Reflecting this desire, the clubs have recently received development approval for extensi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

premises comprising a large s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage / <str<strong>on</strong>g>meeting</str<strong>on</strong>g> room and extensive remodeling and extensi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

downstairs changerooms. A c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sent requires th<strong>at</strong> upgrading (including access works)<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the publicly available <str<strong>on</strong>g>to</str<strong>on</strong>g>ilets <str<strong>on</strong>g>be</str<strong>on</strong>g> undertaken in c<strong>on</strong>juncti<strong>on</strong> with other approved works. These<br />

works are <str<strong>on</strong>g>be</str<strong>on</strong>g>ing funded by the clubs under close supervisi<strong>on</strong> from Council <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers.<br />

The general use <str<strong>on</strong>g>of</str<strong>on</strong>g> and access <str<strong>on</strong>g>to</str<strong>on</strong>g> these facilities will <str<strong>on</strong>g>be</str<strong>on</strong>g> markedly improved. Given the extent <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

investment in<str<strong>on</strong>g>to</str<strong>on</strong>g> the facility and the <str<strong>on</strong>g>be</str<strong>on</strong>g>nefit <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed works <str<strong>on</strong>g>to</str<strong>on</strong>g> the broader community, the<br />

Rugby Club have requested a l<strong>on</strong>ger period <str<strong>on</strong>g>of</str<strong>on</strong>g> tenure than is generally c<strong>on</strong>sidered.<br />

Staff have assessed and negoti<strong>at</strong>ed the proposed licence <strong>on</strong> the basis <str<strong>on</strong>g>of</str<strong>on</strong>g> formalising broader access<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the facility for the cricket clubs, for other community groups when the facility is available and<br />

also in recogniti<strong>on</strong> th<strong>at</strong> the clubs will <str<strong>on</strong>g>be</str<strong>on</strong>g> paying for the upgrade <str<strong>on</strong>g>of</str<strong>on</strong>g> publicly available amenities.<br />

Any improvement <str<strong>on</strong>g>of</str<strong>on</strong>g> a structural n<strong>at</strong>ure <str<strong>on</strong>g>to</str<strong>on</strong>g> the clubhouse, regardless <str<strong>on</strong>g>of</str<strong>on</strong>g> the funding source, shall<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>come the absolute property <str<strong>on</strong>g>of</str<strong>on</strong>g> Council <strong>at</strong> the expir<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the licence. This does, <str<strong>on</strong>g>of</str<strong>on</strong>g> course,<br />

exclude any training or recre<strong>at</strong>i<strong>on</strong>al equipment provided by the Club (n<strong>on</strong>-fixtures).<br />

COMMENTS<br />

St Ives Rugby Club Inc have <str<strong>on</strong>g>be</str<strong>on</strong>g>en occupying the clubhouse since 1956. Since th<strong>at</strong> time the Rugby<br />

Club have made c<strong>on</strong>siderable additi<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> the facility, <strong>at</strong> their own expense. In additi<strong>on</strong> the Rugby<br />

Club has recently received Council Development Approval <str<strong>on</strong>g>to</str<strong>on</strong>g> install and upgrade floodlights <strong>on</strong> the<br />

oval th<strong>at</strong> meet the relevant Australian Standards. The bulk <str<strong>on</strong>g>of</str<strong>on</strong>g> the funds required have <str<strong>on</strong>g>be</str<strong>on</strong>g>en<br />

provided by the Rugby Club, with $15, 000 c<strong>on</strong>tributi<strong>on</strong> from Council. These lights are now<br />

oper<strong>at</strong>i<strong>on</strong>al.<br />

The St Ives Rugby Club Inc. under the proposal licence have exclusive use <str<strong>on</strong>g>of</str<strong>on</strong>g> the upstairs recre<strong>at</strong>i<strong>on</strong><br />

room, however, the St Ives Senior Cricket Club and St Ives Junior Cricket Clubs have formal<br />

authorised use <str<strong>on</strong>g>of</str<strong>on</strong>g> the change rooms, when using the oval <strong>at</strong> times other than those <str<strong>on</strong>g>of</str<strong>on</strong>g> the Rugby<br />

Club under the proposed licence.<br />

Whilst the licence would <str<strong>on</strong>g>be</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g>tween St Ives Rugby Club Inc. and Council, both cricket clubs have<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>en formally involved in the negoti<strong>at</strong>i<strong>on</strong>. Agreement has <str<strong>on</strong>g>be</str<strong>on</strong>g>en reached <str<strong>on</strong>g>be</str<strong>on</strong>g>tween all parties th<strong>at</strong><br />

ensure access during the summer seas<strong>on</strong> for the cricket clubs (Attachment 2). This agreement is<br />

built in<str<strong>on</strong>g>to</str<strong>on</strong>g> the licence as well as the potential for other community groups <str<strong>on</strong>g>to</str<strong>on</strong>g> access the facility.<br />

The Rugby Club have had previous agreements with Council <str<strong>on</strong>g>to</str<strong>on</strong>g> formalise their use <str<strong>on</strong>g>of</str<strong>on</strong>g> the facility,<br />

however, the last agreement expired 15 March 2004. Discussi<strong>on</strong>s c<strong>on</strong>cerning a new licence<br />

commenced prior <str<strong>on</strong>g>to</str<strong>on</strong>g> this d<strong>at</strong>e and the clubs have remained <strong>on</strong> a m<strong>on</strong>th by m<strong>on</strong>th basis since then.<br />

The Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Lands was advised <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed licence and period <str<strong>on</strong>g>of</str<strong>on</strong>g> tenure <strong>on</strong> 10 Sept<br />

2004. They have not expressed any oppositi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposal.<br />

The Rugby Club primarily makes full use <str<strong>on</strong>g>of</str<strong>on</strong>g> the clubroom <str<strong>on</strong>g>be</str<strong>on</strong>g>tween about February and Septem<str<strong>on</strong>g>be</str<strong>on</strong>g>r<br />

when training is undertaken during the week and games played <strong>on</strong> the weekends. During the<br />

summer m<strong>on</strong>ths the <str<strong>on</strong>g>to</str<strong>on</strong>g>p floor is secured except for fundraising activities and Committee <str<strong>on</strong>g>meeting</str<strong>on</strong>g>s<br />
