Overall, the design was found <strong>to</strong> <strong>be</strong> in accordance with DCP 47 requirements and is considered satisfac<strong>to</strong>ry. Integrity <strong>of</strong> the pipeline should <strong>be</strong> protected from loading by heavy machinery during construction given the low depth <strong>of</strong> cover. Council should restrict the area from heavy construction machinery by use <strong>of</strong> temporary fencing surrounding the easement, with inspection by CCTV upon completion <strong>of</strong> the dwelling <strong>to</strong> verify the pipeline condition prior <strong>to</strong> issue <strong>of</strong> occupation certificate. Erosion control measures are descri<strong>be</strong>d by notes only and need <strong>to</strong> shown on plans indicating their location and extent <strong>to</strong> avoid misinterpretation, and moni<strong>to</strong>ring for compliance. RECOMMENDATION A. That Council approves the granting <strong>of</strong> the proposed drainage easement descri<strong>be</strong>d in the instrument setting out the terms <strong>of</strong> easement intended <strong>to</strong> <strong>be</strong> created and released pursuant <strong>to</strong> section 88B Conveyancing Act 1919. These terms specify the release <strong>of</strong> Easement and Restrictive Covenant 1.22 metres wide over 15 Pearson Avenue and creation <strong>of</strong> a new Easement <strong>to</strong> Drain Water 1.22 wide over 17 Pearson Avenue and creation <strong>of</strong> a new Easement 1.6 wide and variable and Restriction on Use <strong>of</strong> Land over 15 Pearson Avenue, Gordon. B. That authority <strong>be</strong> given <strong>to</strong> affix the common Seal <strong>of</strong> the Council <strong>to</strong> the instrument for release and creation <strong>of</strong> new easements and Restriction on Use <strong>of</strong> Land. C. That altering the terms <strong>of</strong> said Easements for drainage including release and <strong>be</strong>ing conditional on payment <strong>to</strong> Council <strong>of</strong> Council's legal costs and disbursements. D. That Council approves the proposal <strong>to</strong> modify the s<strong>to</strong>rmwater drainage pipelines in accordance with revised s<strong>to</strong>rmwater plans and details, drawings GD 2.1, GD 2.4 and GD 2.7 Revision D, along with GD 2.2, GD 2.5 and GD 2.6 Revision C, prepared by K.R Stubbs & Associates Pty Ltd and subject <strong>to</strong> the following conditions: 1. The carrying out <strong>of</strong> all drainage works in accordance with the plans and specifications approved by Council at no cost <strong>to</strong> Council. 2. The works are subject <strong>to</strong> inspections. The Applicant or their engineer is <strong>to</strong> give Council at least 24 hours notice (<strong>to</strong> allow inspections) at the following stages: i. After completion <strong>of</strong> excavation and prior <strong>to</strong> pipe laying commencing. ii. After completion <strong>of</strong> pipe laying prior <strong>to</strong> backfilling, iii. On completion <strong>of</strong> pipeline installation 4. That prior <strong>to</strong> construction <strong>of</strong> the dwelling, fencing or suitable alternative <strong>be</strong> installed around the easement perimeter <strong>to</strong> prevent loading by heavy construction machinery on the area directly above the pipelines at no cost <strong>to</strong> Council. That after the dwelling is completed, an inspection <strong>of</strong> the pipeline by Closed Circuit TV or suitable alternative <strong>be</strong> undertaken <strong>to</strong> verify the structural integrity <strong>of</strong> pipelines at no cost <strong>to</strong> Council, prior <strong>to</strong> the issue <strong>of</strong> Occupation Certificate. 6. That Erosion control measures descri<strong>be</strong>d by notes on drawing GD 2.6 <strong>be</strong> amended <strong>to</strong> detail and show the location and extent <strong>of</strong> the layout on the plan.
