SSMRG and the Northern Suburbs Agricultural and Horticultural Society (NSA&HS) regarding
joint use <strong>of</strong> the craft pavilion.
The Department <strong>of</strong> Lands was advised <strong>of</strong> the proposed licence on 8 February 2005.
Following Council’s resolution <strong>of</strong> the proposed licence, all relevant documentation will <strong>be</strong>
forwarded <strong>to</strong> the Department <strong>of</strong> Lands for the Minister’s consent.
The Guild has provided a letter <strong>of</strong> support (refer <strong>to</strong> Attachment 3) for the proposed licence,
including agreement with the terms <strong>of</strong> the licence as proposed <strong>to</strong> Council.
FINANCIAL CONSIDERATIONS
The Licensee is responsible for the payment <strong>of</strong> 50% <strong>of</strong> Council’s legal fees associated with the
preparation and finalisation <strong>of</strong> the licence agreement and will reimburse Council for the cost <strong>of</strong> the
security partition as a condition <strong>of</strong> the licence.
Council has not undertaken a specific market valuation <strong>of</strong> the proposed licence fee, therefore no fee
is incurred. A comparable market rate <strong>to</strong> that utilised for the Model Flying Club licence has <strong>be</strong>en
used <strong>to</strong> determine the proposed licence fee.
Detailed terms and conditions <strong>of</strong> the proposed licence area are outlined in the attached Draft Heads
<strong>of</strong> Agreement (refer <strong>to</strong> Attachment 2)
Attachment 2 shows the proposed rent structure for the 5 year licence, which is based on a reduction
in Council subsidy (Rental Rebate) from 90% <strong>to</strong> 80% over the term <strong>of</strong> the licence.
CONSULTATION WITH OTHER COUNCIL DEPARTMENTS
Open Space has consulted with Finance and Business Development about the proposed 5 year
licence, terms and conditions.
SUMMARY
The proposed new five (5) year licence is <strong>be</strong>tween Council as Reserve Trust Manager and NSW
School Students Model Railway Guild Inc and would commence from the date <strong>of</strong> Council’s
Resolution.
The licence also requires the consent <strong>of</strong> the Department <strong>of</strong> Land’s Minister administering the
Crown Lands Act 1989 and agreement has <strong>be</strong>en reached with the Guild on the licence as proposed
<strong>to</strong> Council.
