The last callover for the appeal was ong>heldong> on 12 April 2005, at which the matter has again ong>beong>en reserved for callover on 20 April 2005. By that time it is expected that the Council and the appellant will have agreed upon a court appointed expert, and formulated a timetable for evidence and range ong>ofong> hearing dates. There is no hisong>toong>ry ong>ofong> the site relevant ong>toong> the subject development application. Development application hisong>toong>ry: DA1270/04 22 Novemong>beong>r 2004 Pre-development application consultation ong>heldong> ong>beong>tween Council Officers and applicants. Concern was raised about the limited front setback, the height ong>ofong> the building (which appeared ong>toong> exceed LEP194 requirements) and the building depth (which appeared ong>toong> not meet with SEPP65). The pre-development application plans and the submitted development application plans are essentially identical. 29 Novemong>beong>r 2004 Application lodged. 15 Decemong>beong>r 2004 Request from Council ong>toong> the applicant ong>toong> provide a Construction Management Plan. 25 January 2005 Indicative Construction Management Plan and Flora and Fauna Assessment submitted. 18 February 2005 Appeal against Council’s deemed refusal ong>ofong> the application filed in the Land and Environment Court. The appeal was lodged on the 42 nd day ong>ofong> the application ong>beong>ing with Council. 9 February 2005 Comments received from Council’s Consultant Urban Designer.
