PURPOSE OF REPORT
For Council <strong>to</strong> consider Draft (Heritage Conservation) Local Environmental Plan No 30
(DHLEP30) - UTS Kuring-gai Campus following exhibition.
BACKGROUND
Council engaged City Plan Heritage in March 2004 <strong>to</strong> prepare the heritage assessment in
accordance with its resolution <strong>of</strong> 4 Novem<strong>be</strong>r 2003 for the land known as the University <strong>of</strong>
Technology Sydney – Kuring-gai Campus, 100 E<strong>to</strong>n Road, Lindfield. The final heritage report
was received in August 2004. It found the site <strong>to</strong> have both local and State heritage significance.
The Heritage report came <strong>to</strong> the following conclusion:
This heritage assessment concludes that the UTS Ku-ring-gai site is <strong>of</strong> local and state
significance. It is appropriate <strong>to</strong> recommending the listing <strong>of</strong> the site as a heritage item
on the State Heritage Register and under the Ku-ring-gai Planning Scheme Ordinance.
The curtilage <strong>of</strong> the site recommended for listing comprises the whole <strong>of</strong> the site (land
parcels Lot 5 <strong>of</strong> DP 32292 and Lot 1 <strong>of</strong> DP 523448). The site also has an important
visual setting, including distant view <strong>to</strong> and from the site <strong>of</strong> the south and south east.
The identification <strong>of</strong> UTS Kuring-gai as a site <strong>of</strong> cultural heritage significance raises
obligations on the part <strong>of</strong> the site managers, users, and approval authorities <strong>to</strong> ensure
that its significant elements are conserved in accordance with accepted conservation
processes and principles. Any future development will need <strong>to</strong> pay due regard <strong>to</strong> the
built and landscape values <strong>of</strong> the site, and in accordance with Copyright (Moral Rights)
legislation, the architects and landscape architects should <strong>be</strong> consulted. Opportunities
for additional development are limited given the extent <strong>of</strong> the significant buildings and
the significance and sensitivity <strong>of</strong> the natural bushland and cultural landscape.
On the 24 August 2004 Council resolved:
A. That Council prepares a Local Environmental Plan <strong>to</strong> include the UTS site, Lindfield as
a draft heritage item in Schedule 7 <strong>of</strong> the Ku-ring-gai Planning Scheme Ordinance.
B. That due <strong>to</strong> its assessed State level <strong>of</strong> heritage significance, nominate the UTS Lindfield
site <strong>to</strong> the NSW Heritage Council for inclusion in the State Heritage Register.
C. That Council notifies the Department <strong>of</strong> Infrastructure, Planning and Natural
Resources <strong>of</strong> its intension <strong>to</strong> prepare a draft Local Environmental Plan in accordance
with Section 54 <strong>of</strong> the EP&A Act and notify relevant authorities in accordance with
Section 62 <strong>of</strong> the EP&A Act.
D. That Council notifies the University and all affected properties <strong>of</strong> its decision.
E. That the Draft Plan <strong>be</strong> placed on exhibition in accordance with the requirements <strong>of</strong> the
EP&A Act and Regulations.
