architect John Ferres <str<strong>on</strong>g>of</str<strong>on</strong>g> Scott<br />
Carver. Mr Ferres has verified th<strong>at</strong> he is a qualified designer and mem<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> the NSW Architects<br />
Registr<strong>at</strong>i<strong>on</strong> Board and has designed the proposal in accordance with the design quality principles<br />
set out in Part 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> SEPP65.<br />
The applic<strong>at</strong>i<strong>on</strong> has <str<strong>on</strong>g>be</str<strong>on</strong>g>en assessed in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the Design Quality Principles set out in SEPP65. The<br />
design quality principles do not gener<strong>at</strong>e design soluti<strong>on</strong>s but provide a guide <str<strong>on</strong>g>to</str<strong>on</strong>g> achieving good<br />
design and the means <str<strong>on</strong>g>of</str<strong>on</strong>g> evalu<strong>at</strong>ing the merit <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposal. The assessment is summarised as<br />
follows:<br />
C<strong>on</strong>text:<br />
‘SEPP 65 : Good design resp<strong>on</strong>ds and c<strong>on</strong>tributes <str<strong>on</strong>g>to</str<strong>on</strong>g> its c<strong>on</strong>text…Resp<strong>on</strong>ding <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>text<br />
involves identifying the desirable elements <str<strong>on</strong>g>of</str<strong>on</strong>g> a loc<strong>at</strong>i<strong>on</strong>’s current character, or, in the<br />
case <str<strong>on</strong>g>of</str<strong>on</strong>g> precincts undergoing a transiti<strong>on</strong>, the desired future character as st<strong>at</strong>ed in<br />
planning and design policies.’<br />
The n<strong>at</strong>ural envir<strong>on</strong>ment forming a major part <str<strong>on</strong>g>of</str<strong>on</strong>g> the c<strong>on</strong>text for this development<br />
c<strong>on</strong>sists <str<strong>on</strong>g>of</str<strong>on</strong>g> extensive areas <str<strong>on</strong>g>of</str<strong>on</strong>g> high canopy trees, including blue gums, which cre<strong>at</strong>e a<br />
str<strong>on</strong>g sense <str<strong>on</strong>g>of</str<strong>on</strong>g> the n<strong>at</strong>ural envir<strong>on</strong>ment as a setting for the development.<br />
The built form in the existing c<strong>on</strong>text comprises a heritage item and detached houses.<br />
The heritage item is c<strong>on</strong>structed <str<strong>on</strong>g>of</str<strong>on</strong>g> brick and tim<str<strong>on</strong>g>be</str<strong>on</strong>g>r and the detached houses are<br />
predominantly brick and tim<str<strong>on</strong>g>be</str<strong>on</strong>g>r. These m<strong>at</strong>erials complement the n<strong>at</strong>ural wooded<br />
setting and cre<strong>at</strong>e an overall effect <str<strong>on</strong>g>of</str<strong>on</strong>g> harm<strong>on</strong>y <str<strong>on</strong>g>be</str<strong>on</strong>g>tween the n<strong>at</strong>ural and the built<br />
envir<strong>on</strong>ment. The heritage item <strong>on</strong> the corner <str<strong>on</strong>g>of</str<strong>on</strong>g> Pacific Highway is the closest item in<br />
the built c<strong>on</strong>text.<br />
The scale, bulk and architectural language <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed development does not m<strong>at</strong>ch<br />
th<strong>at</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the heritage item and this is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> expected due <str<strong>on</strong>g>to</str<strong>on</strong>g> the c<strong>on</strong>siderably gre<strong>at</strong>er scale<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> development proposed in LEP194. However, colours and m<strong>at</strong>erials could have some<br />
rel<strong>at</strong>i<strong>on</strong>ship <str<strong>on</strong>g>to</str<strong>on</strong>g> the built and n<strong>at</strong>ural envir<strong>on</strong>ment <str<strong>on</strong>g>to</str<strong>on</strong>g> complement r<strong>at</strong>her than c<strong>on</strong>trast<br />
with the c<strong>on</strong>text.<br />
