Loss <strong>of</strong> privacy, and acoustic impact upon No. 4B Finlay Road, which adjoins the site <strong>to</strong> the
immediate south.
This issue is addressed within the report.
The noise from the construction is <strong>of</strong> concern, particularly given nearby current development,
which starts as early as 6am <strong>to</strong> as late as 11pm six <strong>to</strong> seven days per week. This is also <strong>of</strong>
concern for the school children <strong>of</strong> Warrawee Public School.
Should any approval <strong>be</strong> granted, a condition <strong>of</strong> consent would ensure that construction takes place
during standard reasonable hours.
The solar access <strong>to</strong> No.4B Finlay Road would appear <strong>to</strong> comply. However, this is requested <strong>to</strong> <strong>be</strong>
checked.
This has <strong>be</strong>en checked. The development will provide for satisfac<strong>to</strong>ry and compliant levels <strong>of</strong> solar
access <strong>to</strong> 4B Finlay Road.
The application fails <strong>to</strong> address the expected noise levels (both human and mechanical)
generated from this development and its effect on existing residents.
Human noise is inevitable and, <strong>to</strong> a large extent, uncontrollable. Adequate setbacks on adjoining
residential boundaries would ensure limited acoustic impact upon neighbours. There is some
concern with respect <strong>to</strong> the rear boundary – and this is addressed within the report.
If the application were <strong>to</strong> <strong>be</strong> approved, mechanical noise (from airconditioning devices and from the
basement parking areas) would <strong>be</strong> able <strong>to</strong> <strong>be</strong> conditioned <strong>to</strong> ensure limited impact on adjoining
neighbours.
Flora and Fauna
The development will wipe out many advanced growth trees, including significant bluegums and
other flora which will have a significant impact on natural flora and fauna in the area.
This issue is addressed within the report.
The development site includes a natural watercourse, which travels through num<strong>be</strong>rs 4b and 8
Finlay Road <strong>to</strong> join with other natural watercourse in No.12 Denman Street. The whole forms
part <strong>of</strong> the water catchment area for the Lane Cove River.
This has <strong>be</strong>en identified by both Council’s Landscape Officer and Development Engineer as areas
<strong>of</strong> concern. Both <strong>of</strong>ficers have requested further information on this aspect. Given that the
information has not <strong>be</strong>en provided, this has <strong>be</strong>en included among the reasons for refusal.
Traffic
The construction traffic, including construction access and parking for construction workers is
<strong>of</strong> concern, particularly given the close proximity <strong>of</strong> the Warrawee Public School, and the use <strong>of</strong>
Finlay Road <strong>to</strong> drop-<strong>of</strong>f and pick-up schoolchildren.
Council’s Development Engineer has considered the application and has requested further
information with respect <strong>to</strong> the Construction Management Plan (this is detailed <strong>be</strong>low). The failure
<strong>to</strong> provide adequate information has <strong>be</strong>en included within the recommended reasons for refusal.
