The broad aims <strong>of</strong> this Plan are as follows:-
• meet Council’s obligations in respect <strong>to</strong> Public Land Management under the requirements <strong>of</strong>
the Local Government Act 1993 (as amended)
• maximise opportunities <strong>to</strong> improve the distribution and accessibility <strong>of</strong> playgrounds and parks
• conserve and/or enhance the natural and landscape features <strong>of</strong> parks in Ku-ring-gai
• minimise impacts upon the environment and residents adjoining parks
• provide a framework for the sustainable management <strong>of</strong> playgrounds and parks
• provide access <strong>to</strong> a range <strong>of</strong> quality recreation, leisure and diversified play opportunities
based upon the needs <strong>of</strong> the community
• enable Council <strong>to</strong> enter in<strong>to</strong> contracts, leases, licences, hire or occupancy agreements which
relate <strong>to</strong> the development, maintenance or use <strong>of</strong> its parks
As with other Plans <strong>of</strong> Management this draft provides Council with the legal ability <strong>to</strong> enter in<strong>to</strong>
lease, licence or other estate agreements in relation <strong>to</strong> Park areas. This does not necessarily mean
Council will enter in<strong>to</strong> any such agreements but it is legally able <strong>to</strong> do so should the need arise.
The plan is consistent with the draft Open Space Strategy, currently in preparation with a working
party from both Open Space Reference Groups and also the subject <strong>of</strong> a report <strong>to</strong> Council on 26
April, 2005.
Under Section 612 and 705 <strong>of</strong> the Local Government Act 1993, Council is required <strong>to</strong> give public
notice <strong>of</strong> the proposed fee (purchase price). Section 612 requires that Council must give the public
notice for at least 28 days and consider any submissions <strong>be</strong>fore it can determine the fee. A fee has
<strong>be</strong>en included in Council’s Draft Management Plan 2005/2009 for the purchase <strong>of</strong> Plans <strong>of</strong>
Management, including draft plans.
Section 40A <strong>of</strong> the Local Government Act 1993 provides that Council must hold a Public Hearing
in respect <strong>of</strong> the proposed Plan <strong>of</strong> Management if the proposed Plan would have the effect <strong>of</strong>
categorising or re-categorising community land.
Following public exhibition and consultation the Draft Plan will <strong>be</strong> amended and reported back <strong>to</strong>
Council. At this point the report <strong>to</strong> Council will also include a table showing all performance
targets and strategies and the intended means for implementation.
CONSULTATION
During preparation <strong>of</strong> the Draft Plan consultation has <strong>be</strong>en undertaken with the previous Ku-ringgai
Urban Parks Advisory Committee and relevant staff. Information from previous consultation
and Council’s files has also assisted in providing important background information in formulation
<strong>of</strong> the Draft Plan.
It is proposed <strong>to</strong> exhibit the Draft Plan for 28 days with a further 14 days for public comment and
hold a public hearing in accordance with the requirements <strong>of</strong> the Local Government Act 1993.
