BACKGROUND: On 24 August 2004 Council resolved ong>toong> prepare a Local Environmental Plan ong>toong> include the UTS Kuring-gai Campus, Lindfield as a draft heritage item in Schedule 7 ong>ofong> the Ku-ring-gai Planning Scheme Ordinance. DHLEP30 was then placed on public exhibition from 27 Ocong>toong>ong>beong>r ong>toong> 26 Novemong>beong>r 2004. COMMENTS: A ong>toong>tal ong>ofong> 18 submissions were received with 3 from State agencies, 3 from adjoining local government Councils, 1 submission from the Kuring-gai Heritage Advisory Committee and 12 submissions from the general public. RECOMMENDATION: That Council adopt Draft (Heritage Conservation) Local Environmental Plan No 30 UTS Kuring-gai Campus, Lindfield and submit the Draft Plan ong>toong> the Minister with a report under Section 69 ong>ofong> the Environmental Planning and Assessment Act 1979 with a request that the Plan ong>beong> made. BACKGROUND Council engaged City Plan Heritage in March 2004 ong>toong> prepare the heritage assessment in accordance with its resolution ong>ofong> 4 Novemong>beong>r 2003 for the land known as the University ong>ofong> Technology Sydney – Kuring-gai Campus, 100 Eong>toong>n Road, Lindfield. The final heritage report was received in August 2004. It found the site ong>toong> have both local and State heritage significance. The Heritage report came ong>toong> the following conclusion: This heritage assessment concludes that the UTS Ku-ring-gai site is ong>ofong> local and state significance. It is appropriate ong>toong> recommending the listing ong>ofong> the site as a heritage item on the State Heritage Register and under the Ku-ring-gai Planning Scheme Ordinance. The curtilage ong>ofong> the site recommended for listing comprises the whole ong>ofong> the site (land parcels Lot 5 ong>ofong> DP 32292 and Lot 1 ong>ofong> DP 523448). The site also has an important visual setting, including distant view ong>toong> and from the site ong>ofong> the south and south east. The identification ong>ofong> UTS Kuring-gai as a site ong>ofong> cultural heritage significance raises obligations on the part ong>ofong> the site managers, users, and approval authorities ong>toong> ensure that its significant elements are conserved in accordance with accepted conservation processes and principles. Any future development will need ong>toong> pay due regard ong>toong> the built and landscape values ong>ofong> the site, and in accordance with Copyright (Moral Rights) legislation, the architects and landscape architects should ong>beong> consulted. Opportunities for additional development are limited given the extent ong>ofong> the significant buildings and the significance and sensitivity ong>ofong> the natural bushland and cultural landscape. On the 24 August 2004 Council resolved: A. That Council prepares a Local Environmental Plan ong>toong> include the UTS site, Lindfield as a draft heritage item in Schedule 7 ong>ofong> the Ku-ring-gai Planning Scheme Ordinance. B. That due ong>toong> its assessed State level ong>ofong> heritage significance, nominate the UTS Lindfield site ong>toong> the NSW Heritage Council for inclusion in the State Heritage Register. C. That Council notifies the Department ong>ofong> Infrastructure, Planning and Natural Resources ong>ofong> its intension ong>toong> prepare a draft Local Environmental Plan in accordance with Section 54 ong>ofong> the EP&A Act and notify relevant authorities in accordance with Section 62 ong>ofong> the EP&A Act. D. That Council notifies the University and all affected properties ong>ofong> its decision. E. C. Th<strong>at</strong> Council notifies the Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Infrastructure, Planning and N<strong>at</strong>ural<br />

Resources <str<strong>on</strong>g>of</str<strong>on</strong>g> its intensi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> prepare a draft Local Envir<strong>on</strong>mental Plan in accordance<br />

with Secti<strong>on</strong> 54 <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act and notify relevant authorities in accordance with<br />

Secti<strong>on</strong> 62 <str<strong>on</strong>g>of</str<strong>on</strong>g> the EP&A Act.<br />

D. Th<strong>at</strong> Council notifies the University and all affected properties <str<strong>on</strong>g>of</str<strong>on</strong>g> its decisi<strong>on</strong>.<br />

E. Th<strong>at</strong> the Draft Plan <str<strong>on</strong>g>be</str<strong>on</strong>g> placed <strong>on</strong> exhibiti<strong>on</strong> in accordance with the requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

EP&A Act and Regul<strong>at</strong>i<strong>on</strong>s.<br />
