Loss <str<strong>on</strong>g>of</str<strong>on</strong>g> privacy, and acoustic impact up<strong>on</strong> No. 4B Finlay Road, which adjoins the site <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

immedi<strong>at</strong>e south.<br />

This issue is addressed within the report.<br />

The noise from the c<strong>on</strong>structi<strong>on</strong> is <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>cern, particularly given nearby current development,<br />

which starts as early as 6am <str<strong>on</strong>g>to</str<strong>on</strong>g> as l<strong>at</strong>e as 11pm six <str<strong>on</strong>g>to</str<strong>on</strong>g> seven days per week. This is also <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

c<strong>on</strong>cern for the school children <str<strong>on</strong>g>of</str<strong>on</strong>g> Warrawee Public School.<br />

Should any approval <str<strong>on</strong>g>be</str<strong>on</strong>g> granted, a c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sent would ensure th<strong>at</strong> c<strong>on</strong>structi<strong>on</strong> takes place<br />

during standard reas<strong>on</strong>able hours.<br />

The solar access <str<strong>on</strong>g>to</str<strong>on</strong>g> No.4B Finlay Road would appear <str<strong>on</strong>g>to</str<strong>on</strong>g> comply. However, this is requested <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

checked.<br />

This has <str<strong>on</strong>g>be</str<strong>on</strong>g>en checked. The development will provide for s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry and compliant levels <str<strong>on</strong>g>of</str<strong>on</strong>g> solar<br />

access <str<strong>on</strong>g>to</str<strong>on</strong>g> 4B Finlay Road.<br />

The applic<strong>at</strong>i<strong>on</strong> fails <str<strong>on</strong>g>to</str<strong>on</strong>g> address the expected noise levels (both human and mechanical)<br />

gener<strong>at</strong>ed from this development and its effect <strong>on</strong> existing residents.<br />

Human noise is inevitable and, <str<strong>on</strong>g>to</str<strong>on</strong>g> a large extent, unc<strong>on</strong>trollable. Adequ<strong>at</strong>e setbacks <strong>on</strong> adjoining<br />

residential boundaries would ensure limited acoustic impact up<strong>on</strong> neighbours. There is some<br />

c<strong>on</strong>cern with respect <str<strong>on</strong>g>to</str<strong>on</strong>g> the rear boundary – and this is addressed within the report.<br />

If the applic<strong>at</strong>i<strong>on</strong> were <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> approved, mechanical noise (from airc<strong>on</strong>diti<strong>on</strong>ing devices and from the<br />

basement parking areas) would <str<strong>on</strong>g>be</str<strong>on</strong>g> able <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>ed <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure limited impact <strong>on</strong> adjoining<br />

neighbours.<br />

Flora and Fauna<br />

The development will wipe out many advanced growth trees, including significant bluegums and<br />

other flora which will have a significant impact <strong>on</strong> n<strong>at</strong>ural flora and fauna in the area.<br />

This issue is addressed within the report.<br />

The development site includes a n<strong>at</strong>ural w<strong>at</strong>ercourse, which travels through num<str<strong>on</strong>g>be</str<strong>on</strong>g>rs 4b and 8<br />

Finlay Road <str<strong>on</strong>g>to</str<strong>on</strong>g> join with other n<strong>at</strong>ural w<strong>at</strong>ercourse in No.12 Denman Street. The whole forms<br />

part <str<strong>on</strong>g>of</str<strong>on</strong>g> the w<strong>at</strong>er c<strong>at</strong>chment area for the Lane Cove River.<br />

This has <str<strong>on</strong>g>be</str<strong>on</strong>g>en identified by both Council’s Landscape Officer and Development Engineer as areas<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>cern. Both <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers have requested further inform<strong>at</strong>i<strong>on</strong> <strong>on</strong> this aspect. Given th<strong>at</strong> the<br />

inform<strong>at</strong>i<strong>on</strong> has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en provided, this has <str<strong>on</strong>g>be</str<strong>on</strong>g>en included am<strong>on</strong>g the reas<strong>on</strong>s for refusal.<br />

Traffic<br />

The c<strong>on</strong>structi<strong>on</strong> traffic, including c<strong>on</strong>structi<strong>on</strong> access and parking for c<strong>on</strong>structi<strong>on</strong> workers is<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>cern, particularly given the close proximity <str<strong>on</strong>g>of</str<strong>on</strong>g> the Warrawee Public School, and the use <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Finlay Road <str<strong>on</strong>g>to</str<strong>on</strong>g> drop-<str<strong>on</strong>g>of</str<strong>on</strong>g>f and pick-up schoolchildren.<br />

Council’s Development Engineer has c<strong>on</strong>sidered the applic<strong>at</strong>i<strong>on</strong> and has requested further<br />

inform<strong>at</strong>i<strong>on</strong> with respect <str<strong>on</strong>g>to</str<strong>on</strong>g> the C<strong>on</strong>structi<strong>on</strong> Management Plan (this is detailed <str<strong>on</strong>g>be</str<strong>on</strong>g>low). The failure<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> provide adequ<strong>at</strong>e inform<strong>at</strong>i<strong>on</strong> has <str<strong>on</strong>g>be</str<strong>on</strong>g>en included within the recommended reas<strong>on</strong>s for refusal.<br />
