Documents for executi<strong>on</strong> by the owners and Council have <str<strong>on</strong>g>be</str<strong>on</strong>g>en reviewed by Fox & Staniland acting<br />
<strong>on</strong> Council’s <str<strong>on</strong>g>be</str<strong>on</strong>g>half. Both the extinguishment <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing easement and cre<strong>at</strong>i<strong>on</strong> is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> sought<br />
using Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyencing Act 1919, which is c<strong>on</strong>sidered s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry. The terms<br />
under this Instrument are favoured such th<strong>at</strong> it remains a Council easement.<br />
The s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er plan report No X04389-01 d<strong>at</strong>ed Decem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004, prepared by Brown C<strong>on</strong>sulting<br />
(NWS) Pty Ltd has addressed s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er management <strong>on</strong> the site th<strong>at</strong> reduces flooding impacts <strong>on</strong><br />
downstream properties. For both 5 and 100 year ARI’s and for all s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm dur<strong>at</strong>i<strong>on</strong>s, the developed<br />
system produces lower flow r<strong>at</strong>es due <str<strong>on</strong>g>to</str<strong>on</strong>g> the proposed arrangement <str<strong>on</strong>g>of</str<strong>on</strong>g> rainw<strong>at</strong>er tanks, s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er<br />
tanks and OSD s<str<strong>on</strong>g>to</str<strong>on</strong>g>rages. Design <str<strong>on</strong>g>of</str<strong>on</strong>g> the s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er requirements was undertaken in accordance<br />
with the Council’s W<strong>at</strong>er Management Development C<strong>on</strong>trol Plan No 47.<br />
The c<strong>on</strong>sultant has proposed two c<strong>on</strong>necti<strong>on</strong>s in<str<strong>on</strong>g>to</str<strong>on</strong>g> the Council pipeline which is c<strong>on</strong>sidered<br />
s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry.<br />
RECOMMENDATION<br />
A. Th<strong>at</strong> Council grants approval <str<strong>on</strong>g>to</str<strong>on</strong>g> alter the terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the Council easements burdening 5,<br />
7 and 9 Rh<strong>on</strong>da Close as well as 17 and 19 Gilda Avenue <str<strong>on</strong>g>to</str<strong>on</strong>g> allow the surface, ro<str<strong>on</strong>g>of</str<strong>on</strong>g><br />
and s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>ers from, Lot B in DP301211, Lots 1 and 2 in DP 614137, Lots 1 and 2<br />
in DP 228983, Lot X in DP 401889, Lot B in DP 390737 and Lot B in DP 334713,<br />
known as 1580 - 1596 Pacific Highway in<str<strong>on</strong>g>to</str<strong>on</strong>g> the Council pipeline.<br />
B. The two c<strong>on</strong>necti<strong>on</strong>s <str<strong>on</strong>g>be</str<strong>on</strong>g> formalised by the cre<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> easements 1.83 metres wide <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
drain w<strong>at</strong>er pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyencing Act 1919 over 5, 7 and 9<br />
Rh<strong>on</strong>da Close as well as 17 and 19 Gilda Avenue, Wahro<strong>on</strong>ga <strong>at</strong> the applicant’s cost.<br />
C. Th<strong>at</strong> authority <str<strong>on</strong>g>be</str<strong>on</strong>g> given <str<strong>on</strong>g>to</str<strong>on</strong>g> affix the comm<strong>on</strong> Seal <str<strong>on</strong>g>of</str<strong>on</strong>g> the Council <str<strong>on</strong>g>to</str<strong>on</strong>g> appropri<strong>at</strong>e<br />
instrument for the release and cre<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement.<br />
D. Th<strong>at</strong> altering the terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the easements <str<strong>on</strong>g>be</str<strong>on</strong>g> carried out by the applicant’s solici<str<strong>on</strong>g>to</str<strong>on</strong>g>rs and<br />
the payment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>council</str<strong>on</strong>g>’s legal costs and disbursements <str<strong>on</strong>g>be</str<strong>on</strong>g> paid by the applicant.<br />
E. Th<strong>at</strong> the direct c<strong>on</strong>necti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> the <str<strong>on</strong>g>council</str<strong>on</strong>g> pipeline <str<strong>on</strong>g>be</str<strong>on</strong>g> undertaken in accordance with<br />
Council plan No 82-024.<br />
