PURPOSE OF REPORT<br />
For Council <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>sider Draft (Heritage C<strong>on</strong>serv<strong>at</strong>i<strong>on</strong>) Local Envir<strong>on</strong>mental Plan No 30<br />
(DHLEP30) - UTS Kuring-gai Campus following exhibiti<strong>on</strong>.<br />
BACKGROUND<br />
Council engaged City Plan Heritage in March 2004 <str<strong>on</strong>g>to</str<strong>on</strong>g> prepare the heritage assessment in<br />
accordance with its resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> 4 Novem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2003 for the land known as the University <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
Technology Sydney – Kuring-gai Campus, 100 E<str<strong>on</strong>g>to</str<strong>on</strong>g>n Road, Lindfield. The final heritage report<br />
was received in August 2004. It found the site <str<strong>on</strong>g>to</str<strong>on</strong>g> have both local and St<strong>at</strong>e heritage significance.<br />
The Heritage report came <str<strong>on</strong>g>to</str<strong>on</strong>g> the following c<strong>on</strong>clusi<strong>on</strong>:<br />
This heritage assessment c<strong>on</strong>cludes th<strong>at</strong> the UTS Ku-ring-gai site is <str<strong>on</strong>g>of</str<strong>on</strong>g> local and st<strong>at</strong>e<br />
significance. It is appropri<strong>at</strong>e <str<strong>on</strong>g>to</str<strong>on</strong>g> recommending the listing <str<strong>on</strong>g>of</str<strong>on</strong>g> the site as a heritage item<br />
<strong>on</strong> the St<strong>at</strong>e Heritage Register and under the Ku-ring-gai Planning Scheme Ordinance.<br />
The curtilage <str<strong>on</strong>g>of</str<strong>on</strong>g> the site recommended for listing comprises the whole <str<strong>on</strong>g>of</str<strong>on</strong>g> the site (land<br />
parcels Lot 5 <str<strong>on</strong>g>of</str<strong>on</strong>g> DP 32292 and Lot 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> DP 523448). The site also has an important<br />
visual setting, including distant view <str<strong>on</strong>g>to</str<strong>on</strong>g> and from the site <str<strong>on</strong>g>of</str<strong>on</strong>g> the south and south east.<br />
The identific<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> UTS Kuring-gai as a site <str<strong>on</strong>g>of</str<strong>on</strong>g> cultural heritage significance raises<br />
oblig<strong>at</strong>i<strong>on</strong>s <strong>on</strong> the part <str<strong>on</strong>g>of</str<strong>on</strong>g> the site managers, users, and approval authorities <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure<br />
th<strong>at</strong> its significant elements are c<strong>on</strong>served in accordance with accepted c<strong>on</strong>serv<strong>at</strong>i<strong>on</strong><br />
processes and principles. Any future development will need <str<strong>on</strong>g>to</str<strong>on</strong>g> pay due regard <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />
built and landscape values <str<strong>on</strong>g>of</str<strong>on</strong>g> the site, and in accordance with Copyright (Moral Rights)<br />
legisl<strong>at</strong>i<strong>on</strong>, the architects and landscape architects should <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>sulted. Opportunities<br />
for additi<strong>on</strong>al development are limited given the extent <str<strong>on</strong>g>of</str<strong>on</strong>g> the significant buildings and<br />
the significance and sensitivity <str<strong>on</strong>g>of</str<strong>on</strong>g> the n<strong>at</strong>ural bushland and cultural landscape.<br />
On the 24 August 2004 Council resolved:<br />
A. Th<strong>at</strong> Council prepares a Local Envir<strong>on</strong>mental Plan <str<strong>on</strong>g>to</str<strong>on</strong>g> include the UTS site, Lindfield as<br />
a draft heritage item in Schedule 7 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Ku-ring-gai Planning Scheme Ordinance.<br />
B. Th<strong>at</strong> due <str<strong>on</strong>g>to</str<strong>on</strong>g> its assessed St<strong>at</strong>e level <str<strong>on</strong>g>of</str<strong>on</strong>g> heritage significance, nomin<strong>at</strong>e the UTS Lindfield<br />
site <str<strong>on</strong>g>to</str<strong>on</strong>g> the NSW Heritage Council for inclusi<strong>on</strong> in the St<strong>at</strong>e Heritage Register.<br />
C. Th<strong>at</strong> Council notifies the Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Infrastructure, Planning and N<strong>at</strong>ural<br />
Resources <str<strong>on</strong>g>of</str<strong>on</strong>g> its intensi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> prepare a draft Local Envir<strong>on</strong>mental Plan in accordance<br />
with Secti<strong>on</strong> 54 <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act and notify relevant authorities in accordance with<br />
Secti<strong>on</strong> 62 <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act.<br />
D. Th<strong>at</strong> Council notifies the University and all affected properties <str<strong>on</strong>g>of</str<strong>on</strong>g> its decisi<strong>on</strong>.<br />
E. Th<strong>at</strong> the Draft Plan <str<strong>on</strong>g>be</str<strong>on</strong>g> placed <strong>on</strong> exhibiti<strong>on</strong> in accordance with the requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />
EP&A Act and Regul<strong>at</strong>i<strong>on</strong>s.<br />
