PURPOSE OF REPORT<br />

To c<strong>on</strong>sider a request by the Applicant for 1580-1596 Pacific Highway Wahro<strong>on</strong>ga <str<strong>on</strong>g>to</str<strong>on</strong>g> alter the<br />

terms <str<strong>on</strong>g>of</str<strong>on</strong>g> a Council drainage easement over five downstream properties <str<strong>on</strong>g>to</str<strong>on</strong>g> permit c<strong>on</strong>necti<strong>on</strong> and<br />

discharge in<str<strong>on</strong>g>to</str<strong>on</strong>g> a Council pipeline.<br />

BACKGROUND<br />

The applicant, Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n Apartments Pty Ltd has submitted a Development Applic<strong>at</strong>i<strong>on</strong> (DA1081/04)<br />

for the redevelopment <str<strong>on</strong>g>of</str<strong>on</strong>g> seven residential buildings, c<strong>on</strong>taining 157 apartments.<br />

The development is loc<strong>at</strong>ed <strong>at</strong> 1580-1596 Pacific Highway situ<strong>at</strong>ed <strong>at</strong> the corner <str<strong>on</strong>g>of</str<strong>on</strong>g> Munderah<br />

Street, Wahro<strong>on</strong>ga. This site comprises the following lands, Lot B in DP301211, Lots 1 and 2 in<br />

DP 614137, Lots 1 and 2 in DP 228983, Lot X in DP 401889, Lot B in DP 390737 and Lot B in DP<br />

334713.<br />

The disposal <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er from the site requires c<strong>on</strong>necti<strong>on</strong> in<str<strong>on</strong>g>to</str<strong>on</strong>g> the Council pipeline th<strong>at</strong> is<br />

c<strong>on</strong>tained within two c<strong>on</strong>secutive drainage easements, impacting <strong>on</strong> the five downstream properties.<br />

S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er <str<strong>on</strong>g>of</str<strong>on</strong>g>f Munderah Road and Pacific Highway upstream is c<strong>on</strong>veyed by a 450mm diameter<br />

pipe across the subject property. It then increases <str<strong>on</strong>g>to</str<strong>on</strong>g> a 525mm across No’s 5, 7 and 9 Rh<strong>on</strong>da<br />

Close, and <str<strong>on</strong>g>to</str<strong>on</strong>g> a 675mm diameter across No’s 17 and 19 Gilda Avenue downstream <str<strong>on</strong>g>be</str<strong>on</strong>g>fore reaching<br />

Gilda Avenue. A loc<strong>at</strong>i<strong>on</strong> plan <str<strong>on</strong>g>of</str<strong>on</strong>g> the drainage and easement is shown <strong>on</strong> Attachment 1.<br />

Existing terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement permit surface and s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>ers from the Pacific Highway,<br />

Munderah and Rh<strong>on</strong>da Close <strong>on</strong>ly. In order <str<strong>on</strong>g>to</str<strong>on</strong>g> permit the c<strong>on</strong>necti<strong>on</strong> and disposal <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er<br />

from the applicant’s property, the terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement need <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> altered, requiring letters <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

c<strong>on</strong>sent from all five affected downstream owners.<br />

Since Oc<str<strong>on</strong>g>to</str<strong>on</strong>g><str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004, Meri<str<strong>on</strong>g>to</str<strong>on</strong>g>n has negoti<strong>at</strong>ed with downstream owners and c<strong>on</strong>sulted with Council<br />

regarding easements in order <str<strong>on</strong>g>to</str<strong>on</strong>g> advance the timing for the development, r<strong>at</strong>her than postp<strong>on</strong>e until<br />

Council determin<strong>at</strong>i<strong>on</strong> <strong>on</strong> the lodged DA1081/04 with pre-commencement c<strong>on</strong>diti<strong>on</strong>s.<br />

The applicant has submitted a S<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er plan report No X04389-01 d<strong>at</strong>ed Decem<str<strong>on</strong>g>be</str<strong>on</strong>g>r 2004,<br />

prepared by Brown C<strong>on</strong>sulting (NSW) Pty Ltd <str<strong>on</strong>g>to</str<strong>on</strong>g> address s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmw<strong>at</strong>er management <strong>on</strong> the site and<br />

downstream flooding.<br />

COMMENTS<br />

Of the five properties affected downstream, there are two dedic<strong>at</strong>ed Council easements:<br />

• LD2328, 1.83 metres wide, burdening No’s 5, 7 and 9 Rh<strong>on</strong>da Close.<br />

• LD 772 1.83 metres wide burdening No’s 17 and 19 Gilda Avenue.<br />
