22 Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004 Pre-development applic<strong>at</strong>i<strong>on</strong> c<strong>on</strong>sult<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>held</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g>tween Council<br />

Officers and applicants. C<strong>on</strong>cern was raised about the limited fr<strong>on</strong>t<br />

setback, the height <str<strong>on</strong>g>of</str<strong>on</strong>g> the building (which appeared <str<strong>on</strong>g>to</str<strong>on</strong>g> exceed LEP194<br />

requirements) and the building depth (which appeared <str<strong>on</strong>g>to</str<strong>on</strong>g> not meet<br />

with SEPP65). The pre-development applic<strong>at</strong>i<strong>on</strong> plans and the<br />

submitted development applic<strong>at</strong>i<strong>on</strong> plans are essentially identical.<br />

29 Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004 Applic<strong>at</strong>i<strong>on</strong> lodged.<br />

15 Decem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004 Request from Council <str<strong>on</strong>g>to</str<strong>on</strong>g> the applicant <str<strong>on</strong>g>to</str<strong>on</strong>g> provide a C<strong>on</strong>structi<strong>on</strong><br />

Management Plan.<br />

25 January <strong>2005</strong> Indic<strong>at</strong>ive C<strong>on</strong>structi<strong>on</strong> Management Plan and Flora and Fauna<br />

Assessment submitted.<br />

18 February <strong>2005</strong> Appeal against Council’s deemed refusal <str<strong>on</strong>g>of</str<strong>on</strong>g> the applic<strong>at</strong>i<strong>on</strong> filed in the<br />

Land and Envir<strong>on</strong>ment Court. The appeal was lodged <strong>on</strong> the 42 nd day<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the applic<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g>ing with Council.<br />

9 February <strong>2005</strong> Comments received from Council’s C<strong>on</strong>sultant Urban Designer. A<br />

num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> suggesti<strong>on</strong>s were made by the C<strong>on</strong>sultant Urban Designer<br />

(issues discussed within the c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> this report).<br />

24 February <strong>2005</strong> Comments received from Council’s Landscape Officer. Several<br />

c<strong>on</strong>cerns raised (issues discussed within the c<strong>on</strong>tent <str<strong>on</strong>g>of</str<strong>on</strong>g> this report).<br />

24 March <strong>2005</strong> Additi<strong>on</strong>al plans received from applicant clarifying inc<strong>on</strong>sistencies<br />

within the plans.<br />

8 April <strong>2005</strong> Issues filed by Council in resp<strong>on</strong>se <str<strong>on</strong>g>to</str<strong>on</strong>g> the deemed refusal appeal as<br />

follows:<br />
