Reflecting this desire, the clubs have recently received development approval for extension <strong>to</strong> the
premises comprising a large s<strong>to</strong>rage / <strong>meeting</strong> room and extensive remodeling and extension <strong>of</strong> the
downstairs changerooms. A condition <strong>of</strong> consent requires that upgrading (including access works)
<strong>to</strong> the publicly available <strong>to</strong>ilets <strong>be</strong> undertaken in conjunction with other approved works. These
works are <strong>be</strong>ing funded by the clubs under close supervision from Council <strong>of</strong>ficers.
The general use <strong>of</strong> and access <strong>to</strong> these facilities will <strong>be</strong> markedly improved. Given the extent <strong>of</strong>
investment in<strong>to</strong> the facility and the <strong>be</strong>nefit <strong>of</strong> the proposed works <strong>to</strong> the broader community, the
Rugby Club have requested a longer period <strong>of</strong> tenure than is generally considered.
Staff have assessed and negotiated the proposed licence on the basis <strong>of</strong> formalising broader access
<strong>to</strong> the facility for the cricket clubs, for other community groups when the facility is available and
also in recognition that the clubs will <strong>be</strong> paying for the upgrade <strong>of</strong> publicly available amenities.
Any improvement <strong>of</strong> a structural nature <strong>to</strong> the clubhouse, regardless <strong>of</strong> the funding source, shall
<strong>be</strong>come the absolute property <strong>of</strong> Council at the expiration <strong>of</strong> the licence. This does, <strong>of</strong> course,
exclude any training or recreational equipment provided by the Club (non-fixtures).
COMMENTS
St Ives Rugby Club Inc have <strong>be</strong>en occupying the clubhouse since 1956. Since that time the Rugby
Club have made considerable additions <strong>to</strong> the facility, at their own expense. In addition the Rugby
Club has recently received Council Development Approval <strong>to</strong> install and upgrade floodlights on the
oval that meet the relevant Australian Standards. The bulk <strong>of</strong> the funds required have <strong>be</strong>en
provided by the Rugby Club, with $15, 000 contribution from Council. These lights are now
operational.
The St Ives Rugby Club Inc. under the proposal licence have exclusive use <strong>of</strong> the upstairs recreation
room, however, the St Ives Senior Cricket Club and St Ives Junior Cricket Clubs have formal
authorised use <strong>of</strong> the change rooms, when using the oval at times other than those <strong>of</strong> the Rugby
Club under the proposed licence.
Whilst the licence would <strong>be</strong> <strong>be</strong>tween St Ives Rugby Club Inc. and Council, both cricket clubs have
<strong>be</strong>en formally involved in the negotiation. Agreement has <strong>be</strong>en reached <strong>be</strong>tween all parties that
ensure access during the summer season for the cricket clubs (Attachment 2). This agreement is
built in<strong>to</strong> the licence as well as the potential for other community groups <strong>to</strong> access the facility.
The Rugby Club have had previous agreements with Council <strong>to</strong> formalise their use <strong>of</strong> the facility,
however, the last agreement expired 15 March 2004. Discussions concerning a new licence
commenced prior <strong>to</strong> this date and the clubs have remained on a month by month basis since then.
The Department <strong>of</strong> Lands was advised <strong>of</strong> the proposed licence and period <strong>of</strong> tenure on 10 Sept
2004. They have not expressed any opposition <strong>to</strong> the proposal.
The Rugby Club primarily makes full use <strong>of</strong> the clubroom <strong>be</strong>tween about February and Septem<strong>be</strong>r
when training is undertaken during the week and games played on the weekends. During the
summer months the <strong>to</strong>p floor is secured except for fundraising activities and Committee <strong>meeting</strong>s
