Ordinary Meeting <strong>of</strong> Council - 26 April 2005 18 / 2 Item 18 S02252 13 April 2005 PURPOSE OF REPORT To present amended Draft Development Control Plan (DCP) No 47 - Water Management <strong>to</strong> Council for adoption. BACKGROUND At its <strong>meeting</strong> on 23 March 2004, Council adopted Development Control Plan (DCP) 47 with a resolution: C. That Draft DCP47 <strong>be</strong> reviewed upon commencement <strong>of</strong> BASIX. The Department <strong>of</strong> Infrastructure, Planning and Natural Resource’s (DIPNR) Building Sustainability Index (BASIX) for developments commenced on 1 July 2004. The introduction <strong>of</strong> BASIX rendered some elements <strong>of</strong> DCP 47 obsolete, specifically requirements for rainwater tanks and water conservation in the home. Council has also recently introduced a new Riparian Policy and resolved <strong>to</strong> incorporate the relevant changes in<strong>to</strong> the DCP. Since the introduction <strong>of</strong> the DCP, Council has noted that the DCP has <strong>be</strong>en interpreted as allowing a 100% replacement <strong>of</strong> on-site detention with rainwater tanks, even for large developments. This was not the intent <strong>of</strong> the concessions included in the DCP, as OSD is <strong>of</strong>ten necessary <strong>to</strong> reduce the impact <strong>of</strong> flooding on downstream properties, while retention does not necessary ensure sufficient protection. Amendments are therefore proposed <strong>to</strong> DCP47 in relation property drainage <strong>to</strong> clarify the limit <strong>of</strong> OSD concession, <strong>to</strong> meet requirements <strong>of</strong> BASIX and <strong>to</strong> incorporate information as required by the Riparian Policy. At its <strong>meeting</strong> <strong>of</strong> 1 February 2005, Council resolved <strong>to</strong> place Draft DCP47 on exhibition for a period <strong>of</strong> at least 28 days. COMMENTS Exhibition The Draft DCP was exhibited from 23 February 2005 <strong>to</strong> 23 March 2005. No submissions were received. All proposed changes are highlighted in the attachment circulated separately. Amendments <strong>to</strong> Chapter 1 – Introduction Minor changes only are proposed in this chapter so that section 1.7 correctly reflects the current status <strong>of</strong> BASIX and Council’s recently adopted DCPs. Ordinary Meeting <strong>of</strong> Council - 26 April 2005 18 / 3 Item 18 S02252 13 April 2005 Amendments <strong>to</strong> Chapter 2 – Dictionary <strong>of</strong> Definitions Minor changes are proposed <strong>to</strong> some definitions in order <strong>to</strong> make more clear the intent <strong>of</strong> the document. It is also proposed <strong>to</strong> add a definition <strong>of</strong> “Sydney Water” as this body is referred <strong>to</strong> a num<strong>be</strong>r <strong>of</strong> times in the Plan. Amendments <strong>to</strong> Chapter 3 – Determining Development Type and Location Minor changes only are proposed <strong>to</strong> wording in order <strong>to</strong> make more clear Council’s intent with regard <strong>to</strong> the Locations. Amendments <strong>to</strong> Chapter 4 – Site Planning and Building Design The amendments proposed <strong>to</strong> Chapter 4 are primarily the addition <strong>of</strong> controls consistent with the recently adopted Riparian Policy. Inclusion <strong>of</strong> these controls also entails the addition <strong>of</strong> an appendix containing riparian mapping information. The new controls will require that development and associated services are located a reasonable distance from riparian areas. Amendments <strong>to</strong> Chapter 5 – S<strong>to</strong>rmwater Discharge Leaving the Site It is proposed <strong>to</strong> amend Chapter 5 so as <strong>to</strong> enable pump-out systems <strong>to</strong> <strong>be</strong> employed for certain types <strong>of</strong> Location D development, specifically developments up <strong>to</strong> and including new single dwellings where an easement for gravity drainage cannot <strong>be</strong> obtained. Provided that these developments are subject <strong>to</strong> strict controls regarding the impact <strong>of</strong> the pump-out system on the receiving catchment, <strong>to</strong>gether with stringent back up systems provided on-site in the event <strong>of</strong> pump failure/power outages (refer <strong>to</strong> controls in proposed section 5.7.9), there is no technical reason that a pump-out should not <strong>be</strong> considered in certain circumstances where an easement cannot <strong>be</strong> obtained. Some minor changes <strong>to</strong> wording are also proposed so as <strong>to</strong> improve the clarity <strong>of</strong> the document. Amendments <strong>to</strong> Chapter 6 – On-Site S<strong>to</strong>rmwater Management Rainwater tanks were introduced as a manda<strong>to</strong>ry element <strong>of</strong> on-site s<strong>to</strong>rmwater management so as <strong>to</strong> reduce the risk <strong>of</strong> <strong>to</strong>tal system failure as well as <strong>to</strong> help minimise demand on the mains water. The adopted DCP allows for concessions from OSD when OSR systems (eg. water tanks) are employed. It was not intended, however, that OSD systems <strong>be</strong> eliminated as a matter <strong>of</strong> course when concession options were introduced in<strong>to</strong> the DCP. Elimination <strong>of</strong> OSD s<strong>to</strong>rage in development applications is commonly occurring in development application proposals for Type 4 (dual occupancy), Type 5 (multi-unit) and Type 6 (business, commercial or retail premises). This is expected <strong>to</strong> cause problems in the future, following further concentration <strong>of</strong> medium density developments proposed adjoining the rail corridor, especially as these are situated on the ridge <strong>of</strong> the catchments where they have the potential <strong>to</strong> impact on a greater num<strong>be</strong>r <strong>of</strong> downstream properties. Particularly given the downstream capacity <strong>of</strong> Council systems, the magnitude <strong>of</strong> some <strong>of</strong> the (concentrated) uncontrolled discharges from these large sites could <strong>be</strong> very large. It is therefore important that Council review its stance on OSD and OSR for sites such as these. In doing so, it is also important <strong>to</strong> consider the issue <strong>of</strong> overflow from rainwater tanks in the event <strong>of</strong> pump failure due <strong>to</strong> a power outage occurring in a major s<strong>to</strong>rm.
