Both the extinguishment ong>ofong> the existing easement and creation is ong>toong> ong>beong> sought using Section 88B ong>ofong> the Conveyencing Act 1919, which is considered satisfacong>toong>ry. The terms under this Instrument are favoured such that it remains a Council easement. The song>toong>rmwater plan report No X04389-01 dated Decemong>beong>r 2004, prepared by Brown Consulting (NWS) Pty Ltd has addressed song>toong>rmwater management on the site that reduces flooding impacts on downstream properties. For both 5 and 100 year ARI’s and for all song>toong>rm durations, the developed system produces lower flow rates due ong>toong> the proposed arrangement ong>ofong> rainwater tanks, song>toong>rmwater tanks and OSD song>toong>rages. Design ong>ofong> the song>toong>rmwater requirements was undertaken in accordance with the Council’s Water Management Development Control Plan No 47. The consultant has proposed two connections inong>toong> the Council pipeline which is considered satisfacong>toong>ry. RECOMMENDATION A. That Council grants approval ong>toong> alter the terms ong>ofong> the Council easements burdening 5, 7 and 9 Rhonda Close as well as 17 and 19 Gilda Avenue ong>toong> allow the surface, roong>ofong> and song>toong>rmwaters from, Lot B in DP301211, Lots 1 and 2 in DP 614137, Lots 1 and 2 in DP 228983, Lot X in DP 401889, Lot B in DP 390737 and Lot B in DP 334713, known as 1580 - 1596 Pacific Highway inong>toong> the Council pipeline. B. The two connections ong>beong> formalised by the creation ong>ofong> easements 1.83 metres wide ong>toong> drain water pursuant ong>toong> Section 88B ong>ofong> the Conveyencing Act 1919 over 5, 7 and 9 Rhonda Close as well as 17 and 19 Gilda Avenue, Wahroonga at the applicant’s cost. C. That authority ong>beong> given ong>toong> affix the common Seal ong>ofong> the Council ong>toong> appropriate instrument for the release and creation ong>ofong> the easement. D. That altering the terms ong>ofong> the easements ong>beong> carried out by the applicant’s soliciong>toong>rs and the payment ong>ofong> ong>councilong>’s legal costs and disbursements ong>beong> paid by the applicant. Ordinary Meeting ong>ofong> Council - 26 April 2005 10 / 1 Item 10 S02388 5 April 2005 2005 TO 2006 RTA ROAD REPAIR PROGRAM EXECUTIVE SUMMARY PURPOSE OF REPORT: To advise Council ong>ofong> the Roads and Traffic Authority's ong>ofong>fer ong>ofong> funding for the 2005/2006 REPAIR Program. BACKGROUND: The RTA has ong>ofong>fered Council a funding allocation ong>ofong> $103,200 for the 2005/2006 REPAIR Program. The funding is conditional upon Council matching these funds on a dollar for dollar basis and completing the work by 30 June 2006. The funds are for the Pavement Rehabilitation ong>ofong> Eastern Road from Brentwood Avenue ong>toong> Hastings Road at an estimated cost ong>ofong> $206,400. COMMENTS: It is evident that the section ong>ofong> Eastern Road ong>beong>tween Brentwood Avenue and Hastings Road is badly cracked and is already failing. Council has ong>beong>en repairing the road by heavy patching Eastern Road for the last two financial years with the block grant funds. RECOMMENDATION: That Council accepts the 2005/2006 REPAIR Program grants from the Roads and Traffic Authority, funds its equal contribution ong>ofong> $103,200 from the proposed 2005/2006 Road rehabilitation Program and seek a review ong>ofong> Ku-ring-gai's REPAIR Grant allocation. 7 and 9 Rh<strong>on</strong>da Close as well as 17 and 19 Gilda Avenue <str<strong>on</strong>g>to</str<strong>on</strong>g> allow the surface, ro<str<strong>on</strong>g>of</str<strong>on</strong>g><br />
