A dilapidation survey ong>ofong> the heritage item at 1458 Pacific Highway will also ong>beong> recommended. Groundwater was not noted in the boreholes due ong>toong> the use ong>ofong> water as a drilling fluid, nor were standpipes installed for subsequent measurements. If permanent drawdown effects ong>ofong> the proposed basement are ong>toong> ong>beong> assessed as required by Council’s Landscape Development Officer, then it will ong>beong> necessary for further investigation ong>toong> ong>beong> carried out. From an engineering point ong>ofong> view, this can ong>beong> done prior ong>toong> Construction Certificate issue, however if fully tanked basement construction is required ong>toong> maintain moisture levels ong>toong> the existing and new deep soil planting, then this should ong>beong> a condition ong>ofong> consent. The arborist and geotechnical engineer should advise jointly on the potential effects if required by Council’s Landscape Development Officer. Tree and vegetation service Council’s Manager Tree and Vegetation Services has commented on the proposal as follows: I refer ong>toong> your request for an inspection ong>ofong> three trees in located on Council's nature strip adjacent ong>toong> 3-5 Finlay Road Warrawee as part ong>ofong> the current Development Application. Tree 89: Eucalyptus saligna (Sydney Bluegum) This tree has ong>beong>en song>toong>rm damaged in the past and is infected with bracket fungus in a large trunk wound indicating significant internal decay. The entire weight ong>ofong> the tree is above this structural weakpoint and it is considered that the tree is in a potentially hazardous condition. It is noted that this tree is shown for removal as part ong>ofong> the application. Given the condition ong>ofong> this tree, there would ong>beong> no objection ong>toong> its removal and replacement, should the application ong>beong> approved, as a condition ong>ofong> development consent. This work should ong>beong> undertaken at the developer's expense with no cost ong>toong> Council. Tree 88 and un-numong>beong>red tree ong>beong>tween tree numong>beong>rs 86 and 78, both Eucalyptus saligna (Sydney Bluegum) These trees have both ong>beong>en severely song>toong>rm damaged in the past resulting in the loss ong>ofong> their main leader(s). This has resulted in the emergence ong>ofong> weakly attached epicormics as new leaders and also decay in the trunk at these points. Any recommended works from this report would ong>beong> subject ong>toong> approval by Council and should ong>beong> undertaken at the developer's expense. STATUTORY PROVISIONS State Environmental Planning Policy No. 65 – Design quality ong>ofong> residential flat development The application includes a design verification statement by the project architect John Ferres ong>ofong> Scott Carver. Mr Ferres has verified that he is a qualified designer and memong>beong>r ong>ofong> the NSW Architects Registration Board and has designed the proposal in accordance with the design quality principles set out in Part 2 ong>ofong> SEPP65. The application has ong>beong>en assessed in terms ong>ofong> the Design Quality Principles set out in SEPP65. The design quality principles do not generate design solutions but provide a guide ong>toong> achieving good design and the means ong>ofong> evaluating the merit ong>ofong> the proposal. The assessment is summarised as follows: Context: ‘SEPP 65 : Good design responds and contributes ong>toong> its context…Responding ong>toong> context involves identifying the desirable elements ong>ofong> a location’s current character, or, in the case ong>ofong> precincts undergoing a transition, the desired future character as stated in planning and design policies.’ The natural environment forming a major part ong>ofong> the context for this development consists ong>ofong> extensive areas ong>ofong> high canopy trees, including blue gums, which create a strong sense ong>ofong> the natural environment as a setting for the development. The built form in the existing context comprises a heritage item and detached houses. The heritage item is constructed ong>ofong> brick and timong>beong>r and the detached houses are predominantly brick and timong>beong>r. These materials complement the natural wooded setting and create an overall effect ong>ofong> harmony ong>beong>tween the natural and the built environment. The heritage item on the corner ong>ofong> Pacific Highway is the closest item in the built context. The scale, bulk and architectural language ong>ofong> the proposed development does not match that ong>ofong> the heritage item and this is ong>toong> ong>beong> expected due ong>toong> the considerably greater scale ong>ofong> development proposed in LEP194. However, colours and materials could have some relationship ong>toong> the built and natural environment ong>toong> complement rather than contrast with the context.
