Bulk<br />

The building height and design is not comp<strong>at</strong>ible with the local c<strong>on</strong>text, and must <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>trolled <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

ensure the privacy and outlook for neighbouring residents.<br />

The height and bulk <str<strong>on</strong>g>of</str<strong>on</strong>g> the building will not <str<strong>on</strong>g>be</str<strong>on</strong>g> comp<strong>at</strong>ible with the existing local c<strong>on</strong>text - LEP194<br />

effectively provides for situ<strong>at</strong>i<strong>on</strong>s where unit blocks are placed next <str<strong>on</strong>g>to</str<strong>on</strong>g> single s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey residential<br />

dwellings. However, five s<str<strong>on</strong>g>to</str<strong>on</strong>g>rey apartment buildings are part <str<strong>on</strong>g>of</str<strong>on</strong>g> the future character <str<strong>on</strong>g>of</str<strong>on</strong>g> the area and<br />

a change in scale from the existing scale <str<strong>on</strong>g>of</str<strong>on</strong>g> development <str<strong>on</strong>g>to</str<strong>on</strong>g> the new apartment buildings is<br />

inevitable.<br />

The privacy and outlook for neighbouring residents has <str<strong>on</strong>g>be</str<strong>on</strong>g>en addressed. Refer <str<strong>on</strong>g>to</str<strong>on</strong>g> the discussi<strong>on</strong><br />

within the report.<br />

The FSR <str<strong>on</strong>g>of</str<strong>on</strong>g> the development has not <str<strong>on</strong>g>be</str<strong>on</strong>g>en addressed within the applicants’ St<strong>at</strong>ement <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Envir<strong>on</strong>mental Effects.<br />

The applic<strong>at</strong>i<strong>on</strong> was submitted prior <str<strong>on</strong>g>to</str<strong>on</strong>g> the adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the l<strong>at</strong>est versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP55, which includes<br />

a FSR c<strong>on</strong>trol. Notwithstanding, an assessment against the FSR c<strong>on</strong>trol has <str<strong>on</strong>g>be</str<strong>on</strong>g>en undertaken.<br />

Townhouses would <str<strong>on</strong>g>be</str<strong>on</strong>g> a much <str<strong>on</strong>g>be</str<strong>on</strong>g>tter altern<strong>at</strong>ive as a transiti<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> single residences.<br />

LEP194 provides for unit development, as proposed by this applic<strong>at</strong>i<strong>on</strong>.<br />

The sunshade devices and ro<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>to</str<strong>on</strong>g>p structure <strong>on</strong> the ro<str<strong>on</strong>g>of</str<strong>on</strong>g> terrace <strong>at</strong> the south-west end <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

development further c<strong>on</strong>tribute <str<strong>on</strong>g>to</str<strong>on</strong>g> the visual bulk and scale <str<strong>on</strong>g>of</str<strong>on</strong>g> the development as perceived from<br />

No. 6 Finlay Road. This is the area where the steep slope exempti<strong>on</strong>s already apply.<br />

The building is sited some 9 <str<strong>on</strong>g>to</str<strong>on</strong>g> 9.5 metres from the boundary <str<strong>on</strong>g>of</str<strong>on</strong>g> No. 6 Finlay Road. Additi<strong>on</strong>ally,<br />

the building is staggered <strong>at</strong> this end, resulting in <strong>on</strong>ly 11 metres in length presenting <str<strong>on</strong>g>to</str<strong>on</strong>g>wards 6<br />

Finlay Road. It is c<strong>on</strong>sidered th<strong>at</strong> the elev<strong>at</strong>i<strong>on</strong> would not <str<strong>on</strong>g>be</str<strong>on</strong>g> unduly obvious from 6 Finlay Road.<br />

Residential Amenity<br />

The bulk and mass <str<strong>on</strong>g>of</str<strong>on</strong>g> the development c<strong>on</strong>tributes <str<strong>on</strong>g>to</str<strong>on</strong>g> the loss <str<strong>on</strong>g>of</str<strong>on</strong>g> privacy and outlook for<br />

neighbouring residents.<br />

This issue is addressed within the report.<br />

The steep slope c<strong>on</strong>cessi<strong>on</strong> which has <str<strong>on</strong>g>be</str<strong>on</strong>g>en applied <str<strong>on</strong>g>to</str<strong>on</strong>g> this development has neg<strong>at</strong>ive impact <strong>on</strong><br />

residential amenity, particularly <strong>on</strong> the immedi<strong>at</strong>ely adjoining 2(c2) site. The maximum FSR<br />

should not <str<strong>on</strong>g>be</str<strong>on</strong>g> able <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> achieved <strong>on</strong> such sites.<br />

The c<strong>on</strong>trols as set out within DCP55 do not provide for a lowering <str<strong>on</strong>g>of</str<strong>on</strong>g> the FSR <strong>on</strong> steep slope sites.<br />

The departures from DCP55, including a reduced rear setback and reduced fr<strong>on</strong>t setback, have<br />

effectively resulted in excess <str<strong>on</strong>g>of</str<strong>on</strong>g> 7.5 additi<strong>on</strong>al metres <str<strong>on</strong>g>to</str<strong>on</strong>g> the south-west elev<strong>at</strong>i<strong>on</strong> width <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

building when perceived from 4B Finlay Road.<br />

This is addressed within the report <str<strong>on</strong>g>be</str<strong>on</strong>g>low.<br />
