Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n has approached each <str<strong>on</strong>g>of</str<strong>on</strong>g> affected owners requesting their c<strong>on</strong>sent <str<strong>on</strong>g>to</str<strong>on</strong>g> extinguish the<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er easements <strong>on</strong> their title and replaced with a new easement permitting the discharge <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er from lands in the public roadway as well as Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n.<br />

Council has requested cre<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the new easement under Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyancing Act<br />

1919.<br />

Of the five properties, Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n has obtained a <str<strong>on</strong>g>to</str<strong>on</strong>g>tal <str<strong>on</strong>g>of</str<strong>on</strong>g> four written c<strong>on</strong>sents by:<br />

• A letter from 5, 7 and 9 Rh<strong>on</strong>da Close, and<br />

• A Deed <str<strong>on</strong>g>of</str<strong>on</strong>g> Agreement from 17 Gilda Avenue.<br />

The remaining fifth c<strong>on</strong>sent from 19 Gilda Avenue was initially sought by commencing<br />

proceedings in the Supreme Court pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> Secti<strong>on</strong> 88K <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyancing Act 1919, however<br />

the owner has given written c<strong>on</strong>sent prior <str<strong>on</strong>g>to</str<strong>on</strong>g> the hearing.<br />

Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n has prepared the necessary documents for executi<strong>on</strong> by the owners who have c<strong>on</strong>sented,<br />

and submitted these <str<strong>on</strong>g>to</str<strong>on</strong>g> Council for comment. The extinguishment <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing easement was<br />

sought using Secti<strong>on</strong> 88B <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>veyencing Act 1919, and is c<strong>on</strong>sidered s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry. However,<br />

as the cre<strong>at</strong>i<strong>on</strong> (for a Transfer granting easement) was sought using the Real Property Act 1900,<br />

Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n were requested <str<strong>on</strong>g>to</str<strong>on</strong>g> liaise with Fox & Staniland acting <strong>on</strong> Council’s <str<strong>on</strong>g>be</str<strong>on</strong>g>half. Fox & Staniland<br />

have amended the proposed wording by Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n who have agreed, such th<strong>at</strong> it remains a Council<br />

easement.<br />

Assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> property s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er discharge in<str<strong>on</strong>g>to</str<strong>on</strong>g> Council pipelines<br />

An assessment was made <str<strong>on</strong>g>of</str<strong>on</strong>g> the s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er report and plans prepared by Brown C<strong>on</strong>sulting (NSW)<br />

Pty Ltd and are c<strong>on</strong>sidered s<strong>at</strong>isfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry. Design <str<strong>on</strong>g>of</str<strong>on</strong>g> the s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er requirements was undertaken in<br />

accordance with the Council’s W<strong>at</strong>er Management Development C<strong>on</strong>trol Plan No 47. A reduced<br />

plan <str<strong>on</strong>g>of</str<strong>on</strong>g> the s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er management measures and layout is shown <strong>on</strong> Attachment 2.<br />

Key devices <str<strong>on</strong>g>of</str<strong>on</strong>g> the internal s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er management system comprise;<br />

• A series <str<strong>on</strong>g>of</str<strong>on</strong>g> rainw<strong>at</strong>er tanks <str<strong>on</strong>g>to</str<strong>on</strong>g>talling 185m 3 (supplying w<strong>at</strong>er for internal use) and<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er tanks <str<strong>on</strong>g>to</str<strong>on</strong>g>talling 286 m 3 (supplying w<strong>at</strong>er for irrig<strong>at</strong>i<strong>on</strong>);<br />

• Detenti<strong>on</strong> basins for <strong>on</strong>-site s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage <str<strong>on</strong>g>to</str<strong>on</strong>g>talling 613 m 3 ; and<br />

• Two bioretenti<strong>on</strong> basins <str<strong>on</strong>g>to</str<strong>on</strong>g> reduce w<strong>at</strong>er borne pollutants. One is placed <str<strong>on</strong>g>be</str<strong>on</strong>g>fore each <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

two discharge points in<str<strong>on</strong>g>to</str<strong>on</strong>g> the Council s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er pipeline.<br />

The net result <str<strong>on</strong>g>of</str<strong>on</strong>g> these devices for s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er does not adversely impact <strong>on</strong> downstream properties<br />

or the pipe system. Specifically, these achieve:<br />

• Reduced peak flow <str<strong>on</strong>g>of</str<strong>on</strong>g> 0.32m 3 /s leaving the site compared <str<strong>on</strong>g>to</str<strong>on</strong>g> 0.9m 3 /s for existing c<strong>on</strong>diti<strong>on</strong>s<br />

from a 100 year ARI design s<str<strong>on</strong>g>to</str<strong>on</strong>g>rm event.<br />

• At Gilda Avenue, a reduced <str<strong>on</strong>g>to</str<strong>on</strong>g>tal flow from 5.7 <str<strong>on</strong>g>to</str<strong>on</strong>g> 5.0m 3 /s, and reduced peak surface flow<br />

from 4.9m 3 /s <str<strong>on</strong>g>to</str<strong>on</strong>g> 4.1m 3 /s.<br />
